HomeMy WebLinkAbout20040980.tiff RESOLUTION RE: APPROVE REVISION TO OPERATIONS MANUAL, SECTION 6.000, COLORADO WORKS IN WELD COUNTY AND CHILD CARE POLICIES AND PROCEDURES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Revision to Section 6.000, Colorado Works in Weld County and Child Care Policies and Procedures, for the Department of Social Services Operations Manual, and WHEREAS,after review,the Board deems it advisable to approve said revision,a copy of which is attached hereto and incorporated herein by reference. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County,Colorado,ex-officio Board of Social Services,that the Revision to Section 6.000,Colorado Works in Weld County and Child Care Policies and Procedures for the Department of Social Services Operations Manual, be, and hereby is, approved. These exempted people will still qualify under Weld County's work participation rate 6.005.1 Reasons for Temporary Good Cause Exemption from Work Participation Revised 9/99 Revised 9/02 Temporary good cause reasons for exemption from work participation will include but not Revised 3/04 be limited to those listed below: A. A Colorado Works applicant or participant who is caring for child(ren) who is under age six (6) is exempt from work activities if one or more of the following conditions apply: 1. Affordable child care arrangements are unavailable in Weld County when the cost of available child care exceeds the maximum amount Weld County Department of Social Services deems as appropriate and considers a participant could pay. Appropriate child care would not exist if there was no facility or home available when a child's health and safety could not reasonably be assured, or 2. Informal child care does not exist when a TANF recipient cannot make arrangements for child care with a relative or acquaintance and assure that the child's health and safety would not be in jeopardy, or 3. Child care is not available when it is not within a reasonable distance from work or home to allow the recipient to effectively participate in the Colorado Works in Weld County Program. It must also be demonstrated that a reasonable commuting time and/or alternative transportation is also not available. 4. Childcare is not available when it is not within a one half hour drive from the recipient's home. If child care can be provided and alternative transportation arranged by the Department of Social Services, the one half hour drive is not applicable. B. Transportation -An applicant or a recipient residing at a location too remote for effective participation in work activities is exempt from participation. The person must demonstrate that he or she is unable to get to and from the site of a work activity within a reasonable commuting time or does not have alternative transportation. C. Temporary Incapacity-An applicant or a recipient who has an illness or injury (may include domestic violence)which prevents entry into employment or training for a temporary period not to exceed three months. D. Incapacitated Household Member-An applicant or a recipient needed in the home to care for an incapacitated member of the household. Jobs or Work Sites -If the Department's program does not have available jobs and work sites, the applicant or recipient is exempted from participation. F. Relative Care-A non-parent participant who has children living with him or her for whom out-of-home placement would be necessary if the Department discontinued the assistance. G. Due to personal circumstances, such as the lack of skills, or abilities, or economic conditions, which limits the individual from attaining employment that results in self-sufficiency. Self-sufficiency is defined for these purposes as income that makes them ineligible for ongoing cash assistance. H. A person will be temporarily exempt from work activities if they are responsible for caring for a child less than three months of age. 6.005.2 Redetermination of Temporary Good Cause Exemptions The Department will redetermine the recipient's exempt status not to exceed three months, and possibly sooner, depending on the individual or family situation. 6.005.3 Participant Appeal of Non-Exempt Status Under Temporary Good Cause Exemptions The Department will send a notice of adverse action to all applicants and recipients, who in the opinion of the Department, do not meet the exempt status of temporary good cause. The Department's process is outlined in Section 6.011.12 of the Department's Operations Manual. The participant may appeal his or her nonexempt status under Temporary Good Cause Exemption(Sections 6.0051 and 6.0053)by following the procedures outlined in Section 6.011.12 of the Department's Operations Manual. Colorado Works in Weld County and Child Care Policies and Procedures 6.008.5 Colorado Benefit Management System (CBMS) Contingency Plan Added 3/04 The Weld County Department of Social Services may use TANF County Diversion funds or TANF Segregated Funds in emergency situations. TANF Segregated Funds would be available to those clients who are eligible for adult categorical programs. Emergency situations for this purpose are defined and limited to times when State or County Computer systems(CBMS)become disabled and the benefit calculation and distribution of benefits is delayed for one week or longer. In order to be eligible for these emergency funds individuals or families must: A. Have gross incomes below 185% of poverty and, B. Have been determined eligible for categorical public assistance programs (Food Stamps, Medicaid,Adult Categorical Programs, LEAP). In order to receive these emergency funds families and/or individuals must be in a crisis situation that required immediate action. The family must be without food, shelter, clothing, or other basic necessities that would normally be provided by categorical assistance programs. These funds would not be in addition to categorical program assistance. Benefit amount would not exceed the amount of public assistance benefit that the individuals would have been eligible for had there not been computer/system failure. Colorado Works in Weld County and Child Care Policies and Procedures 6.026 Individual Development Accounts Effective 9/10/97 Individual Development Accounts will be allowed for participants who wish to establish Revised 3/04 savings for one or more of the allowable goals/objectives: post-secondary education; purchase of a home; and business capitalization. According to C.R.S 26-2-716 and Section 3.617.5 of the Colorado Depai tinent of Human Services Staff Manual 3. The Depaibnent will not contribute financially to these Accounts. Griego, Director, Social Services di rOC`„ C� ti„, ,,O RE: Revisions to Section 6.000, Colorado Worin Weld County and Child Care Policies and Procedures, Weld County Department of Social Services Operations Manual Enclosed for Board approval are revisions to Section 6.000, Colorado Works in Weld County and Child Care Policies and Procedures, Weld County Department of Social Services Operations Manual. These revisions were reviewed and discussed at the Board's Work Session held on February 18, 2004. The revisions are described below: A. A definition of the non-availability of child care for Colorado Works clients has been revised in Section 6.005.1,A, 4, to include clients who do not have child care available within a one half hour drive from the recipient's home. B. A clarification is being provided for a temporary exemption from work activities through Section 6.005.1,II. A temporary exemption will include an individual caring for a child who is less than three months of age. C. A new provision is being provided in Section 6.008.5,to create a contingency plan for emergency and supportive service needs for families if and when the implementation of the Colorado Benefit Management System(CBMS) may be delayed. The new provision provides the Depai tinent flexibility to use TANF County Diversion or TANF Segregated funding to provide resources for eligible families who have gross incomes below 185% of poverty, have been determined eligible for categorical assistance programs, and must be in a crisis situation. The maximum funds available for emergency needs would not exceed the amount of public assistance benefit that the individual would have been eligible or in addition to the categorical public assistance already provided. D. Section 6.026, Individual Development Acts, have been slightly revised to include statute and rule citations and to state that the specifics of the availability program in Weld County would be developed on or about June 30, 2004.
