IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 5,
ARTICLE IV, OF THE WELD COUNTY CODE
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF
WELD, STATE OF COLORADO:
WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority
of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted Weld
County Code Ordinance 2000-1,enacting a comprehensive Code for the County of Weld,including
the codification of all previously adopted ordinances of a general and permanent nature enacted on
or before said date of adoption, and
WHEREAS, the Weld County Code is in need of revision and clarification with regard to
procedures, terms, and requirement therein.
NOW,THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the County
of Weld, State of Colorado,that Chapter 5,Article IV,of the Weld County Code be, and hereby is,
revised to read as follows.
CHAPTER 5, REVENUE AND FINANCE
ARTICLE IV, Purchasing Policy
Sec. 5-4-100. Contracts for personal services or independent contractors.
A. No change.
B. Selection process:
1. The selection of individuals or companies to perform professional services work shall
involve, at the discretion of the Department Head or Elected Official, either the use of the
"qualification based selection process" detailed in Section 5-4-110 of this Code, or the
quotation or proposal process detailed in Subsection(2),below. The selection process will
be in accordance with purchasing procedures and may vary with each specific service.
2. No change.
3. Where it is in the best interest of the County, contracts for professional services can be on
a multiple-year basis with annual renewals at the option of the County. Contracts over fifty
thousand dollars ($50,000.00) will follow the normal purchasing process as specified in
these policies and procedures, which requires presentation to the Board of County
Commissioners for approval and specific Board action on the individual contract.
4. Contracts under fifty thousand dollars ($50,000.00) will follow the normal purchasing
process specified,but may be approved by the Department of Purchasing and the contract
be placed on the Professional Services Agreement form approved by the County Attorney
and Board of County Commissioners. The Professional Services Agreement must be
signed by Chair of the Board.
5. No change.
C. Procedure.
1. The Professional Services Agreement form will be completed by the Department of
Purchasing after the appropriate selection process or proper procedure has been
completed.
2. The Department of Purchasing will send the Professional Services Agreement form to the
Department of Finance and Administration for approval of the Director of Finance and
Administration and Chair of the Board.

Sec. 5-4-110. Qualification based selection process for professional services.
Delete entire section and replace with the following:
A. Procedure.
1. A Request for Proposals ("RFP") shall be advertised by the Department of Purchasing
outlining general project requirements and proposal guidelines.
2. A pre-proposal meeting shall be held with interested firms or companies to discuss the
project details.
3. Proposals shall be submitted to the Department of Purchasing by a designated date. Such
proposals shall include, at a minimum, the following:
a. Proposed cost and work hours.
b. Assigned personnel.
c. Firm or company capabilities.
d. Project understanding.
e. Proposed schedule.
f. References for similar work.
4. Proposals shall be reviewed by a team of individuals selected by the Department Head or
Elected Official and ranked according to the scoring system and criteria set forth in
Subsection B, below.
5. The highest-ranked firms or companies shall be interviewed. The number of firms or
companies interviewed shall be at the discretion of the Department Head or Elected Official.
6. The interview panel (same as the proposal selection team) shall re-rank each firm or
company after the interviews.
7. The project manager shall check the top-ranked firm's or company's references.
8. The results of the selection process,including the name and address of the recommended
firm or company and a Professional Services Agreement, shall be presented to the Board
of County Commissioners for approval and specific Board action (over $50,000), or for
signature by the Chair of the Board of County Commissioners (less than $50,000).
B. Scoring System and Criteria. Professional firms or companies shall be evaluated according to
the following scoring system and criteria. The scoring system and criteria shall be the basis for
review of the written proposals and interviews.
The rating scale shall be from 1 to 5, with 1 being the poorest, 3 being average, and 5 being
outstanding.

FACTOR QUALIFICATION STANDARD
2.00 Scope of proposal. Does the proposal show an understanding of the
project objective,methodology to be used,and results
that are desired for the project?
2.00 Assigned personnel. Do the persons who will be working on the project
have the necessary skills? Are sufficient people of
the requisite skills assigned to the project?
1.00 Availability. Can the work be completed in the necessary time? Can the
target start and completion dates be met? Are other qualified
personnel available to assist in meeting the project schedule
if required? Is the project team available to attend meetings
as required by the Scope of Services?
1.00 Motivation. Is the firm or company interested and are they capable of
doing the work in the required time frame?
2.00 Cost and work hrs. Do the proposed cost and work hours compare
favorably with the Project Manager's estimate? Are
the work hours presented reasonable for the effort
required in each task or phase?
2.00 Capability. Does the firm or company have the support capabilities the
required by the assigned personnel? Has the firm done
previous projects of this type and scope?
BE IT FURTHER ORDAINED by the Board that the Clerk to the Board be, and hereby is,
directed to arrange for Colorado Code Publishing to supplement the Weld County Code with the
amendments contained herein, to coincide with chapters, articles, divisions, sections, and sub-
sections as they currently exist within said Code; and to resolve any inconsistencies regarding
capitalization,grammar,and numbering or placement of chapters,articles,divisions,sections,and
sub-sections in said Code.
BE IT FURTHER ORDAINED by the Board if any section, subsection, paragraph, sentence,
clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such
decision shall not affect the validity of the remaining portions hereof. The Board of County
Commissioners hereby declares that it would have enacted this Ordinance in each and every
section, subsection, paragraph, sentence, clause,and phrase thereof irrespective of the fact that
any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be
declared to be unconstitutional or invalid.
The above and foregoing Ordinance Number2004-2 was,on motion duly made and seconded,
adopted by the following vote on the 26th day of April, A. D., 2004.
