In utilizing the plat drawing of the Onsite Improvements Agreement for (private road maintenance) I verified quantities and unit costs for estimated construction costs, site grading,street grading, street base,fire hydrants, street name signs, stop signs, and culverts. All units costs appear to be adequate to complete the project. I recommend acceptance of the transportation portion of the Exhibit "A." All other non-transportation items should be verified by Planning Services prior to scheduling. In the Road Stabilization Improvements Agreement, the developer agrees to pay the amount of$2,248 for each lot, which is identified on Page 2 of 5, Item 3A. In checking the calculation in Item No 3C, the lot commitment does not add to the number that appears in the agreement. I have contacted Todd Hodges Design to rework the figures to match the total requirement of $20,232. I am very concerned with the Mr. Deroo's take on addressing in Weld County subdivisions. As the other attached shows, I did make some minor concessions for the Post Office, but the method still follows Weld County Code Ord 2003-6. My question is, since the method has not changed, why the big problem now? How did they locate subdivisions in the past? I feel we must follow the code and, since Ambulance Services has GIS and the new map books, it is their obligation to know where new development is. This is the same situation and argument as Nunn FPD. One of the addresses submitted is 5305 Red Tail Court. If the crews were to be paged to an emergency and all that was given was the 5305 Red Tail Court it would be extremely difficult to find. The crew would guess the address would be somewhere in the southwestern part of Weld County due to the low numbers, but that would be as close as they could come to the incident without a Weld Counry Road address at the end to obtain a crossroad. For example, if the address was 5305 Red Tail Court WCR 1 the crew would know that the address is located on WCR 1 and the crossroad would be WCR 12 with the house three tenth of a mile north from WCR 12 and WCR 1 and be located on the east side of the road. Without a WCR number as the example above indicates on the end of an address for a reference, it is impossible for any emergency agency to know where to respond to. There is a significant amount of new subdivisions being developed monthly throughout the county's 4004 square miles and for our agency's personnel to know where everyone of these are without good complete addresses is impracticable. For this reason without a complete address the developer and residents of this subdivision must be aware if an emergency should occur a significant delay in the response time could occur. The Fire District objects to approval of the final plan at this time. The Response Questionnaire states that the applicant has been proactive in meeting the Fire Districts requirements. I must disagree to some extent because although the utility plans were dated February 14, 2003, the Fire District did not receive them for review until February 23, 2004. At this lime, the Fire District found that hydrant spacing did not meet the requirements of the District. Additionally, there has been correspondence with the applicant stating the addressing of the lots is problematic. Please see the attached copies of my recent correspondence regarding the subdivision. In residential subdivisions, generally hydrants may not be spaced more than 500 feet apart and a hydrant must be located within 250 feet of the front property line of all lots. r-� Because these are residential estate with very large lots and the homes will be provided with residential sprinkler systems, the Fire District will accept the following: the hydrant between lots 5 and 6 needs to be relocated to between lots 4 and 5 and an additional fire hydrant needs to be provided between lots 1 and 2. Department of P lic • COLORADO Health and Environment CASE NO.: MF-1017 NAME: Jeff Stamp The Weld County Health Department has reviewed this final plat application. The resolution approved by the Board of County Commissioners on July 30, 2003 requires that language for the preservation and/or protection of the second absorption field envelope shall be placed in the development covenants. A review of the submitted final plat materials does not include any absorption field language in the covenants. The application was approved with the following Department recommended conditions being placed as notes on the plat: 1. Water service shall be obtained from the Little Thompson Water District. 2. A Weld County septic permit is required for each proposed septic system,which shall -- be installed in according to the Weld County individual sewage disposal system regulations. Each septic system shall be designed for site-specific conditions, including, but not limited to: maximum seasonal high groundwater, poor soils, and shallow bedrock. 3. Language for the preservation and/or protection of the second absorption field envelope shall be placed in the development covenants. The covenants shall state that activities such as landscaping (i.e. planting of trees and shrubs)and construction (i.e. auxiliary structures,dirt mounds,etc.) are expressly prohibited in the designated absorption field site. 4. If required, the applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment. Silt fences shall be maintained on the down gradient portion of the site during all parts of the construction phase of the project. 5. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions,at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 6. