At issue was Staff's determination based on known information. The 3`d AmUSR-655 land use application was approved by the Board of County Commissioners on June 6, 2001, with the plat recorded on January 15, 2002. Development Standards do not address any additional on premises signs or any sign. On January 9, 2003 a Building Permit was submitted (BCS-030010) for a 5'x8'x9' illuminated sign on 4' square tube posts - fabricated sheet metal wl white face & internal fluorescent lamps (277 volts). On January 17, 2003 Planning staff determined that the proposed sign is larger than allowed in Agricultural Zone District. Planning staff to send letter. On September 17, 2004 Planning Staff (Jacqueline) submitted a letter to Jeff Benge of Freeman Signs Inc out of Englewood concerning the size of the sign. The size of the sign is in excess of the Agricultural Zone District (16 SF) On November 15, 2004 the Building Permit Application expired. The application was referred to code compliance for action (Peggy Gregory in Building Code Compliance). Planning Staff was notified to prepare for a Substantial Change Hearing for the amendment to the existing USR. At issue is the lack of a Building Permit for the installed sign. Staff is willing to defer action on this property, if the property owner is able to provide a timeline for the amendment to the existing 3r° AmUSR--655, specific to when the application should be expected into this office. Staff is aware that the applicant seeks to expand and enlarge operations with the addition of at a minimum one structure for the facility. Staff requests the applicant provide an application within the 2004 Calendar year for processing. Freeman Signs Inc was notified by letter dated September 17, 2004 and attached herein, that this sign, which is already installed, is not in compliance with the Weld County Code Section 23-4-90.B and and Section 29-3-10. Failure to address this problem may result in a violation being initiated and/or review of your current zoning permit 3`dAMUSR-655. Your immediate attention to this problem would be most appreciated. Cornell Ave Englewood CO 80110 Subject: BCS-030010—Sign Permit Dear Mr. Benge, The Department of Planning Services' has reviewed your application and related materials for compliancy with the Weld County Code in regards to the sign. We find that your sign proposal does not meet the intent of the Code. Section 23-4-90.B of the Weld County Code states that one (1) identification sigh per principal use shall be allowed, provided that the sign does not exceed sixteen (16) square feet in area per face. The proposed sign is forty (40) square feet. If you wish to proceed with a forty (40) square foot sign the Department of Planning Services recommends that you amend your Use by Special Review permit, 3rd AMUSR-655.
