RE: GRANT MOBILE HOME PERMIT, ZPMH #2415 - PEGGY MARTIN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board of County Commissioners of Weld County,Colorado,on the 8th day
of November, 2004, considered the request of Peggy Martin, 3037 Weld County Road 19, Fort
Lupton, Colorado 80621, for a mobile home to be used as a Temporary Accessory Use During a
Medical Hardship, and
WHEREAS, said mobile home is to be occupied in the A (Agricultural) Zone District on a
parcel of land being more particularly described as follows:
Lot B of Recorded Exemption#3821;being part of the
SE1/4 SE1/4 of Section 16,Township 1 North, Range
67 West of the 6th P.M., Weld County, Colorado
WHEREAS,the Board of County Commissioners, having heard all of the testimony, finds
that said request should be granted subject to the following conditions:
1. An existing septic system is to be used for the proposed second home. The Weld
County Department of Public Health and Environment will require an Individual
Sewage Disposal System(I.S.D.S.)evaluation. In the event the system(s)is found
to be inadequate, the system(s) must be brought into compliance with current
I.S.D.S. Regulations.
2. Prior to the occupancy of the mobile home, the applicant shall finalize the Building
Permit for the mobile home.
3. The mobile home shall not be occupied until such time that the applicant has
complied with Conditions#1 and #2 stated above.
4. All Zoning Permits for mobile homes during a medical hardship are temporary. Such
permits shall be subject to review annually on the anniversary of the original permit's
issuance. Such permits shall be extended only if the use continues to be in
conformance with the criteria set out in Section 23-4-180. Any permit for a medical
hardship use shall automatically expire,and the mobile home shall be removed upon
cessation of the medical hardship, or at any such time the mobile home is used for
purposes other than the permitted use.
5. The applicant shall submit documentation to the Department of Planning Services
by October 1st of each year describing the status of the medical hardship. This
permit is temporary and shall terminate once the medical hardship ceases to exist,
at which time the applicant shall have thirty(30) days to remove the mobile home
from the property.

6. The applicant shall submit a statement of an exit plan acknowledging that the
temporary permit shall cease to exist at any such time as the mobile home is used
for other than the permitted use. Such statement shall include a detailed plan for
removal of the mobile home upon expiration of the permit,or at such time the permit
is not renewed by either the Department of Planning Services or Board of County
Commissioners, the applicant will have 30 days to put the exit plan into place.
7. The applicant must obtain a Building Permit for a mobile home and must comply
with all installation standards of Chapter 29 of the Weld County Code applicable to
mobile homes.
8. All proposed or existing structures will meet the minimum setback and offset
requirements for the Zone District in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured
from the future right-of-way line.
9. Any future structures or uses on the site must obtain the appropriate Zoning and
Building Permits.
10. Weld County Road 8 is designated on the Weld County Road Classification Plan as
a local gravel road, which requires 60 feet of right-of-way at full build out. There is
presently 60 feet of right-of-way. This road is maintained by Weld County.
11. Weld County Road 19 is designated on the Weld County Road Classification Plan
as a collector status road, which requires 80 feet of right-of-way at full build out.
There is presently 60 feet of right-of-way. This road is maintained by Weld County.
12. The applicant shall use the existing access to this parcel, no additional access shall
be granted.
13. Should noxious weeds exist on the property, or become established as a result of
the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds, pursuant to Section 15-1-10 of the Weld County
Code.
14. The applicant shall maintain compliance with Section 23-4-180 of the Weld County
Code at all times.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of Peggy Martin for permission to place a mobile home to be
used as a Temporary Accessory Use During a Medical Hardship on the above described parcel of
land,which was found to be in compliance with Chapter23,Article IV, Division 3,of the Weld County
Code, be, and hereby is, granted subject to the hereinabove listed conditions.

