THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS
REQUEST BE APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 23-
2-260 of the Weld County Code.
2. It is the opinion of the Department of Planning Services' staff that the applicant has shown
compliance with Section 23-2-220 of the Weld County Code as follows:
A. Section 23-2-220.A.1 -- The proposed use is consistent with Chapter 22 and any
other applicable code provisions or ordinance in effect. Section 22-2-60.D (A.Goal
4) states, "Conversion of agricultural land to nonurban residential, commercial and
industrial uses will be accommodated when the subject site is in an area that can
support such development. Such development shall attempt to be compatible with
the region." The proposed location is currently permitted as USR-891 for a
USR-1454 Arrington 3
decorative rock sales and ditch cleaning business in the Agricultural Zone District.
With the property already developed through USR-891 the proposed use will
generate no additional impacts on the agricultural land by not taking any additional
farm ground out of production.
The proposed development would be serviced by Central Weld County Water
District and an I.S.D.S sewage disposal system.
B. Section 23-2-220.A.2 -- The proposed use is consistent with the intent of the A
(Agricultural)Zone District. Section 23-3-40.A.2, Section 23-3-40.U and Section 23-
3-40.R of the Weld County Code provides for a Mineral resource development
facility including an oil and gas support and services; Semi-Trailer and Cargo
Containers Situated as Permanent Storage Units and a use permitted as a use by
right, an accessory use, or a use by special review in the commercial or industrial
zone districts, (an industrial machine shop) as a Use by Special Review in the A
(Agricultural) Zone District.
C. Section 23-2-220.A.3--The uses which will be permitted will be compatible with the
existing surrounding land uses. The surrounding property to the north, east and
west are primarily agricultural. The surrounding property to the south is residential.
The development standards and conditions of approval will ensure compatibility with
adjacent properties.
D. Section 23-2-220.A.4 -- The uses which will be permitted will be compatible with
future development of the surrounding area as permitted by the existing zoning and
with the future development as projected by Chapter 22 of the Weld County Code
and any other applicable code provisions or ordinances in effect, or the adopted
Master Plans of affected municipalities. The subject property lies within the three
mile referral area of the City of Evans, City of Garden City,Town of La Salle and the
City of Greeley. The City of Evans, City of Garden City and the Town of La Salle
reviewed the request and found no conflicts with their interests. The City of Greeley
is requesting a minimum of 50 feet of right-of-way from the centerline of County
Road 50 be reserved.
E. Section 23-2-220.A.5 —The site does not lie within any Overlay Districts. Building
Permits issued on the Lot will be required to adhere to the fee structure of the
County Wide Road Impact Program (Ordinance 2002-11).
F. Section 23-2-220.A.6--The applicant has demonstrated a diligent effort to conserve
prime agricultural land in the locational decision for the proposed use. The
proposed use will occupy 4.82 acres which has already been developed by USR-
891, substantially limiting its agricultural value.
G. Section 23-2-220.A.7 -- The Design Standards (Section 23-2-240, Weld County
Code), Operation Standards (Section 23-2-250, Weld County Code), Conditions
of Approval and Development Standards ensure that there are adequate provisions
for the protection of health, safety, and welfare of the inhabitants of the
neighborhood and County.

❑URGENT x FOR REVIEW ❑PLEASE COMMENT ❑PLEASE REPLY ❑PLEASE RECYCLE
After speaking with a representative of Michael Arlington in regards to the Notice of Inquiry
dated October 23,2003 and submitted to the Town of LaSalle for review,a decision has been
reached"internally". The decision is to not proceed with public meetings for the Notice of
Inquiry,we will await the submittal of the USR for this project. This decision was reached
once the exact location of the site was shown to our office by Arrington'representative.
The notice of inquiry is attached with no comments, and again this item will not be heard
before the Planning Commission and Board in as much as the location is further away of
growth boundaries which could feasibly be annexed into the town
Thank you for notifying LaSalle of the potential of this site and we will await the USR filing.
