HomeMy WebLinkAbout20043375.tiff 784 11111111111111111111111111111 III 1111111 III 11111 IIII IIII 3246784 12/27/2004 12:18P Weld County, CO 1 of 2 R 0.00 D 0.00 Steve Moreno Clerk& Recorder RESOLUTION RE: ACTION OF THE BOARD CONCERNING CANCELLATION AND RELEASE OF COLLATERAL FOR USE BY SPECIAL REVIEW#1382 -VETERINARY PROPERTIES, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated July 10, 2002, the Board approved the application of Veterinary Properties, LLC, 1907 1st Avenue, Greeley, Colorado 80631, for a Veterinary Clinic in the A (Agricultural) Zone District on the following described real estate, to wit: Lot of Recorded Exemption#2948; being part of the W1/2 SE1/4 of Section 26,Township 6 North, Range 66 West of the 6th P.M.,Weld County, Colorado,and WHEREAS, on January 20, 2003, the Board of County Commissioner of Weld County, Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for Improvements(Private Road Maintenance)for Use By Special Review#1382, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Veterinary Properties, LLC with terms and conditions being as stated in said agreement, and on November 5, 2003, approved the release of collateral, retaining only$5,000.00 in an Escrow Fund with Wells Fargo Bank West, N.A.,to cover the Landscaping portion of said agreement, and WHEREAS, on November 15, 2004, the Board of County Commissioners deemed it advisable to continue this matter to November 22, 2004, at the request of the applicant, and WHEREAS, on November 22, 2004, a representative for the applicant was present, and WHEREAS,the Board of County Commissioners has received a request for the full release of said collateral from Countryside Large Animal Veterinary Service, LLC, 3765 West O Street, Greeley,Colorado 80631,and Department of Planning Services staff has recommended denial of said request, and WHEREAS,the Board of County Commissioners,after hearing testimony of those present and, having been fully informed, deems it advisable to continue said matter to February 23, 2005, with the requirement that the Veterinary Properties, LLC representatives work with staff to develop a new landscaping plan based upon recently received written recommendations, and at such time to consider whether or not it is advisable to release part or all of the collateral being held. 2004-3375 PL1609 0c : RI BBL r1�P� /�-.3d �l 1 IIIIII 1111 11111 3246784 12/27/2004 12:18P Weld County, CO 2 of 2 R 0.00 D 0.00 Steve Moreno Clerk& Recorder CANCEL COLLATERAL - VETERINARY PROPERTIES, LLC PAGE 2 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County,Colorado,that the Cancellation and Release of Collateral for Use by Special Review#1382- Veterinary Properties, LLC, be, and hereby is, continued to February 23, 2005. The above and foregoing Resolution was,on motion duly made and seconded, adopted by the following vote on the 22nd day of November, A.D., 2004.
