Home My WebLink About20043111.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING PETITION FOR THE ANNEXATION OF A PORTION OF WELD COUNTY ROAD 33 TO THE CITY OF EVANS AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with a Petition for the Annexation of a Portion of Weld County Road 33, being more particularly described in said petition, to the City of Evans, Colorado, and WHEREAS,a public hearing was held on the 27th day of October,2004,for the purpose of hearing public input on such matter,at which time,the Board deemed it advisable to continue said matter to November 1, 2004, at 9:00 a.m., to allow staff time to ascertain the language to be included in said petition, and WHEREAS,at said hearing on November 1,2004,after review,the Board deems it advisable to approve said petition, a copy of which is attached hereto and incorporated herein by reference, conditional upon the following: 1. An agreement between the City of Evans and County of Weld shall be executed prior to the date of the final hearing on the annexation to address the designation of a haul route for any gravel mining operations which will be operating on properties annexed to the City of Evans,road maintenance for those roadways which are part of the haul route,mitigation of impacts to said roadways,and safety of persons traveling on said haul route. 2. Failure to reach an agreement prior to the date of the final hearing on the annexation shall result in the County of Weld withdrawing said petition. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado,that the Petition for the Annexation of a Portion of Weld County Road 33 to the City of Evans, be, and hereby is, approved, conditional upon the above.
