ANNEXATION IMPACT REPORT` for ALATAMIRA PROPERTY May 6, 2004' Ag 3t r`s.,.ry fr ,� yA dE Views of the subject property Annexation of property to the Town of Lochbuie, Colorado by: The Bromley Companies, LLC 9145 East Kenyon Avenue, Suite 100 �+� •• Denver,CO 80237 44--ce-C(/t- 5--/cr c ' CC° C7/1,77/ ' 2004-1441 Altamira Annexation Impact Report INTRODUCTION The following report has been prepared pursuant to Section 31-12-108.5 of the Colorado Revised Statutes(C.R.S.)and concerns the proposed annexation by The Bromley Companies,LLC of certain real property known as Altamira(Property)to the Town of Lochbuie(Town).The property proposed for annexation comprises a total of 235.35 acres.That total includes a 30-foot wide strip along the northern boundary of the northwest'/of Section 36,and most of the southern '/,of Section 25,of Township 1N,Range 66 W of the 6th Principal Meridian, Weld County,Colorado. The southern boundary of the Property includes a portion of the right-of-way for Weld County Road 4. To the east,the Property is bounded partly by County Road 37 and partly by the Tagawa Greenhouses property. Lochwood Farms PUD is directly southeast of Altamira. Part of the development proposal as outlined on the Conceptual Plan Map(Exhibit C)is not included with this annexation petition. A portion of the Speer Canal and the West Burlington Extension Ditch are onsite and there is an onsite oil well easement. CURRENT ZONING AND USES/PROPOSED USES/PROCESS The Property is currently zoned A-1 (Agriculture) in unincorporated Weld County and current uses are agricultural. In connection with the annexation, Bromley Companies will process a zoning request so that a residential Planned Unit Development(PUD)will be permitted. A Conceptual Plan Map(Exhibit C) is submitted with this report, showing possible layouts of roads and lots. The Conceptual Plan proposes 5 dwelling units(DU)per acre. An Annexation Petition for the Property was submitted to the Town of Lochbuie on March 26, and Town of Lochbuie Board of Trustees approved a Resolution of Substantial Compliance on April 7,2004,acknowledging receipt of the petition for annexation for the Property and finding that the petition was in substantial compliance with relevant annexation statutes and setting a Public Hearing related to the application. The date,time,and place for a Planning Commission meeting and for the Public Hearing for the proposed Annexation are as follows: • Tuesday, May 25 2004,Planning Commission: recommendation on zoning and annexation to the Town Board, held at 7:00 p.m. at the Lochbuie Town Hall, 152 Poplar St,Lochbuie, Colorado. • Wednesday,June 2,2004,Town Board: Public Hearing on annexation, held at 7:00 p.m. at the Lochbuie Town Hall, 152 Poplar St,Lochbuie,Colorado. Advertising and notice,pursuant to the C.R.S.,are being overseen by the Town of Lochbuie. Copies of the annexation petition,the referenced resolution,and the published notice of the hearing,were mailed to the Weld County Board of County Commissioners and the County Attorney, among others, in accordance with C.R.S. §31-12-108. 1 Altamira Annexation Impact Report ANNEXATION IMPACT REPORT REQUIREMENTS This section is divided into the six elements that correspond to section 31-12-108.5(1(a)through (f),C.R.S. as follows: A. REQUIRED MAPS- C.R.S.§31-12-108.5(1)(a) Thee maps are included as exhibits to this report as required by Subparagraph(a)of C.R.S. 31- 12-108.5: Exhibit A: Annexation Map This map shows the property boundaries in relation to current Town boundaries. Exhibit B: Conceptual Utility Service Map Exhibit B shows the existing utility services(including major water trunk lines and sewer lines), and major roads,and ditches, located near and on the Property. After the annexation is complete, the extension and provision of municipal services to the proposed development would be implemented in accordance with the terms of the annexation agreement to be negotiated between Annexor,the Town and any other appropriate agencies. Streets: Current"streets"on the Property consist of dirt or gravel roadways across fields. Street extensions into the Property would be developed from Weld County Roads 37 and 4. Improvements to County roads may be necessary in conjunction with the development of the Property. Water,Sewer,Electric Transmission and Ditches: Existing trunk water mains and sewer interceptors and outfalls are located in the intersection of Weld County Roads 4 and 37(Exhibit B). Water and sewer lines could be extended into the Property along CR 4 or CR 37. A major electric transmission line is located along County Roads 4 and CR 35 at the southwest corner of the Property. An east-west transmission line is also located approximately',mile north of the property. The Speer Canal and