RE: ACTION OF BOARD CONCERNING PETITION FOR ABATEMENT OR REFUND OF
TAXES -NICHOLAS JAMISON AND THE THOMAS E. BERRY AND THEO D. BERRY
DECLARATION OF TRUST
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board of County Commissioners of Weld County, State of Colorado, at a
duly and lawfully called regular meeting held on the 14th day of July, 2004, at which meeting there
were present the following members: Chair Robert D. Masden, and Commissioners M. J. Geile,
William H. Jerke, and Glenn Vaad, with Commissioner David E. Long being excused, and
WHEREAS,notice of such meeting and an opportunity to be present has been given to the
taxpayer and the Assessor of said County, and said Assessor, Stan Sessions, being represented
by Chris Woodruff, and taxpayer Nicholas Jamison and the Thomas E. Berry and Theo D. Berry
Declaration of Trust, being represented by Patrick Groom, and
WHEREAS, the Board of County Commissioners have carefully considered the attached
petition, and are fully advised in relation thereto.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado,that the Board concurs with the recommendation of the assessor and the petition
be and hereby is, approved in part, and an abatement or refund be allowed as follows:

Dr. Nicholas A. Jamison hereby appoints the law firm of Witwer, Oldenburg, Barry &
Johnson, LLP ("Agent"), as his agent for all matters regarding a petition for abatement or refund
of taxes, pursuant to Title 39 of the Colorado Revised Statutes, for the property located at 3001-
8th Street, Evans, Colorado 80520. This appointment includes the authority to appear on behalf
of Owner before appropriate courts, authorities, and agencies, and the appointment shall continue
until it is terminated in writing by the Owner or Agent.

ADDENDUM TO PETITION FOR ABATEMENT OR REFUND OF TAXES
The taxes assessed against the Property for the tax years 2001, 2002, and 2003 are
incorrect because the Property is erroneously valued.
The Property consists of a main floor of approximately 5,000 square feet and a storage
basement. The building was built by one of the current owners, Dr. Nicholas A. Jamison,
father in the 1950's. Little improvements, if any, have been made to the building since it
was erected, and the main floor is comprised of open space with no division into offices
and/or cubicles.
The erroneous value for the years 2001, 2002, and 2003 fails to take into account the
actual income available from the Property. The current tenant, P.S. Trophies, rents the
Property for $1,300.00 for month. Prior to the current tenant's occupation of the
Property, the Property was vacant for approximately two (2) years. The previous tenant,
Weld County's copy machine lessor, abandoned the Property in the middle of their lease.
While the County is well aware of the plight of landlords in downtown Greeley, a rental
comparison of historical rents on the Property illustrate this point. In 1954, the Property
rented for$2,400.00 per month; in 2004, it rents for$1,300.00.
In December, 2001, the previous owner of the Property, Anna Jamison, passed away. As
part of the administration of her Estate, the Property was appraised in 2003. The
appraised market value of the Property was determined to be $100,633.33. A copy of the
appraisal is attached hereto.
For Assessment purposes, the "Actual Value" of the Property for 2003 was $175,000.00,
resulting in an "Assessed Value"of$50,760.00. The Actual Value of the Property for the
year 2003 should have been no greater than $111,000.00, which would take into account
the economic reality of the site.
