RE: ACTION OF BOARD CONCERNING EARLY ACTION COMPACT FOR OZONE AND
AUTHORIZE CHAIR TO SIGN AMENDMENT
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Denver metro area is voluntarily participating in the U. S. Environmental
Protection Agency's Early Action Compact (EAC) Protocol process for the express purpose of
deferring the effective date of a nonattainment designation of the Denver area if a violation of the 8-
hour ozone NAAQS occurs in the future, and
WHEREAS, the Colorado Department of Public Health and Environment ("State Health
Department"),by letter dated January7,2004,has extended an invitation to the Counties of Elbert,
Larimer, Morgan and Weld to become a partner in the EAC, and
WHEREAS,the Board has been informed by Douglas H. Benevento, Executive Director of
the Colorado Department of Public Health and Environment,that the Board may continue this matter
until February 4, 2004,so that the Board may have additional time to consider the implications of
becoming a partner in the EAC.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that this matter be, and hereby is, continued to February 4, 2004, for further
consideration.
The above and foregoing Resolution was,on motion duly made and seconded,adopted by
the following vote on the 28th day of January, A.D., 2004.