the West Burlington Ditch both extend through Altamira in a north-south orientation. Exhibit C: Conceptual Plan Map This map presents the residential development that is generally proposed for the subject property. Total area is approximately 235 acres. Exhibit C includes a parcel that is not a part of this annexation and is not included with the estimate of total acreage. The Bromley Companies propose an average density of 5 DU/acre. ANNEXATION AGREEMENT—C.R.S. §31-12-108.5(1)(b) A preannexation agreement is not required and has not been prepared.An annexation agreement is anticipated to be part of the annexation of this Property. Work on a draft of annexation agreement is in progress and will be forwarded to the Weld County Attorney and other parties upon its completion. C. EXTENSION OF MUNICIPAL SERVICES-C.R.S. §31-12-108.5(1)(c) For all facilities and services,the Annexor will have the obligation to develop and install all on- site and off-site transmission and/or infrastructure facilities necessary to serve the Property with water,wastewater,stormwater facilities and services. Water: It is anticipated that the Town will provide water treatment and water services to the Property. The Annexor will provide a sufficient amount of raw water or water rights to serve the development of the Property per Town Ordinances and the annexation agreement. Wastewater: It is anticipated that the Town will provide wastewater services and wastewater treatment to the Property after acceptance of all wastewater facilities constructed by the Annexor. Stormwater: The Annexor will design and construct storm drainage facilities within the Property. Stormwater drainage may include: channels, inlets, piping,detention ponds and water quality facilities.The Annexor shall convey and manage the 100-year storm event in compliance with standards approved by the Town and applicable Districts. Other Utilities: • Telephone service will be provided by Qwest • Electrical service by United Power • Natural gas service by XCEL Energy Service lines will be located within street or other rights of way dedicated to those purposes within the Property. Emergency Services: • Police protection will be provided by the Town's Police Department. • Fire Protection will be provided by the Hudson Fire Protection District. Open Space/Parks/Public Land Dedication: The annexation agreement will document the public land dedications and/or fees that will meet or exceed Town standards for parks,open space, schools and other public facilities,as appropriate. Streets: The proposed access to the Property would be from Weld County Roads 4 and 37,and from roads to the north as the property directly north of Altamira is developed. It is anticipated that the Annexor will improve both off-site(as identified)and on-site streets to urban public standards as identified in the annexation agreement. The Town's Comprehensive Plan(May 2003)proposes 3 Altamira Annexation Impact Report extending CR 35 along the western Property boundary but the extension has not yet been scheduled. D. FINANCING SERVICE EXTENSIONS-C.R.S.§31-12-108.5(1)(d) The extension of municipal services into the Property will occur through one or more of the following mechanisms: I. Development Fees, 2. Improvement Districts, 3.Developer Funds, 4.Metropolitan Districts, 5. Impact Fees, or 6. As otherwise agreed to between the Town and the owners of the Property. E. EXISTING DISTRICTS IN THE AREA TO BE ANNEXED- C.RS. §31-12-108.5(1)(e) The Weld County Treasurer's office records reflect that the Property is currently subject to the following taxing authorities: Taxing District Ames Junior College District 6.316 Hudson Fire Protection District 3.318 CCW Water District .871 Central Colorado Water Conservation District 3.850 Weld County School District RE-3(j) 39.500 Weld County Library District 3.249 Weld County Administration 20.056 With annexation to the Town, one or more of the taxing entities noted above may no longer serve the Property. F. EFFECT ON SCHOOL DISTRICT RE-3(j)-C.R.S. §31-12-108.5(1)(t) Proposed residential development of the Property will affect attendance and capital facility needs within the Weld County School District RE-3(j). RE-3(j)is in the process of reviewing the potential impacts of the proposal. A student generation rate of 0.645 students per dwelling unit has recently been proposed for the RE-3(j)District. Based on Bromley Companies' proposed density: > 5 Dwelling units/acre: Total 1,175 DU would generate an estimated 758 students Capital facility construction and improvements would need to be made to RE-3(j)facilities to serve the new students. The annexation agreement will identify any land dedications or cash-in- lieu payments to offset the impacts of the proposed development.
