RE: APPROVE DANCE HALL LICENSE NUMBER 318 ISSUED TO RJML, LLC, DBA LA
MARAVILLA - JANUARY 1, 2005, THROUGH JANUARY 5, 2005, AT 12:00 MIDNIGHT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, RJML, LLC, dba La Maravilla, 13015 Weld County Road 16, Fort Lupton,
Colorado 80621, presented to the Board of County Commissioners an application for a County
Dance License to hold public dances at the location described as follows:

WHEREAS,said applicant has paid to Weld County the sum of TWENTY-FIVE AND NO/100
DOLLARS ($25.00) for said Weld County Dance Hall License, and
WHEREAS,after review,the Board deems it advisable to grant Dance License#318,for the
term beginning January 1,2005,through January 5,2005,with the option to extend said dance hall
license upon review of testimony from the applicant, Sheriff's Office, Department of Public Health
and Environment, Town of Fort Lupton, and State Patrol.
WHEREAS,Weld County Dance Hall License#318,for the purpose of conducting dances
at said facility, shall be subject to the following condition:
1. The occupancy for the Dance Hall must be held at or below the number set forth by
the Board of County Commissioners in accordance with the procedure set forth in
Paragraph(C)of the Stipulated Conditions for Renewal of License,which has been
incorporated into Resolution #2004-2247 of even date herewith.
WHEREAS,said license is issued upon the express condition and agreement that the public
dances will be conducted in strict conformity to all laws of the State of Colorado, and any violation
thereof shall be cause for revocation of the license.
NOW,THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Weld
County, Colorado, that County Dance Hall License#318 be, and hereby is granted for the term
January 1, 2005,through January 5,2005,with the option to extend said dance hall license based
upon testimony from the applicant, staff and public.

SUBJECT: La Maravilla, Dance Hall License
The Department has reviewed all pertinent health-related operations at the La Maravilla facility
and has no issue with the approval of the facility's Dance Hall License.
Comments concerning the sewage disposal system, drinking water system, and food service
establishment are addressed individually below:
Sewage Disposal:
This facility disposes of its domestic wastes through a septic system. According to records
provided by the owner, Ruben Rodriquez, the amount of wastewater disposed is well within its
design capacity. The system is designed to handle up to 1,727 gallons per day. The average
discharge during the months of October, November, and December was approximately 1,100
gallons per day.
Water Treatment System:
Water is provided to the facility by a well. The water treatment system is classified as a
transient, non-community system by the Colorado Primary Drinking Water Regulations. Based
upon information available to the Department, the system is in substantial compliance with the
Colorado Primary Drinking Water Regulations.
Food Service:
The facility has a Colorado food service license. Based upon recent inspections by Department
staff, the facility is in substantial compliance with the Colorado Retail Food Establishment
Regulations.

Dear Mr. Rodriguez:
Please be advised that on January 5, 2005, at 9:00 a.m., the Board of County Commissioners of
Weld County,Colorado,will consider the application by RJML,Inc.,for the issuance of a Dance Hall
License at the La Maravilla Restaurant, 13015 WCR 16, Fort Lupton, Colorado,for the year 2005.
The Board's consideration will take place in the First Floor Meeting Room,Weld Centennial Center,
915 10th Street, Greeley, Colorado at 9:00 a.m.
The matter came onto the Board's agenda for consideration on December 22, 2004; however, on
that date the Board had no information before it to decide if the criteria set forth in Section
12-5-40.C.of the Weld County Code is satisfied, in particular with regard to the occupancy number
increased in Paragraph (C) of the Stipulated Conditions for Renewal of License incorporated into
the Board's Resolution#2004-2247,dated August2,2004. The Board asked to hear from the Weld
County Sheriff's Office,the Weld County Department of Health and Environment,the Fort Lupton
Police Department and the Colorado State Patrol.
The Board did grant the Dance Hall License for the period between January 1,2005, and January
5, 2005. The Board's decision on January 5, 2005, will concern the issuance of the Dance Hall
License for the period from January 5, 2005, to December 31, 2005.

WELD COUNTY CODE SECTION 12-5-40.
C. To grant the application, the Board of County Commissioners must find that the
premise is a safe and proper place for the intended purpose, and that the public morals, public
safety or public health of the community shall be satisfied by the issuance of the license. Such
determination may include, but not be limited to, consideration of the following factors:
1. That the premises is equipped with sufficient water, lighting, parking and
restroom facilities to accommodate the number of persons expected to
attend dances thereon.
2. That the premises is not in such a state of disrepair that it is more likely
than not to be a safety hazard to persons expected to attend dances
thereon.
3. That if the premises consists of an enclosed structure, the structure is
sufficient in size and fire rating to safely accommodate the number of
persons expected to attend dances therein, and all requirements of the
applicable fire department, district or authority have been met.
4. That the premises is capable of being accessed from a public road, street
or highway safely without causing an increased risk of accidents.
