Comments These comments follow a previous Memorandum from Public Works dated 27-August-2004. ❑ A signing plan per the current edition of the MUTCD is required as part of the final roadway plans. The signing plan may include street names, stop,yield,no outlet or other associated subdivision signing. ❑ The applicant must provide separation (visual) control between Pelican Shores Drive and County Road 26. The two roads are adjacent, so some type of longitudinal traffic barrier (physical) must be employed for the safety of the public. Night driving would be a major concern; especially with vehicle headlamps and the possibility of disorientation. a The applicant shall submit to Public Works stamped, signed and dated final roadway, drainage, utility / construction plan drawings(full set). Certified drawings will remain in the department's file for use during construction. ❑ The applicant must submit three (3) additional full sets of final roadway, drainage, utility/ construction plan drawings (stamped, signed, and dated) to Public Works for Weld County Field Inspectors' use during construction of the subdivision. ❑ The applicant shall submit a final geotechnical report for this development site that includes groundwater levels and disturbed soil conditions/properties. The Public Works Department has not received this report as to date. ❑ The portion of CR 26 south of the centerline shall be paved to a full 12-foot section with fillets at the edge of pavement to eliminate drop-offs and so noted on the roadway construction drawings. ❑ An off-site improvements agreement is required for CR 26 from the applicant. ❑ The applicant or their agents may be required to obtain permits from Weld County's Public Works Right-Of-Way Agent for each utility. A separate building permit shall be obtained prior to the construction of any building. 2. A plan review is required for each building. Plans may require the wet stamp of a Colorado registered engineer or architect. Two complete sets of plans are required when applying for each permit. 3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit application. Current adopted codes include the 2003 Intemational Residential Code; 2003 Intemational Building Code;2003 International Mechanical Code;2003 International Plumbing Code;2003 International Fuel Gas Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code. 4. Each building will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. When measuring buildings to determine offset and setback requirements, buildings are measured to the farthest projection from the building. Property lines shall be clearly identified and all property pins shall be staked prior to the first site inspection. 7. A Flood Hazard Development Plan shall be submitted for buildings constructed within the 100-year flood plain. One observation is that the recorded Change of Zone map (page 3 of 3) shows the locations of the 3 existing boat ramps and the Final Plat map does not. I also discussed with the applicant back in February 2004 (see attached email) some options for the permanent restroom and handwashing in the gathering areas. I did not see that the maintenance of the restrooms was addressed in the HOA covenants. Although not a requirement, this might still need to be addressed for clarity later. The Departments' recommendations for approval (from the change of zone)are included as follows and have been included as plat notes on the Final Plat: 1. Water service shall be obtained from Central Weld County Water District and Little Thompson Water District. 2. Sewer service shall be obtained from the St. Vrain Sanitation District. 3. Passive and active recreational uses shall be defined. 4. Common-use boat ramp(s), swim beaches, picnic areas, etc. shall be depicted on the Change of Zone plat. 5. Permanent restroom and handwashing facilities shall be provided within easy access of the public gathering areas. 6. The recreational uses on the lakes will require compliance with the water quality standards of the Colorado Department of Public Health and Environment Swimming Pool and Mineral Bath Regulations. 7. If required,the applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment. Silt fences shall be maintained on the down gradient portion of the site during all parts of the construction phase of the project. 8. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 9. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods that are technologically feasible and economically reasonable in order to minimize dust emissions. 1 10. If land development creates more than a 25-acre contiguous disturbance, or exceeds 6 months in duration,the responsible party shall prepare a fugitive dust control plan,submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. 11. "Weld County's Right to Farm"as provided in Appendix 22-E of the Weld County Code shall be placed on any recorded plat. I envisioned a cistern with non-potable water (posted) for handwashing and a permanent, vaulted restroom similar to what you see at a national park or public lake. One of these would need to be placed on each of the three boat ramps as they have swim beaches and picnic areas. Maintenance could be designated through the responsibilities of the HOA. Per Doug' s direction in our conversation today, the letter dated June 5, 2003 is no longer accurate and we should instead reference the February 13, 2004 letter (I will get a copy to you) . Doug will be calling you, probably Monday, to discuss a 'trigger point' for when these would need to be built. I referred him to you for your expertise on this. Except for this point, all conditions have been met with the resolution. Plans are approved in accordance with the following comments and stipulations: • Access appears to be satisfactory as indicated on the plans. Fire apparatus access roads must be designed and maintained to support the imposed loads of fire apparatus (75,000 pounds) and must have a surface that provides all-weather driving capabilities. All access roads will need to be constructed and approved before building permits are issued. • Fire hydrant locations as shown on the plans submitted are acceptable. A minimum fire flow of 1,000 gallons per minute, measured at a residual pressure of 20 pounds per square inch, is required for one- and two-family dwellings not exceeding 3,600 gross square feet. All other buildings (including larger one- and two-family dwellings) require a minimum fire flow of 1,750 gallons per minute and may require more depending on the building size and type of construction as per Appendix III-A of the Uniform Fire Code. Street construction plans for the utilities showing the location of fire hydrants, the size of water mains and available fire flows must be submitted to the Fire District for review and approval prior to beginning construction. Please note, private cisterns are not approved as an alternative to fire hydrant installation. The last sentence of item 3 as well as all of item 4 on sheets UTPI & UTP2 should be stricken prior to the final recording of the plat. • Street intersections must be marked with signs showing the street name at the time building construction begins. If standard street signs are used, then the signs do not need to be submitted to the Fire District for approval. If non-standard street signs are used, the Fire District respectfully requests to comment with regard to sign visibility. • All single-family residences shall have a legible address that is clearly visible from the street fronting the property. The District has reviewed the development proposal in terms