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods which are technologically feasible and economically reasonable in order to minimize dust emissions. 7. If land development creates more than a 25-acre contiguous disturbance,or exceeds 6 months in duration,the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. 8. "Weld County's Right to Farm" as provided in Appendix 22-E of the Weld County Code shall be placed on any recorded plat. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2003 International Residential Code; 2003 International Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code Code. 4. Each building that is required to have an engineered foundation shall be based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Building height shall be limited to the maximum height allowed for dwellings per the International Residential Code and for other buildings by table 503 of the International Building Code. Separation of buildings of mixed occupancy classifications shall be in accordance with IBC Table 302.3. and Chapter 3. Setback and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 2003 International Residential Code and the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. The District has reviewed the development proposal in terms of (1) available school capacity and (2) required land dedications and/or cash-in-lieu fees and has the following RECOMMENDATION: the District is OPPOSED to the approval of this application due to this development's impact on already overcrowded school facilities. 1) SCHOOL CAPACITY The Board of Education has established a District-wide policy of opposing new developments that add to the student enrollment of overcrowded schools prior to the District's ability to provide needed facilities. Overcrowded schools are those that are projected to be at or above 125% of their capacity within 5 years. The Board has determined that school facilities operating beyond the 125%threshold impose costs on the District that begin to affect its ability to adequately provide educational services to the public. Because of the burden created on the District once a school exceeds 125% of capacity, the District cannot support a plat until there is a known date for capacity relief. Typically capacity relief can be established once the Board of Education sets a construction schedule for a new facility, sometime after a successful bond election. Once the date of capacity relief is known, the Planning Department can work with the developer on an appropriate phasing plan that coincides the completion of new residential units with the addition of school capacity for the feeder. Current capacity for this feeder along with the impact from this development is noted in the chart below. Under the policy, should an applicant wish to begin construction on a residential development prior to the District's ability to provide additional capacity,the applicant may mitigate the development's impact on the feeder by agreeing to a voluntary, per-unit payment. Funds would be used to provide permanent or temporary capacity within the impacted feeder.The Planning Department would be happy to discuss this type of mitigation for the proposal with either the Town or developer. Specific comments concerning this proposal regarding School Capacity are as follows: • This application will add 9 new single-family dwelling units with a potential impact of 6 additional students in the Mead Elementary, Mead Middle and Skyline High School Feeder. The "Stdt. Impact" column in the above chart breaks down the development proposal's student impact by grade level. • Of the schools in this feeder, Mead Middle and Skyline High School are projected to exceed 125% of capacity in 5 years with the addition of students from this development. For this reason, the School District is not supporting this application at this time. A middle school is scheduled for opening in the Fall of 2005 and will alleviate overcrowding at the middle school level. However, additional high school capacity for this feeder, although approved under the 2002 bond, has not yet been scheduled for construction. Differing rates of residential growth in parts of the District and the budgeting of operating funds to staff new schools both affect the construction schedule of individual projects. In the mean time, Skyline High School may exceed 125%of its capacity within the next 5 years. (2) LAND DEDICATIONS AND CASH IN-LIEU FEES The land dedication/cash in-lieu policy of the District requires the dedication of land with the adjacent infrastructure and/or payment of an equivalent cash-in-lieu (CIL)fee based on the student yield of the development. CIL fees only provide funds for land acquisition, which is only a small component of providing additional school capacity for a feeder. Specific comments regarding land dedications and CIL fees for this referral are as follows: • The School District does not anticipate the need for additional school land in this area and does not request a dedication at this time. • Since no land dedication is required,Cash in-lieu fees will be assessed per the attached chart. GENERAL COMMENTS The recommendation of the District noted above applies to the attendance boundaries current as of the date of this letter. As new school facilities are constructed under the approved 2002 bond, this project's attendance area and capacity could be affected in the future. Under current boundaries, transportation would most likely be provided for middle school only starting in the Fall of 2004.
