RE: GRANT RENEWAL OF MOBILE HOME PERMIT, ZPMH #1197 - HERBERT WAGNER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board of County Commissioners of Weld County, Colorado,on the 8th day
of November, 2004, considered the request of Herbert Wagner, 174 Weld County Road 65,
Keenesburg, Colorado 80643, to renew Mobile Home Permit, ZPMH#1197, for a mobile home to
be used as a Temporary Accessory to the Farm, and
WHEREAS, said mobile home is to be occupied in the A (Agricultural) Zone District on a
parcel of land being more particularly described as follows:
Part of Section 33,Township 1 North, Range 63 West
of the 6th P.M., Weld County, Colorado
WHEREAS,the Board of County Commissioners, having heard all of the testimony, finds
that said request should be granted subject to the following conditions:
1. The applicant shall submit a statement of an exit plan acknowledging that the
temporary permit shall cease to exist at any such time as the mobile home is used
for other than the permitted use. Such statement shall include a detailed plan for
removal of the mobile home upon expiration of the permit,or at such time the permit
is not renewed by either the Department of Planning or Board of County
Commissioners, the applicant will have 30 days to put the exit plan into place.
2. The mobile home will be occupied by persons principally employed at,or principally
engaged in,the operation of the use where the mobile home is located. Accessory
farm use of the mobile home shall be established and revalidated on an annual basis
as follows:evidence shall be submitted by the applicant or property owner by the first
of each year for review and acceptance by the Department of Planning Services
verifying that the mobile home occupant is principally employed at,or engaged in,the
farming operation on the subject property. The evidence shall consist of tax records,
employment agreements or other documentation as determined suitable by the
Department of Planning Services. Failure to submit the required documentation may
result in cessation of the allowance of the mobile home for temporary accessory
farm use.
3. The mobile home will not be used as an income source by the applicant for rental
to persons who are not principally employed upon the lot.
4. The applicant shall submit documentation to the Department of Planning Services
by September 1st of each year describing the status of the accessory farm unit.
This permit is temporary and shall terminate once the use ceases to exist, or at
which time is used for purposes other than those permitted, at which time the
applicant shall have thirty(30) days to remove the mobile home from the property.

5. All temporary permits for mobile homes shall not be transferable by the applicant
and/or owner to any successor;the zoning permit shall terminate automatically upon
conveyance or lease of the property. The mobile home shall be removed from the
property, or a new zoning permit shall be applied for and approved.
6. The property is in violation of Chapter 23 of the Weld County Code (VI-0200022).
Within thirty(30)days following the date of this Resolution,the applicant shall submit
to the Department of Planning Services an application fora Non-Conforming Use for
the mobile home placed on the property prior to 1972. The applicant shall schedule
a final inspection with the Weld County Zoning Compliance Officer within six (6)
months following the date of this Resolution and submit a copy of the closure letter
indicating compliance with Chapter 23 of the Weld County Code. The applicant shall
maintain compliance with Section 23-4-170 of the Weld County Code at all
times.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that the request of Herbert Wagner to renew Mobile Home Permit,ZPMH#1197,
for a mobile home to be used as a TemporaryAccessoryto the Farm on the above described parcel
of land, which was found to be in compliance with Chapter 23, Article IV, Division 3, of the Weld
County Code, be, and hereby is, granted subject to the hereinabove listed conditions.
The above and foregoing Resolution was,on motion duly made and seconded,adopted by
the following vote on the 8th day of November, A.D., 2004.

