Masden, Chair Commissioner William H. Jerke, Pro-Tem Commissioner M. J. Geile Commissioner David E. Long Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther E. Gesick Assistant County Attorney, Lee Morrison Planning representative, Sheri Lockman The following business was transacted: I hereby certify that pursuant to a notice dated December 12, 2003, and duly published December 18, 2003, in the South Weld Sun, a public hearing was conducted on December 29, 2003, to show whether good cause exists for revocation of Amended Use by Special Review Permit #685 for a Kennel and Boarding Facility (not to exceed 140 dogs and 20 cats) in the A (Agricultural) Zone District. At said hearing on December 29, 2003, the applicants were not present, therefore, the Board deemed it advisable to continue the matter to January 19, 2004. At said hearing on January 19,2004,staff advised the Board that applications had been submitted for a Zoning Permit for a Mobile Home to be used as an office,and a Recorded Exemption,and further testimony revealed the house in violation has been abandoned and the utilities removed,therefore, the Board deemed it advisable to continue the hearing to April 19,2004. At said hearing on April 19, 2004, Lee Morrison, Assistant County Attorney, made this a matter of record. Sheri Lockman, Department of Planning Services,stated the applicants have completed a Zoning Permit for a Mobile Home, staff has signed the Building Permits, the office was vacated and is not being used as a rental,the access issues have been resolved with the Colorado Department of Transportation,and the Board recently approved the partial vacation of Use by Special Review Permit#685,therefore, staff requests this case be dismissed. No public testimony was offered concerning this matter. Commissioner Long moved to dismiss the Show Cause against Matt and Becky Fosher. Commissioner Geile seconded the motion, which carried unanimously.
