RE: APPROVAL OF SUBDIVISION EXEMPTION #874 - RONALD AND SUE ANN
GRABRIAN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10)(d), C.R.S.,and Section 24-1-20 of the Weld County Code,did determine at
a public meeting held in the Chambers of the Board, that certain parcels of land to be divided, as
shown on the plat known as Subdivision Exemption#874,does not come within the purview of the
definition of the terms, "subdivision" and "subdivided land," and
WHEREAS,the request for Subdivision Exemption#874 was submitted by Ronald and Sue
Ann Grabrian, 6325 Weld County Road 23, Fort Lupton, Colorado 80621, for property which is
located in part, being more particularly described as follows:
N1/2 SE1/4 of Section 35, Township 2 North, Range
67 West of the 6th P.M., Weld County, Colorado
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the above described parcels of land be, and hereby are, declared to be
exempt from the definitions of "subdivision" and "subdivided land" as set forth in
Section 30-28-101(10), C.R.S., and Section 24-1-40 of the Weld County Code.
BE IT FURTHER RESOLVED by the Board that approval of Subdivision Exemption#874,
submitted by Ronald and Sue Ann Grabrian be, and hereby is, conditional upon the following:
1. A Weld County septic permit is required for any proposed home. The septic system
shall be installed according to the Weld County Individual Sewage Disposal System
(I.S.D.S.) Regulations.
2. Prior to recording the plat:
A. The plat shall be titled Subdivision Exemption No. 874.
B. The applicant shall submit to the Weld County Department of Planning
Services evidence that any existing septic system meets all requirements of
the Weld County Department of Public Health and Environment. The Weld
County Department of Public Health and Environment was unable to locate
a septic permit for the septic system located at 6509 Weld County Road 5.
Any existing septic system which is currently not permitted through the Weld
County Department of Public Health and Environment will require an I.S.D.S.
evaluation prior to the issuance of the required septic permits. In the event
the system is found to be inadequate, the system must be brought into
compliance with current I.S.D.S. Regulations.

C. The Subdivision Exemption Lot shall use the existing residential access,as
no additional accesses shall be granted.
D. All approved accesses shall be clearly shown on the plat. The applicant shall
contact the Weld County Department of Public Works to determine if a
culvert is necessary at any approved road access. If a drainage culvert is
required,a 15-inch Corrugated Metal Pipe(CMP)is Weld County's minimum
size. If the applicant chooses to place a larger culvert, please contact the
Weld County Department of Public Works to adequately size the culvert.
E. Weld County Road 14.5 is designated on the Weld County Transportation
Plan Map as a local gravel road,which requires 60 feet of right-of-way at full
build out. There is presently 60 feet of right-of-way. A total of 30 feet from
the centerline of Weld County Road 14.5 shall be delineated as right-of-way
on the plat. This road is maintained by Weld County.
F. The applicant shall provide the Weld County Department of Planning
Services with a certificate from the Weld County Treasurer showing no
delinquent taxes exist for the original parcel.
G. The following notes shall be placed on the plat:
1) All proposed or existing structures will meet the minimum setback
and offset requirements for the Zone District in which the property is
located. Pursuant to the definition of setback in the Weld County
Code,the required setback is measured from the future right-of-way
line. No building or structure as defined and limited to those
occupancies listed as Groups A, B, E, F, H, I, M, and R in Section
302.1 of the 2003 International Building Code, shall be constructed
within a 200-foot radius of any tank battery or within a 150-foot radius
of any wellhead.Any construction within a 200-foot radius of any tank
battery, or 150-foot radius of any wellhead, shall require a variance
from the terms of the Section 23-3-10 of the Weld County Code.
2) Any future structures or uses on the site must obtain the appropriate
Zoning and Building Permits.
3) Prior to the release of Building Permits, the applicant shall submit a
recorded deed describing the lot upon which the Building Permit is
requested with the Building Permit applications. The legal description
on such deed shall include the Subdivision Exemption number.
4) Should noxious weeds exist on the property,or become established
as a result of the proposed development, the applicant/landowner
shall be responsible for controlling the noxious weeds, pursuant to
Section 15-1-10 of the Weld County Code.

5) Weld County's Right To Farm statement, as it appears in the Weld
County Code, Appendix 22-E, shall be placed on the Plat.
3. This Subdivision Exemption was approved to bring an illegal parcel into compliance
with the State of Colorado and Weld County's requirements.
4. The applicant shall submit a Mylar Plat to the Department of Planning Services to be
recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 24-8-60 of the Weld
County Code. The plat shall be submitted within sixty (60) days from the date of
approval by the Weld County Board of Commissioners. The applicant shall be
responsible for paying the recording fees.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 28th day of June, A.D., 2004.