This is case ZPMH-1197, a renewal for a Zoning Permit for a mobile home permitted as a
Temporary Accessory to the Farm. The legal description is part of Section 33, T1 N, R63W of
the 6`h P.M., Weld County, Colorado. The property is located east of and adjacent to CR 65 and
south of adjacent to CR 4.
The property owner is Herbert Wagner.
ZPMH-1197 was approved by the Board of County Commissioners on August 20, 1986 for a
second mobile home for accessory to the farm.
Mr. Wagner's property currently has three homes on it. The principal dwelling unit is a stick
built. The first mobile home was placed on the property prior to 1972. The second mobile home
was originally permitted under ZPMH-1197 as a Temporary Accessory to the Farm. Mr.
Wagner switched out the second mobile home for another and at that time he was asked to re-
justify the Temporary Accessory to the Farm.
The Department of Planning Services staff met on June 25, 2004, to discuss the re-justification
of the mobile home being used as a Temporary Accessory to the Farm. In a letter dated June
25, 2004 staff recommended two options to Mr. Wagner. First, that he could apply for a
Recorded Exemption in conjunction with a Subdivision Exemption. By applying for these
permits, all three homes would be placed on separate lots. Second, staff suggested that Mr.
Wagner could apply for a Non-Conforming Use for the first mobile home that was put on the
property prior to 1972 and that ZPMH-1197 would need to be taken to the Board of County
Commissioners for a final determination. Staff would be requesting denial for the of the second
mobile home as there is not enough justification for an additional home to continue as an
accessory to the farm.
Section 23-4-170.A.2 states the mobile home is necessary for the effective and economic
operation of the use and or protection of the agricultural use. According to Mr. Wagner the
homes are both currently unoccupied and Mr. Wagner has expressed interest in having his
daughter move into one of the mobile homes in the future.
The Department of Planning Staff is recommending that the mobile home under ZPMH-1197 be
removed from the property and an application for a Non-Conforming Use be submitted for
review and approval or Mr. Wagner can apply for a Recorded Exemption and Subdivision
Exemption on his property placing each home on its own individual lot. As outlined for Mr.
Wagner in a letter dated June 25, 2004 by Staff.
Should the Board approve for the use to continue, the Department of Planning Services
recommends the following conditions be amended into the existing permit:
1. The applicant shall submit a statement of an exit plan acknowledging that the temporary
permit shall cease to exist at any such time as the mobile home is used for other than
the permitted use. Such statement shall include detailed plan for removal of the mobile
home upon expiration of the permit, or at such time the permit is not renewed by either
the Department of Planning or Board of County Commissioners, the applicant will have
30 days to put the exit plan into place.
2. The mobile home will be occupied by persons principally employed at or principally
engaged in the operation of the use where the mobile home is located. Accessory farm

Dear Mr. Wagner:
The Department of Planning Staff met on Friday,June 25th, 2004, to discuss your property and your options,
which are as follows:
1. Apply for two land use permits,a recorded exemption and a subdivision exemption. By applying for these
permits, all three homes would be placed on separate lots.
2. The mobile home that has been on site prior to 1972, unless placed on a separate lot, is a non-
conforming use, which means that it can remain on site but would not be able to be replaced should it be
destroyed or extended more than 50% of its replacement cost. The second mobile home permitted under
ZPMH-1197, would need to go before the Board of County Commissioners for a final determination, and
staff would be recommending denial of this permit as it does not meet the intent of Section 23-4-170 of the
Weld County Code.
I understand this may all be confusing. I would recommend coming in and talking to either myself if I am
available, or to a Planner. By appointment, you could see Jacqueline Hatch. I would also recommend
should you wish to pursue the recorded exemption/subdivision exemption, that you hire someone to help
you through this process.

Dear Mr. Wagner:
This letter is in regards to the mobile homes located at the above referenced site. When we met, we
discussed the options of re-justifying the mobile homes, removing them,and a recorded exemption to create
separate parcels. To date you still have one of the mobile homes in violation with the building department
as it was never finaled, and all three need to be justified. To avoid any further violations, please contact our

RESOLUTION
RE: GRANT MOBILE HOME PERMIT NO. 1197 - HERBERT E. WAGNER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, on the 20th day of August, 1986, considered the request
of Herbert E. Wagner for a mobile home to be used as more than one
mobile home as an accessory to a farm, and
WHEREAS, said mobile home is to be occupied in an
A-Agricultural Zone District on a parcel of land being more
particularly described as follows:
Section 33, Township 1 North , Range 63 Vast of
the 6th P.M. , Weld County, Colorado
WHEREAS, the Board of County Commissioners, having heard the
testimony, finds that said request should be granted subject to
the following conditions: 1) Prior to the issuance of a building
permit, the owner shall submit evidence that the well is supplying
water in such a manner as to be adequate in quality, quantity and
dependability for the proposed use; and 2) The mobile home shall
not be occupied until such time that the applicant has complied
with the above mentioned condition.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the request of
Herbert E. Wagner for permission to place a mobile home to be used
as more than one mobile home as an accessory to a farm on the
above described parcel of land, which was fund to be in
compliance with Section 43 of the Weld County L_ning Ordinance,
be, and hereby is, granted subject to the hereinabove listed

I, the undersigned, understand and agree to the conditions of this Zoning
Permit which are as follows:
1. All zoning permits for mobile homes as accessory uses are temporary.
Such permits shall automatically expire and the mobile home shall be
removed upon the cessation of the use of the mobile home as an accessory
use; and
2. A zoning permit for more than one mobile home in the "A" Agricultural
Zone District as an accessory use may be issued only upon approval by the
Board of County Commissioners.
Further, I, the undersigned, meet the following conditions which are required
to be eligible for this permit:
1. The mobile home will be occupied by persons customarily employed at or
engaged in the operation of the use where the mobile home is located;
• 2. The mobile home is necessary for the effective and economic operation of
the use and/or protection of the agricultural use;