The Department of Planning Services' staff has reviewed this request and recommends that this
request be denied for the following reasons:
1. It is the opinion of the Department of Planning Services' staff that the applicant has not shown
14 compliance with Section 23-4-180 of the Weld County Code, as follows:
a. A medical hardship exists in which the person to be living in the mobile home requires the
supervision and care of those persons residing in the principal dwelling unit on the
property (or the reverse). Documentation of the medical hardship shall be established in
a letter from the subject's medical doctor or other evidence deemed suitable by the
Department of Planning Services. The letter shall be submitted as a part of the zoning
permit application and shall verify that the subject is physically impaired and requires full-
time care.
The Department of Planning Staff reviewed the information provided by the applicant,
and concurred that an additional home is not justified as full time care in not required. In
the letter from Dr. Stefane Davis with the Metro Community Provider Network dated June
28, 2004 states "I think that it is very important that this patient has someone who lives
nearby and checks on her daily" Staff has determined that this does not constitute full-
time care as outlined in Section 23-4-180.A.1 of the Weld County Code.
Should the Board of County Commissioners approve this request, the Department of Planning
Services'staff recommends the following conditions be attached:

application meets the approval criteria of Chapter 23,Article IV,Division 3,of the Weld County Code,you will
be notified that the zoning permit is approved. If the staff determines that the application does not meet the
approval criteria, you will be notified and asked to appear before the Board of County Commissioners at a
public hearing. You will be informed of the hearing date at least a week prior to the hearing. The Board of
County Commissioners will then consider your application and make a final decision on the zoning permit for
the mobile home.
It is the policy of Weld County to refer an application of this nature to any town or municipality lying within three
miles of the property in question or if the property under consideration is located within the comprehensive
planning area of a town or municipality. Therefore,our office has forwarded a copy of the submitted materials
to the Dacono, Frederick and Northglenn Planning Commission for their review and comments. It is
recommended that you and/or a representative be in attendance at the Dacono, Frederick and Northglenn
Planning Commission meeting to answer any questions the Commission members may have with respect to

Tv Whom It May Concern:
This letter is far Mavis Czarny. She is a patient here at the clinic. She has
multiple medical diagnosis. Her current diagnoses are: 1. Hypertension, 2.
Diabetes, 3. Hyperlipidemia, 4. Depression, 5. Transient ischemic attacks, 6.
Spinal cord stimulator for pain 7.Neuropathy, 8. Right knee artbroplasty, 9.
History of MI,and 10. Occasional dizziness. This patient has many health
I problems. She recently had a TIA and was taken to the hospital by her
friend who lives close. Her friend(Ms.Martin)lives near to this patient and
checks on her frequently, because of the patient's medical problems. This
patient is alone and does not have family close to help her. Her friend helps
her and is her contact. I think that it is very important that this patient has
someone who lives nearby and checks on her daily. This patient is at risk of
having a stroke or heart attack, and having some one close to either help or
call 911 if necessary will be a benefit for this patient.

CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested
water right from seeking relief In a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2,Znless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors In accordance with Rule 18.
3) Approved pursuant to CRS 37-92-602(3)(c)for the relocation of an existing well,permit no.93835. The old well must be
plugged In accordance with Rule 16 of the Water Well Construction Rules within ninety(90)days of completion of the new
well. The enclosed Welt Abandonment Report form must be completed and submitted to affirm that the old well was
plugged.
4) The use of ground water from this well is limited to fire protection,ordinary household purposes inside not more than 2
single family dwelling(s),the irrigation of not more than 10,000 square feet of home gardens and lawns,and the watering
of domestic animals.
5) Production from this well is restricted to the Laramie Fox Hills aquifer,which corresponds to the interval between 510 feet
and 710 feet below the ground surface. Plain casing shall be installed and grouted to prevent production from other zones.
6) The maximum pumping rate of this well shall not exceed 15 GPM.
7) This well shall be constructed not more than 200 feet from the location specified on this permit.
8) The depth to the top of the Laramie-Fox Hills aquifer is approximate. To ensure the exclusion of poor quality water from
zones Immediately above the aquifer,plain casing and grout shall extend through the lowermost coal and/or carbonaceous
shale that overlies the Laramie sand portion of the aquifer.
NOTE:The ability of this well to withdraw its authorized amount of water from this non-renewable aquifer may be less than
the 100 years upon which the amount of water In the aquifer Is allocated,due to anticipated water level declines.
NOTE:To ensure a maximum productive life of this well,perforated casing should be set through the entire producing
Interval of the approved zone or aquifer indicated above.
