as Lot B. Recorded Exemption No. 0803-03-2-AMRE-343. being a part of NW1/4 of
Section 3,Township 6 North, Range 65 West of the 6r' P.M.,Weld County. Colorado,to
authorize the firm of Brega 8 Winters P.C. and Thomas E. Hellerich to act on the
owners behalf concerning a Use by Special Review Application.

ANSWERS TO QUESTIONNAIRE FOR USE BY SPECIAL REVIEW
APPLICANTS: Scott L. Vermilyea and Nancy M. Vermilyea, USR
The applicants are the owners of Lot B of Exemption 0803-03-2 AMRE-343 which
contains approximately 147.745 plus or minus, acres, being a part of the NW 1/4 of
Section 3, Township 6 North, Range 65 West, 6th P.M., Weld County, Colorado. The
property is bordered to the north by Weld County Road 74 and a portion of the east
property line by Weld County Road 43.
The applicant is in need of two building sites on Lot B and has submitted a request for
Use by Special Review for an additional single family dwelling unit. The applicants will
reside in one home and the applicant's father will reside in the second single family
home. Other than these two residences, the property will be used for agricultural
purposes and crop production. There is a center pivot on the property for crop
irrigation. The proposed building envelopes lie outside of the pivot area and in a corner
of Lot B. There will be no disruption of productive agricultural ground and the
construction of the two residences will not interfere with the operations of the center
pivot sprinkler system.
The request is consistent with the Weld County Comprehensive Plan as it is not taking
any productive agricultural pivot of use. While an additional residence on the corner
outside of the center pivot area, it will not be detrimental to the continued operations of
the agricultural activities on Lot B. The use will not require any additional water to be
diverted from agricultural use. The use as a residence is consistent with the present
development property and future development of the property and will not interfere with
or be detrimental to the present or future development of the property. It is consistent
with development to the south and will not interfere with agricultural use to the east.
There will be a shared common access for both households, and therefore no additional
agricultural lands will be lost to driveways and one access will be required. The two
building sites are adjacent to each other and will optimize the economics of providing
utilities to both residences.
The surrounding uses are agricultural to the east, a residence to the south, landing strip
for Crop Air, Inc. to the south and an existing residence associated with the property
owner to the south. One additional residence will not interfere with any of the
operations and uses by adjoining landowners, and is consistent with the surrounding
land uses.
There will be one family residing in the additional residence, presently consisting of one
person. There will be no employees and the occupant will assist Scott and Nancy
Vermilyea in the farming operations and caring for the two residences. There will be no
hours of operation as no business will be conducted. These residences are proposed
as the only structures. The proposed building plan for Scott and Nancy Vermilyea's
residence are attached. There will be no unusual or exotic animals and no
concentration of animals on the property. The only vehicles will be common agricultural

vehicles and passenger vehicles and no concentration of any vehicles. Vehicles will
consist of pick-up trucks and automobiles. These vehicles will not have any increased
impact on traffic, and will simply provide transportation for a residence.
Fire protection will be provided by Eaton Fire District. Water is provided by North Weld
County Water District to each of the residences. Sewage shall be by new septic
systems and proper permits will be obtained. No storage or warehousing is proposed
on site.
Landscaping will consist of typical landscaping around a residence including lawn and
some trees. No other landscaping is anticipated other than typical residential
landscaping.
No reclamation plan has been prepared as no reclamation will be required. Likewise,
no storm water drainage plan is necessary as the two residences will have no significant
impact on drainage.
It is contemplated that the residences will be built within 12 to 18 months. Construction
is anticipated to commence this summer.
No stockpiling or storage of waste will occur on site. Trash will be removed in a normal,
typical residential manner. No additional services will be needed for removal of waste.
The applicants are requesting a permit to build an additional residence on Lot B with
both residences in the proposed building envelopes. Building an additional residence
will not be detrimental to the operation of any land uses by adjoining property owners,
and will not interfere with the future development of any present or future development
of any property in the adjoining areas. The application is consistent with all phases of
the comprehensive plan and will allow the owner to make use of non-productive ground.
The applicants respectfully request that the Use by Special Review Application be
approved.
