The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Section 23, Article II, Division 4. Our
comments and requirements are as follows:
COMMENTS:
WCR 25 is designated on the Road Capital Improvement Plan in the County Wide Impact Fee Code
Ordinance, Section 20-1-30, as a local paved road, which requires a 60-foot right-of-way at full build out.
There is presently a 60-foot right-of-way. The road is maintained by Weld County. Pursuant to the definition of
SETBACK in the weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback measured
from the future right-of-way line.

There is presently a 60-foot right-of-way. The road is maintained by Weld County. Pursuant to the definition of
SETBACK in the weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback measured
from the future right-of-way line.
WCR 25 has an average daily traffic (ADT) count of 256 vehicles taken on 7/31/2002 in a 48-hour period.
WCR 18 has an average ADT count of 355 vehicles taken 12/10/1996. There are four existing gravel pits in
the vicinity of WCRs 18 and 25. Two of the gravel pits are operated by the County, the Koenig facility and
Bearson facility. These facilities are not full-time operations. Northern Colorado Constructors (USR-1394)
has a facility located at intersection of WCRs 18 and 25, and the L.G. Everist pit is (USR-1255) located directly
south of the intersection of WCRs 18 and 25.
REQUIREMENTS:
Traffic Study: The applicant has provided a traffic study from LSC Transportation Consultants, Inc. The
traffic study indicates that the proposed project will generate approximately 150 external daily vehicle trips with
75 entering and 75 leaving the site.
US Highway 85 Access Corridor Plan: CDOT has jurisdiction over all access to the US Highway 85;
therefore, CDOT shall review the traffic impact study to determine an additional needs that may be required.
Intersection improvements to accommodate truck turning movements may be required at the intersection of
--WCRs 18 and 25 as well as WCR 18 and US Highway 85. Additional right-of-way may be required.

The traffic study should determine any improvements needed to accommodate the traffic level of service and
recommended improvements.
'' 'Existing Road Pavement Status: The Weld County Public Works Department will investigate the existing
road pavement status of WCR 18 and WCR 25 for additional overlay requirements to accommodate the
proposed heavy hauling on a daily basis for this route.
Road Maintenance and Improvements Agreement: The applicant shall enter into a Road Maintenance and
Improvements Agreement with the Weld County Public Works Department for the designated haul route and all
intersection improvements associated with this USR.
On-Site Improvements: The approach road from the office/scale house to WCR 25 and a small parking area
shall be paved with asphalt or concrete to handle the dust control from the gravel pit.
Off-Site Improvements: The applicant indicated that a portion of the designated haul route will be upgraded
and paved from the pit entrance south to the existing asphalt section. ,The applicant will be responsible for the
pavement design. The Weld County Public Works will review and approved this section.
Storm Water Drainage: This site is being proposed for a water storage reservoir. The applicant indicated
that a slurry wall will be installed. The area will be de-watered and the water will be returned to the South
Platte River.
The historical flow patterns and run-off amounts will be maintained on site in such a manner that will
reasonably preserve natural character of the area and prevent property damage of the type generally attributed
to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off.

Environmental Health Services has reviewed this proposal for a Mineral Resource
Development Facility. The applicant states that the site will be mined in 2 phases with
a maximum of 25 employees (1 shift) and that hours of operation will be Monday
though Saturday, 5:30 AM to 8:30 PM.
There is an existing residence on the property that will continue to be occupied as a
residence for the next 2 to 3 years, at which time will be converted to an office for the
site. The Department was unable to locate a septic permit for the existing residence.
Any existing septic system located within the USR boundary that is not currently
permitted through the Weld County Department of Public Health and Environment will
require and I.S.D.S. Evaluation prior to issuance of the required septic permit. A
temporary construction trailer with portable toilets is proposed for the site's office until
the house is vacated. Since the residence will eventually be used as an office the
septic system must be evaluated by a registered professional engineer for adequacy for
the current residential use and the future commercial use (25 employees). In the
event the system is found to be inadequate, the system must be brought into
compliance with I.S.D.S. regulations. Because the propose uses of the reclaimed land
are a lined water storage reservoir and a wildlife habitat pond, the Department is in
agreement with the applicant's proposal to use portable toilets at the temporary office
until the permanent office can be occupied.
The application also states that there are two wells (one domestic and one irrigation
well) on the property that will be utilized as the facility's source of water. The domestic
well (currently for the residence) must be permitted for commercial uses at the time the
residence is used for the on-site office.
Therefore, the Department recommends that the following requirements be met prior to
allowing the plat to be recorded:

