Dear Mr. Thomas:
This law firm represents Anadarko Land Corp., formerly known as Union Pacific Land
Resources Corporation ("Anadarko Land"), and Anadarko E&P Company LP ("Anadarko
E&P"), formerly known as Union Pacific Resources Company, with respect to the application
for a site specific development plan and special review permit that you have filed with Weld
County and your request for a waiver of timely notice of a hearing that is presently scheduled
before the Weld County Planning Commission on May 4, 2004, which notice was to have been
provided to the Anadarko entities as mineral interest owners pursuant to Colorado statutes. I
understand that the application covers approximately twelve acres of land that is located in the
S/2NW/4 of Section 5, Township 7 North,Range 65 West, specifically described on the attached
Exhibit A and hereinafter referred to as the"Property?'
This letter constitutes a waiver by the Anadarko entities to having received timely notice
of the bearing scheduled on May 4, 2004 pursuant to the requirements of Colorado Revised
Statutes §§ 24-65.5-101 et seri, that applicants give advance written notice to mineral estate
owners of hearings for applications for development.
This waiver is limited to applications for development as defined in C.R.S. § 24-65.5-
102(2)to the extent that the applications cover only the Property, or portions of the Property, and
only to the extent that the Anadarko entities own minerals under the Property. It does not in any
respect apply to mineral interests owned or claimed by any other person or entity in any portion
