Dear Ms. Katyryniuk:
On January 28, 2004, Kerr-McGee Rocky Mountain Corporation ("KMRMC") received a
notice for a public hearing on March 2, 2004 covering the Property. KMRMC has learned that
the Weld County Planning Commission will consider an application for a Special Review Permit
to allow a vehicle maintenance facility to be constructed on the surface of the Property. The
purpose of this letter is to inform the Weld County Planning Commission that KMRMC owns
certain oil and gas leasehold interests in and to the Property, including the right to drill oil and
gas wells.
KMRMC prefers to meet with the surface owner as soon as possible in this process to
begin discussions with respect to any proposed development. KMRMC has not discussed the
proposed development with the surface owner nor has a surface use agreement been executed.
Therefore, KMRMC objects to the approval of this application until such time there is a surface
use agreement in place that allows for the compatible development of the surface and mineral
estates.
KMRMC requests that Weld County Planning Commission encourage the applicant to
communicate with KMRMC to resolve any potential conflicts between the proposed surface
development and mineral leasehold estate prior to receiving plat approval. Thank you for your

To Weld County Department of Planning Services,
We are writing this in regards to the above mentioned property. The
Sanders family has a half interest in the mineral rights on this property, and
we have one main area of concern.
We want to make sure that there is a written agreement between the county,
the oil companies and the new owner as to an easement for the right of way
to the existing wells or any future wells on the property. We would also like
to have the signed agreement for this special use permit, which would also
include rights to the easement, to be sent to us for our own files.
We appreciate that times are changing and going away from agriculture, so
we don't object to the change in the property status, but this issue is very
important to us. Thank you for your help on this matter.