1. Submit an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit
application to the Air Pollution Control Division, Colorado Department of Health

and Environment for emissions of criteria, hazardous or odorous air pollutants.
2. Submit a dust abatement plan to the Environmental Health Services, Weld
County Department of Public Health & Environment, for approval prior to
operation.
3. The applicant shall provide evidence from the Colorado Division of Water
Resources that the well(s) have been permitted for the appropriate use(s).
4. If applicable, a CPDS Permit shall be obtained from the Water Quality Control
Division of the Colorado Department of Health for any proposed discharge into
State Waterways.
5. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of
Public Health & Environment. The plan shall include at a minimum, the
following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
6. For any vehicle maintenance facility located on the site that is equipped with a
floor drain, the applicant must apply for an Underground Injection Control (UIC)
Class V Injection Well permit through the Environmental Protection Agency
(EPA), for the floor drain system, or provide evidence that the applicant is not
subject to the EPA Class V requirements.
We recommend that the following requirements be incorporated into the permit as
conditions that that must be met prior to operation:
_ 1. There is no documentation that existing septic system located within the USR
boundary is currently permitted through the Weld County Department of Public
Health and Environment. This system will require and I.S.D.S. Evaluation prior
to issuance of the required septic permit. Since the residence will eventually be
used as an office, the septic system must be evaluated by a registered
professional engineer for adequacy for the current residential use and the future

commercial use (25 employees). In the event the system is found to be
inadequate, the system must be brought into compliance with I.S.D.S.
regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
,1. Fugitive dust shall be controlled on this site. The facility shall be operated in
accordance with the approved dust abatement plan at all times.
2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
3. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
— solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended.
4. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, blowing debris, and other potential nuisance conditions.
The applicant shall comply with all provisions of the Underground and Above
Ground Storage Tank Regulations (7CCR 1101-14).
6. This facility shall adhere to the maximum permissible noise levels allowed in
the Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
7. The applicant shall remove, handle, and stockpile overburden, soil, sand and
gravel from the facility area in a manner that will prevent nuisance conditions.
X All potentially hazardous chemicals must be stored and handled in a safe
manner in accordance with product labeling and in a manner that minimized
the release hazardous air pollutants (HAP'S) and volatile organic compounds
(VOC'S).
9. The applicant shall operate in accordance with the approved "waste handling
plan".
>10. If applicable, the applicant shall obtain a stormwater discharge permit from the

• 11' In the event washing of vehicle will occur on site, the applicant shall ensure
that any vehicle washing area(s) shall capture all effluent and prevent
discharges from the washing of vehicles in accordance with the Weld county
Code, the Rules and Regulations of the Water Quality Control Comm:ssiion,
and the Environmental Protection Agency.
Z Any septic system located on the property must comply with all provisions of
the Weld County Code, pertaining to Individual Sewage Disposal Systems.
�'. Adequate toilet and handwashing facilities shall be provided for emplcyees
and patrons of the facility.
14. Portable toilets may be utilized on sites which are temporary locations of the
working face and portable processing equipment, etc., for up to six metrths at
each location.

Site Specific Development Plan and Special Use Permit for a Mineral Resource Development
Facility, including wet & dry open pit mining and materials processing and an asphalt and
concrete batch plant in the A (Agricultural) Zone District.
USR-1444
There are no active or historical permits on record for this parcel.
1. A building permit shall be obtained prior to the construction of the concrete or asphalt batch
plants, scale, shop building, office trailer and any other structure placed on the parcel including
any sign. Demolition permits are required for the demolition or removal of any structure on the
property. A plot plan shall be submitted when applying for building permits showing all
structures with accurate distances between structures, and from structures to all property lines.
2. A plan review is required for each building for which a building permit is required. Plans
shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of
plans are required when applying for each permit.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 1997 Uniform
Building Code; 1998 International Mechanical Code; 1997 International Plumbing Code; 2002
National Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical
report or an open hole inspection performed by a Colorado registered engineer. Engineered
foundations shall be designed by a Colorado registered engineer.
5. Building wall and opening protection and limitations shall be in accordance with UBC Table
5-A. Separation of buildings of mixed occupancy classifications shall be in accordance with
UBC Table 3-B and Chapter 3. Setback and offset distances shall be determined by the Zoning
Ordinance.

