HomeMy WebLinkAbout840590.tiff RESOLUTION RE: APPROVAL OF APPLICATION FOR RIGHT-OF-WAY FOR MEAD GRADER SHED AND AUTHORIZATION FOR CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Weld County Department of Engineering Services has requested that an application be submitted to the State Board of Land Commissioners for right-of-way on which to place a grader shed for Weld County' s 20th grader district which per- forms road maintenance to the most southwesterly part of Weld County, and WHEREAS, said land for which the application is being sub- mitted is described as part of the NE4 of Section 16 , Township 3 North, Range 68 West of the 6th P .M. , Weld County, Colorado, containing 1 . 659 acres, more or less, as shown on the map marked Exhibit "A" , and WHEREAS, after review, the Board deems it advisable to approve said application, a copy being attached hereto and in- corporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application to be submitted to the State Board of Land Commissioners for right-of- way on which to place a grader shed, to be known as the Mead Grader Shed, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said application to the State Board of Land Commissioners. COLORADO STATEMENT OF NEED STATE OF COLORADO Weld County has the need to utilize a small parcel of land in the northeast quarter (NE%) of Section 16, Township 3 North, Range 68 West of the 6th P.M. , for the location of a grader-maintenance shed. The shed would be centrally located in the County' s 20th grader district which performs road maintenance to the most southwesterly part of Weld County. The site would be supportive of a grader shed of 24' x 48' proportions as well as a trailer with all the facilities needed for a living situation. At this time, the grader is being kept in a shed on Great Western property in the town of Mead, which has recently been sold. Therefore, the existing site will no longer be available to the County. It has been found that a shed in this general location is most effective in • maintenance operations during both inclement and fair weather. The County feels this would be a prime location for the grader shed. We do not know of any other state, federal , or private subdivisions which would be affected by the new shed location, as well as any licensing or regulatory agencies. If the County was not permitted to use the pro- posed site, it would have to find one elsewhere, possibly without all the central advantages of this site. The parcel of land in question would consist of 1.659 acres, more or less, utilizing a piece of land 511.07' by 150' and 452.43' by 160.98' . Although the amount of land actually occupied by the grader shed and trailer would be small in comparison, the County may have the need to park some other equipment at the site for short periods of time while doing extra work in the area. As far as any operational constraints or engineering factors which might affect the location or design of the project, the County knows of none. Mead grader shed lease with Great Western Railway Co. The original lease on this property was executed in 1937. The lease has no expiration date and has not been renewed regularly on a yearly basis. The file shows that it was renewed on the following dates in the following ways: 1937 - Original Lease 1971 - Renewed by letter 1979 - Renewed by resolution to 2/1/80 (this is the year the rental was increased from $1.00 per year to $313.00 per year) 1980 - Renewed by resolution to 2/1/81 The Clerk to the Board's office discussed the possibility of having the Board renew the lease this year in a different manner for a longer period of time thaione year. The options discussed are: 1) Renew for 5 years 2) Renew for an indefinite period Both of the above options would be contingent upon the yearly rental remaining the same, $313.00 per year, and the County Engineer's yearly appraisal of the continued need for the property. Great Western Railway does not send a lease renewal to the County each year, only a bill. The only renewal we have received from them since 1937, was a modification to the lease when the rental was changed. Neither of the options would affect the lease as far as Great Western is concerned. It would only establish the Board's intent to continue to lease, thereby keeping our records up to date and giving the County Engineer the authority to pay the rent.
