Gentlemen:
In regard to 1829-1831 Cherry Avenue, legally described as Lot 3, Block 1,
Seehusen Snhaivision, this was sold to Maren J. Welsh September 19, 1979.
At that time, this property was represented to Jan DePetro, salesperson at
the Gilbaugh Agency, and Maren J. Welsh, the purchaser, as being all that
property lying inside the white board fence. Sometime later, approximately
in October, 1979, a nieghbor infotued Mrs. Welsh that 34.1 feet on the back
end of her property did not belong to her. At that point, Gerald B. McRae
did a survey for Mrs. Welsh and we found, in fact, that Mrs. Welsh did not
own the 31.4 feet that she had originally bought.
We, the Gilbaugh Agency, secured a sales contract for Mrs. Welsh on the
property at 1829-1831 Cherry Avenue. The contract called for all that area
inside the white board fence which is presently being used as corrals. Mrs.
Welsh entered into a contract with the fee owner, R.E. Caner. to purchase
the 31.4 feet so that the property could be kept as one parcel as it present-
ly exists. We are, therefore, requesting a subdivision exemption to legally
attach the approximate 34.1 feet to Lot 3, Block 1, Seehusen Snhlivision.
It is our opinion that the granting of this request eliminates a future
request for a building site and or building permit. It will leave the prop-
erty as it is presently improved.
We sincerely hope that you will give this favorable consideration at your
earliest convenience. The closing date on this property was July 15, 1983.