of (1) available school capacity, (2) required land dedications and/or cash-in-lieu fees, and (3) transportation considerations and has the following RECOMMENDATION: the District does NOT OPPOSE the approval of this development proposal at this time. (1) SCHOOL CAPACITY The Board of Education has established a District-wide policy of opposing new developments that add to the student enrollment of overcrowded schools prior to the District's ability to provide needed facilities. Overcrowded schools are those that are projected to be at or above 125%of their capacity within 5 years. The Board has determined that school facilities operating beyond the 125%threshold impose costs on the District that begin to affect its ability to adequately provide educational services to the public. Because of the burden created on the District once a school exceeds 125% of capacity, the District cannot support a plat until there is a known date for capacity relief, unless the applicant chooses to participate in the District's mitigation policy. Typically capacity relief can be established once the Board of Education sets a construction schedule for a new facility, sometime after a successful bond election. Once the date of capacity relief is known, the Planning Department can work with the developer on an appropriate phasing plan that coincides the completion of new residential units with the addition of school capacity for the feeder. Current capacity for this feeder along with the impact from this development is noted in the chart below. The "Stdt. Impact" column in the above chart breaks down the development proposal's student impact by grade level. • Of the schools in this feeder, Skyline High School and Mead Middle School are expected to exceed 125% of capacity in 5 years with the addition of students from this development. However, the applicant has agreed to participate in the School District's mitigation policy by voluntarily contributing funds to offset this development's impact on the School District(see enclosed). Because of this participation,the District does not oppose this application at this time. (2) LAND DEDICATIONS AND CASH IN-LIEU FEES The land dedication/cash in-lieu policy of the District requires the dedication of land with the adjacent infrastructure and/or payment of an equivalent cash-in-lieu (CIL)fee based on the student yield of the development. CIL fees only provide funds for land acquisition, which is only a small component of providing additional school capacity for a feeder. Pedestrian access, in particular, is an important goal of the School District in order to facilitate community connection to facilities and to minimize transportation costs. • Because of its rural location, it is unlikely this site will have pedestrian access to any existing or planned schools. • Bussing for this project, under the current boundaries,would most likely be provided. • The District's Transportation Department has accepted the applicant's bus pull-out design (see enclosed). GENERAL COMMENTS The recommendation of the District noted above applies to the attendance boundaries current as of the date of this letter. As new school facilities are constructed under the approved 2002 bond this project's attendance area and capacity could be affected in the future. Dear Ms Lockman, Pending approval of the above application by the County of Weld,this will confirm that the St. Vrain Valley School District has reached an agreement with The River Runs Through It, LLC, evidenced by the signatures below, in regard to the donation of mitigation funds to address the lack of school capacity for the Pelican Shores subdivision. The River Runs Through It, LLC has voluntarily offered to mitigate the impacts on the capacity of the Skyline High School Feeder schools with a$1,466 per unit payment on all 26 units. This mitigation essentially solves the issue of exceeding the school benchmark by providing the funding necessary to add classroom space or help construct new schools to accommodate the expected student yield from this project. In reliance upon the expected receipt of these funds prior to or at the time of the recording of each final plat for units within the subdivision, the School District will not recommend denial of the project at this time. In addition to the payments noted above,The St.Vrain Valley School District also requires that a cash-in-lieu of land dedication fee of$645 per unit be paid prior to the recording of each fmal plat. As indicated above, the mitigation payments shall be provided for all units in each final plat or filing of the Pelican Shores subdivision prior to the release by the County of any individual final plat for recording. Any future changes or variations requested by the developer on the standard mitigation calculation and payment schedule would need to be considered by the School District Staff and/or the Board of Education. This could include evaluating the possibility,but with no obligation, of the District deferring future payments by the developer if the necessary additional school capacity is completed prior to construction of the first unit in this project. The applicant has obtained a Preliminary Subsurface Investigation report by Western Soils,Inc., dated October 18, 2002. Western Soils'report adequately characterizes the site's geology, and contains appropriate preliminary recommendations regarding subsurface drainage and feasibility of basements,grading and surface drainage, foundation and floor system design, and additional, -sife specific uivestigations to provide design parameters for final design purposes. The proposed water sources are the Little Thompson District for the Northern area and the Central Weld Water District for the Southern area. A letter of commitment for service was provided for both Districts in the previous referral of July 24, 2002. ^ The Little Thompson District (District) will supply treated water to the development, charging fees for the water supply on a per tap basis payable prior to activation of the tap. Based on current records on file in this office, the District currently has an adequate uncommitted water supply to provide the water associated with this project. Alternatively, the District will require the developer/lot owner to purchase and transfer to the District a share of the Colorado Big Thompson (CBT) prior to tap activation. A Water Supply Information Summary Form was submitted on July 24, 2002 for the development, however, it did not clarify how much water will be supplied by each District. In order to determine if Central Weld Water District has adequate water to service their portion of the subdivision, a Water Supply Information Summary Form is required, which states the amount of water that the Central Weld Water District will need to provide. This information is also required so that our office can track the amount of water that Central Weld Water District has committed to providing. The lakes, which are a part of the proposed subdivision, appear to have been created during the mining process of the Bailey Pit, Division of Minerals and Geology number M1984099. Depletions to the South Platte River, which result from the lake evaporation, are currently covered under an augmentation agreement with Central Colorado Water Conservancy District and Groundwater Management Subdistrict of the Central Colorado Water Conservancy District. Prior to final approval of the subdivision, the party responsible for assuring that evaporation depletions from the site will be replaced in the long term must be clarified by the applicant.
