RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 363 - RALPH
SOUTHER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held on
the 8th day of January, 1979 in the Chambers of the Board of
County Commissioners of Weld County, Colorado that a certain
parcel of land, being the property of Ralph Souther, does not
come within the purview of the definition of the terms, "subdi-
vision" and "subdivided land" , pursuant to its authority under
Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, said Board of County Commissioners did approve
Recorded Exemption No. 363 , by Resolution, on January 8 , 1979,
and
WHEREAS, Ralph Souther is requesting that the aforementioned
Recorded Exemption No. 363 be amended by reducing the size of
Lot A from 1. 403 acres to 0. 92 acres. Lot B will increase in
size from 0. 459 acres to 0. 9325 acres, and
WHEREAS, the Board of County Commissioners finds that said
request to amend Recorded Exemption No. 363 should be approved
for the following reasons.
1. The impact on surrounding land uses would not
appear to be any different than the original
request which has already been approved.
2. The Fort Lupton Planning Commission has set
forth no objections to this request. The
property is located within the Fort Lupton
Comprehensive Plan area.
3. The request is in compliance with Section
9-4A of the Weld County Subdivision Regula-
tions.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the abovedescribed
amendment to Recorded Exemption No. 363 for Ralph Souther be,
and hereby is , approved for the reasons as set forth above.
The above and foregoing Resolution was, on motion duly made
and seconded , adopted by the following vote on the 16th day of

Re: Amendment to Recorded Exemption #363
Dear Commissioners:
The attached application, plat, and related items are in reference to a
request to amend Recorded Exemption #363 from Mr. Ralph Souther. The
property is described as part of the W1 WW1/4, Section 8, T1N, R66W of the
6th P.M. , Weld County, Colorado. This property is located directly south
of Fort Lupton at 804 and 820, Denver Avenue.
The request reduces the size of Lot A from 1.403 acres to 0.92 acres.
Lot B will increase in size from 0.459 acres to 0.9325 acres. Each
parcel has a single family residence located on it. The property is
currently zoned "Estate".
Based upon the information submitted, the Department of Planning Services
Staff recommends approval of this requested amendment for the following
reasons:
1. The impact on surrounding land uses would not appear to be
any different than the original request which has already
been approved.
2. The Fort Lupton Planning Commission has set forth no objections
to this request. The property is located within the Fort Lupton
Comprehensive Plan area.
3. This request is in compliance with Section 9-4 A. of the Weld
County Subdivision Regulations.