The Subdivision Exemption is approved in accordance with information submitted in the application and

Agricultural users of the land should not be expected to change their long-
established agricultural practices to accommodate the intrusions of urban users
into a rural area. Well run agricultural activities will generate off-site impacts,
including noise from tractors and equipment; slow-moving farm vehicles on rural
roads; dust from animal pens, field work, harvest, and gravel roads; odor from
animal confinement, silage, and manure; smoke from ditch burning; flies and
mosquitoes; and the use of pesticides and fertilizers in the fields, including the
use of aerial spraying. Ditches and reservoirs cannot simply be moved out of
the way of residential development without threatening the efficient delivery of
irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be
found to be a public or private nuisance if the agricultural operation alleged to be
a nuisance employs methods or practices that are commonly or reasonably
associated with agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the
State of Delaware)with more than 3,700 miles of state and county roads outside
of municipalities. The sheer magnitude of the area to be served stretches
available resources. Law enforcement is based on responses to complaints
more than on patrols of the county and the distances which must be traveled
may delay all emergency responses, including law enforcement, ambulance,
and fire. Fire protection is usually provided by volunteers who must leave their
jobs and families to respond to emergencies. Coun

how often they are bladed, will not provide the same kind of surface expected
from a paved road. Snow removal priorities mean that roads from subdivisions
to arterials may not be cleared for several days after a major snowstorm. Snow
removal for roads within subdivisions are of the lowest priority for public works
or may be the private responsibility of the homeowners. Services in rural areas,
in many cases, will not be equivalent to municipal services. Rural dwellers
must, by necessity, be more self-sufficient that urban dwellers.
Children are exposed to different hazards in the county than in an urban or
suburban setting. Farm equipment and oil field equipment, ponds and irrigation
ditches, electrical power for pumps and center pivot operations, high speed
traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real
threats to children. Controlling children's activities is important, not only for their
safety, but also for the protection of the farmer's livelihood. Parents are
responsible for their children.
3. This Subdivision Exemption was approved to bring an illegal parcel into compliance with the
State of Colorado and Weld County's requirements.
4. The applicant shall submit a Mylar Plat to the Department of Planning Services to be recorded in
the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with
the requirements of Section 24-8-150.1 of the Weld County Code. The plat shall besubmitted
within sixty (60) days from the date of approval by theDepartment of Planning Services., The
applicant shall be responsible for paying the recording fees.

based upon satisfying the above conditions. Should an applicant be unwilling or unable to meet

This letter is to inform you that before a building permit can be released from our office the following items
need to be completed for Recorded Exemption 3038 and Subdivision Exemption 874.
1. The applicant shall provide the Weld County Department of Planning Services with a Statement
of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original
parcel.
2. The applicant shall submit to the Weld County Department of Planning Services evidence that
any existing septic system meets all requirements of the Weld County Department of Public
Health and Environment. The Weld County Department of Public Health and Environment was
unable to locate a septic permit for the septic system located at 6509 and 6508 County Road 5.
Any existing septic system which is currently not permitted through the Weld County Department
of Public Health and Environment will require an I.S.D.S. evaluation prior to the issuance of the
required septic permits. In the event the system is found to be inadequate, the system must be
brought into compliance with current I.S.D.S. regulations.
The property is currently in violation as outlined in the letter dated September 27, 2004 from Wendi Inloes
prior to recording the final Mylar her issues will also need to be resolved.
As stated above the Department of Planning Services can not release building permits until the final Mylar
for both the Recorded Exemption and Subdivision Exemption are submitted to our office for recording.

Sorry I got tied up and wasn't able to meet about this issue. The main problem I have is with which existing septic
permit goes with which trailer/mobile home.
According to Grabrian's SE-0400018, The mobile home's septic system was installed in 1984 without a permit.
This is the first mobile home closest to Cr 23. I sent a letter on February 23, 2004 stating that, and the need to
get a repair permit and provide evidence of the system along with soils report. (ISDS 04017).
To my knowledge this has not been done. Trevor said that according to you, there was a permit for this system. I
was aware that a permit had been found for a mobile home that had burned down; one he wanted to replace. I
never did an ISDS inspection on any system for which there was not an existing structure.
I would like to talk to you about this before he is scheduled to appear before the commissioners. Let me know.

The Department of Planning Services Staff has met to further consider your application for a
Recorded Exemption as well as the Subdivision Exemption in conjunction with a Recorded
Exemption Application and other materials which were submitted February 12, 2001.
Planning Services was unable to approve your application as submitted. The creation of a new lot
in the Northwestern Quarter of your property does not comply with current County regulations or
policy and would further complicate an already complicated situation.
Planning Services will however approve the use of a Recorded Exemption used in conjunction with
a Subdivision Exemption to place each of the three existing homes on their own separate and legal
lot. This proposal does not create a new lot or building site.
The issue of Zoning Violations regarding the Travel Trailers, Septic Systems, Illegally created Lot

Should the proposed alternative of using the RE/SE combination to correct the violations on the

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under
the Subdivision Exemption Standards. Our comments and requirements are as follows:
COMMENTS:
WCR 14.5 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-foot
right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld
County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89,
as amended), the required setback is measured from the future right-of-way line.
REQUIREMENTS:
The Weld County Public Works recommends approval of this application.
The applicant shall utilize the existing residential access to this parcel, and no additional accesses shall
be granted.
