HomeMy WebLinkAbout840694.tiff RESOLUTION RE: GRANT ACCESSORY DWELLING PERMIT NO. 14 : 84 : 3 - BETTY ANN NEWBY WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners of Weld County, Colorado, on the 27th day of June, 1984 , considered the request of Betty Ann Newby to place an accessory dwelling on a parcel of land which currently has a residence on it, and WHEREAS , said accessory dwelling is to be used as a princi- pal dwelling and is to be occupied in an A-Agricultural Zone Dis- trict, with said parcel being more particularly described as follows: The SEq and SW4 of Section 33 , Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS , the Board of County Commissioners, having heard the testimony, finds that said request should be granted sub- ject to the following conditions: 1) the applicant shall apply for a building permit for the accessory dwelling within thirty days from the date of approval by the Board of County Commis- sioners; 2) a septic permit shall be obtained and the site shall meet percolation test requirements prior to the issuance of a building permit; 3) prior to the issuance of a building permit, the owner shall submit evidence that the proposed water tap is supplying water in such a manner as to be adequate in quality, quantity and dependability for the proposed use; and the acces- sory dwelling shall not be occupied until such time that the applicant has complied with Conditions 1 , 2 and 3 above. The Department of Planning Services staff has reviewed this request and recommends that the request be approved for the reasons: WILL WILL NOT X Be compatible with the Weld County Comprehensive Plan X Be compatible with the surrounding area X Be in harmony with the character of the neighborhood X Adversely affect the immediate area X Be adequately served by water and sewage disposal facilities X Adversely affect the general health, safety and welfare of the inhabitants of the area and the County COMMENTS: Mrs. Newby would like to construct a smaller residence for herself to enable her son and his family to move into the main house on the Newby Farm. The Department of Planning Services has not received any objections regarding this case. The Department of Planning Services staff recommendation for approval is conditional upon: 1. The applicant applying for a building permit for the accessory dwelling within thirty (30) days from the date of approval by the Board of County Commissioners. 2. My sons Gregg and two children and Lane and I have been living in the main house . Gregg is to be married soon and will have 4 children, so I feel that he should live in the main house . He is in charge of the actual farm op- eration and also has a fair sized flock of sheep operation. Both of thew: activities require him to be here at all times. The accessory dwelling will be for my son Lane and my self. He does a lot of our mechanical work and helps in the field during peak times . I 'm the farm manager and do a lot of the selling of our hay to people buying in small amounts . This requires that I be close to the hay and scale . The small house on the north side of the "farmstead" buildings is occupied by my son Neal and his family. He also helps us at peak times and helps with the mechanical jobs . There is a house and grade A dairy and corrals just east of W.C .R. 52 (in the center of the south side of the proper ty) . We rent set of buildings to a dairyman.
