WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 11th day of May, 1983, and continued to May 18 , 1983, at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board for the purpose of hearing the application of Stegemen Marketing Services, Inc. , P. O. Box 1814 , Greeley, 80631, for a Use by Special Review for an "Ag" business to process and ware- house onions, on the following described real estate, to wit: Part of the NW4 of Section 23, Township 4 North, Range 66 West of the 6th P.M. , Weld County, Colorado, lying East of Union Pacific RR and North of the Western Ditch Company. WHEREAS, Section 24. 4 .2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed , finds that: 1. The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance; 2 . It is the opinion of the Board of County Commissioners t:aat the applicant has shown compliance with Section 24. 4 . 2 of the Weld County Zoning Ordinance as follows : a. The proposal is consistent with the Comprehensive Plan in that policies of the plan promote agri- businesses so long as they do not create negative impacts on the environment or the County. No such impacts have been identified with this pro- posal. The proposal is consistent with the in- tent of the Agricultural Zone District. The use is both compatible with existing agricultural activity and with land use which is contemplated to be agricultural in the Comprehensive Plan. 3. Operation and design standards provide adequate protection of the health, safety and welfare of the neighborhood and the County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners that the application for a Use by Special Review for an "Ag" business to process and warehouse onions on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached standards for Use by Special Review be adopted; 2 . The plat for the Use by Special Review permit be placed on record by the Department of Planning Services staff prior to any building permits being issued on the site. The permitted use shall be a vegetable processing and warehousing operation. 2. The Use By Special Review area shall contain the following structure; one (1) eighty (80) foot by one-hundred-fifty (150) foot warehouse. 3. The warehouse structure shall setback one hundred (100) feet from the Western Mutual Ditch as shown on the plat submitted to the Department of Planning Services. 4. No trash or garbage associated with this operation shall be allowed to enter the Western Mutual Ditch. 5. There shall be one (1) point of ingress and egress to the subject Use By Special Review area and it shall be located at least one-hundred-fifty (150) feet east of the Union Pacific Railroad and Weld County Road 44 intersection. The access shall have a fifteen (15) inch by forty (40) foot CMP Culvert. 6. Design Standards for Uses by Special Review, Section 24.5 et seq. of the Weld County Zoning Ordinance shall be complied with. 7. Operation Standards for Uses by Special Review, Section 24.6 et seq. of the Weld County Zoning Ordinance shall be complied with. 8. The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards stated above, and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shaLl be filed in the office of the Department of Planning Services. 9. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. Russell Anson, Assist= County Attorney, read the application into the record. Rod Allison, representing the Planning Department, read the favorable recommenda- tion, with conditions, from the Weld County Planning Commission. This hearing had been continued due to the fact that the mineral rights owner, Union Pacific • Railroad, had requested that an additional standard be added to the Development Standards. Jim Stegemen was present, representing the applicant. There was no representative for the mineral rights owner. Mr. Stegemen stated that he had been in contact with the representative of UPRR and they would work some- thing out. After a short discussion, Commissioner N. Carlson moved to approve this application for a Use by Special Review. Commissioner Johnson seconded the motion and it carried unanimously. Rod Allison, Planning Department representative, read the favorable recommendations of the Department of Planning Services and the Weld County Planning Commission into the record. The favorable recommendations did contain conditions that were felt necessary for the proposal. Mr. Allison said he had been contacted by Mr. Dave Karpel, Rocky Mountain Energies. Mr. Karpel represents the company which owns the mineral rights on the subject • property. Mr. Karpel indicated that they were not opposed to this proposal, but they are requesting an additional development standard which would protect their mineral rights. Mr. Allison read the standard which he had prepared and would be as follows: Development Standard #10 - Evidence of a signed agreement between the surface fee owner and the owner of the mineral rights shall be submitted to the Department of Planning Services prior to the issuance of building permits on the subject site. The applicant was not present, but Mr. Allison pointed out that there was no opposition at the Planning Commis- sion Hearing. Mr. Morrison said that the difference here is that an additional standard is being proposed. He said the Board could decide to continue this matter and contact the applicant to make sure that he attends the next hearing. After further discussion, Commissioner Johnson moved that this hearing be continued to May 18, 1983. Commissioner N. Carlson said he would be opposed to adding the additional standard. Mr. Morrison said this could be a signifi- cant issue, and he suggested that Mr. Karpel also be asked to appear. Cum- missioner Brantner seconded the motion and it carried unanimously. The following is the breakdown of these items . We would certainly appreciate it very much , if you could review this proposal as soon as possible so that we may be set up before next shipping season. Item #1 : a. Our proposal is totally related to agriculture use by furnishing the growers in the area with a facility to store, process and market their onion crop. b. The location of our proposal is near the Peckham area. We feel this would be close to all producing areas - mainly the Ft. Lupton to Eaton districts; and would be easily accessable to and from these districts . Our plan encompasses purchasing approximately 3.5 acres. 5.5 acres would remain in agriculture production and the balance would be enough to construct a modern facility to efficiently house and process onions grown in the area. c. As stated, the proposal will remain 2/3's in crop Production. The surrounding area is almost entirely in agriculture use. d. Our facility will feature the latest in this type of a facility technology. A forced air system for storage which is capable of maintaining a consistent temperature throughout the shipping season. The area surrounding this 8.5 acre site consists of the following: to the west, a feed supply business ; across the highway, a maintainance shop for vehicles ; both north and south , corn is being farmed; and to the east, a residential dwelling. We feel a properly constructed building - landscaped well - will fit easily in this location. e. N/A f. As mentioned above, our intentions will be to maintain approximately 5.5 acres in onions ; which we intend to process thru our facility. 4 r C Page 2 SMSI 3/06/83 g. Our facility will meet all 0.S.H.A. requirements and will be built for maintaining the strictest standards for safety of all who enter. All bi-products generated will be placed in the local landfill on a daily basis. Item #2, #3 and #4 are attached. Item #5: a. Approximately 8.5 acre site will be divided into a 5.5 acre of farm production land and a 2.5 acre site will be set aside to store, process and market onions for the surrounding area. b. On east side adjacent to this property is a single family dwelling and to the north - across the highway - is another family dwelling. c. We will have one 8 hour shift, 5 to 6 days per week, with 8 to 12 employees. Our operation will mainly run from August to March each year. d. We anticipate approximately 10 growers and there should be no more than 20 people on the site at any given time. e. No animals - unless in the future we feel it is necessary to have a watch dog on the premises at night. f. N/A g. One 80' X 150' aluminum sided rectangle warehouse. h. Other than employees ' vehicles , we will have farm trucks occasionally and will load semi-trucks weekly for 8 months. The only access will be a paved county road to Highway 85; which is less than 300 yards away. i . Septic system. j . No waste area will be utilized. All storage will be inside the warehouse. k. 1/4 yard canister for office and employee wastes will be removed each week. All by-products for plant will be removed each day to the local landfill . 1 . Ater all legal problems are meet, it will take 3 to 5 weeks to complete the basic structure; with another 6 to 8 weeks to complete the processing and office facilities. m.