6. Building height shall be measured in accordance with the 1997 Uniform Building Code for the
purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 27 of the
Weld County Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback requirements.
Offset and setback requirements are measured to the farthest projection from the building.
7. A Flood Hazard Development Permit shall be submitted for buildings constructed within the
100-year flood plain whether the buildings are existing or new.

The sheriff's office recommends the following improvements for this gravel pit
operation:
1. The sheriff's office requests that gravel trucks transporting materials out of the
area on county roads assure that their loads are covered, thus reducing loose
materials on the roadway and the amount of damage to vehicles.
2. The Sheriffs Office also requests that gravel trucks and other vehicles leaving
the site do not bring foreign materials on to the roadways on their tires. This
may be accomplished by paving a short distance prior to entering the public
roadway.
3. The sheriffs office would however be willing to provide a program entitled
Crime Prevention Through Environmental Design to the developer. This
program reduces the likelihood of criminal activity at a specific location by
"hardening" it to crime.
The Sheriffs Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.

The Department of Planning Services reviewed the above referenced Use by Special Review
Landscape Plat and offers the following comments:
Per the application materials, the applicant is proposing Site Specific Development Plan and Special
Use Permit for Mineral Resource Development Facility including wet&dry open pit mining and materials
processing and an asphalt and concrete batch plant in the A(Agricultural)Zone District..
Staff reviewed the Reclamation Landscape Plan for this application. Staff did not review the
mining and excavation plan, as this stage of the application is addressed through the Division of
Minerals and Geology (DMG) Permit. On-site landscape treatment consists of existing and
proposed deciduous and evergreen trees with a dryland seed mix covering the groundplane.
The plan is general and non-specific with no common, botanical or cultivar species noted. This
plant material is located thoughout the application boundary, typically at the edge of the
proposed lined water storage reservoir and wildlfe habitat areas.
The shape of the reservoir could be described as square at best. For the development of a
wildlife habitat area, the reservoir shall have an undulating shoreline with terraced shelves to
accommodate a wide variety of wildlife species. Further, the applicant shall contact the
Colorado Division of Wildlife for direction on how to provide adequate cover and a positive
environment to accommodate the newly created habitat area(s). Written evidence of the
Colorado Division of Wildlife requirements and methods of implementing said requirements
shall be submitted to the DMG and this office. These comments shall be reflected in the
revised Reclamation and Landscape Plan.
Per the application materials, the ground plane will be planted in native and/or drought tolerant
grasses. Future correspondence shall identify the species of grass seed mix and whether the
mix is to be drilled or broadcast for installation. Future correspondence shall identify the
erosion control devices including but not limited to rip-rap and seeding that will be placed within
and adjacent to this area. If plant material is proposed, please identify the species and how this
plant material will be installed.
Staff has concerns with the selection of the native grasses and the potential for noxious weeds
to gain a foothold and establish themselves within the open space areas. The application
materials state that this proposal greatly increases the amount of wildlife on site. The attached
correspondence from the Division of Wildlife does not indicate this to be the case. Future
correspondence shall identify the proposed management plan for the open space, particularly
given the close proximity of the agricultural production lands.
The applicant shall submit an Improvements Agreement for Private Road Maintenance for
review and approval by this office if so determined that one is needed.

RE: USR-1444, Heit Sand and Gravel Mine

In consultation with the Platte Valley Conservation District, we have reviewed the referenced
application and want to provide the following comments on the proposed sand and gravel mine
in Weld County.
Temporary Topsoil Berm: The berm is shown having 2:1 slopes, such a steep slope can make
the planting and establishment of temporary cover vegetation difficult. The application describes
maintenance consisting of mowing the berm for at least 2 years following seeding to assist in
establishing regenerating stands of grasses and to control weed infestation. With a 2:1 slope,
mowing of the berm will be difficult, if not impossible. It is recommended that the berm have a
4:1 slope to allow the planting, establishment and maintenance of cover vegetation.
The topsoil stockpiles should be re-seeded with temporary cover immediately following
completion of the berms, or as appropriate depending on weather and season. Our
recommendation for seeding the topsoil stock piles as soon as possible is based on soil erosion,
both from a wind and water standpoint, as well as from a weed standpoint. Weeds are very
invasive and move into or onto disturbed areas very fast. Some of these can be "noxious weeds"
and would require control based on the state noxious weed list. By seeding the temporary cover,
the chances for weed invasion will be lessened, as will the potential for erosion.
Site Reclamation: During site reclamation, topsoil should be spread in lifts not to exceed 4
inches and worked into the slopes to ensure good adhesion and to minimize soil creep. Soil
testing should be performed to determine if fertilizer is needed prior to applying the reclamation
seed mix.
The following seed mix and application rates are recommended for site reclamation and are
based on NRCS "critical area" seeding rates, which are double our normal rates.

Our normal recommended seeding dates are November 1s`through April 15`h. All seeding
should take place on unfrozen soils. A good quality seed drill with an agitator and press wheels
is recommended. If seed is broadcast, the above recommended rates would be doubled.
We recommend mulching with clean weed free straw or native hay. Mulch should be applied at
a rate of 4,000 pounds per acre. After the mulch is applied, it should be `crimped' into the soil to
help anchor it. Crimping should be cross slope or on the contour, if at all possible. The State of
Colorado has a list of`certified weed free' straw available on the internet or through the local
county Extension Service office.
Wetlands: According to the National Wetlands Inventory, mine area 2 may contain wetland

Dust Control: Given the proximity of the sand and gravel mine to the residential area, good
dust control during operation is important to minimize a nuisance situation. Applying water to
the work area also can help to control soil erosion during windy conditions.

If any work associated with this project requires the placement of dredged or fill material, and
any excavation associated with a dredged or fill project, either temporary or permanent, in waters of the
United States at this site,this office should be notified by a proponent of the project for proper
Department of the Army permits or changes in permit requirements pursuant to Section 404 of the Clean
Water Act. Waters of the U.S. includes ephemeral, intermittent and perennial streams, their surface

Chris,
CDOT's Issue with this project would be the intersection of WCR 18 and US 85. The traffic engineer
who did the study states that this development is not responsible for making improvements since their
impact is insignificant. Though I would agree that the volumes at this intersection already warrant a
longer left turn lane, volumes projected by this proposal alone would trigger improvements to the
northbound to westbound left turn lane.
I would encourage the County require the applicant provide the left turn lane as a condition of their
permit.

Pursuant to the State Engineer's August 7, 1995 memorandum to county planning
directors, this office is no longer providing comments on land use actions that do not involve a
subdivision as defined in Section 30-28-101(10)(a), C.R.S. This referral does not appear to
qualify as a"subdivision". However the following comments are provided for your information.
We have reviewed the above referenced proposal to create a gravel mining operation
and Concrete and Asphalt Batch Plant on a 102-acre parcel.
Based on the submitted information it appears that the Gravel Mining operation will cause
depletions to the South Platte River due to evaporative losses from exposed ground water and
operational losses. A Temporary Substitute Water Supply Plan or court approved
augmentation plan must be obtained to replace the depletions caused by the operation.
The plan states that two wells located on the property will be used within the gravel
mining operation. If the wells do not qualify under 37-92-602(c) C.R.S. as commercial exempt, all
depletions from the wells must be covered by a Temporary Substitute Water Supply Plan or court
approved augmentation plan. The wells must be repermitted pursuant to the Temporary
Substitute Water Supply Plan, court approved augmentation plan or as a commercial
exempt well.
Gravel pit operators typically must first obtain approval from the Colorado Division of
Minerals and Geology(DMG)prior to mining. As part of that process the applicant will need to
address the potential concerns of State Engineer's Office as they relate to water rights.
