The Weld County Health Department has reviewed this proposal. The applicant proposes a 9 lot
minor subdivision on 80 acres. The minimum lot size is 7 acres with an overall density of one septic
system per 8.9 acres. The Larimer Canal borders the property on the west and various irrigation
ditches, and a pond currently exist on the property. Some ditches are proposed to be moved and a
detention pond is proposed on the property.
The application has satisfied Chapter 24 of the Weld County Code in regard to water service. The
application states that the subdivision will be served by North Weld County Water District. A letter of
intent was submitted with the application. Sewer will be provided by individual sewage disposal
systems. The minimum proposed lot size (7 acres) coupled with the overall density of one septic
system per 8.9 acres does meet current Department policy.
The preliminary percolation test report conducted by Church and Associates (dated February 19,
2003) states that some standard septic systems will be possible, however most can be expected to
be engineered systems due to high percolation rates (24 to 240+ minutes per inch).
The existing and proposed water features have been delineated on the Change of Zone plat along
with primary and secondary septic envelopes. The Department has several concerns: all septic
systems must be located a minimum of 100 feet from all irrigation ditches, wells, and/or ponds, and
25 feet from a detention pond. Using the scale provided, these setbacks will affect the septic
envelope placement on Lots 1, 6, 8, and 9 as delineated on the plat map. The Department
recommends that language for the preservation and/or protection of the second absorption field
envelope be placed in the development covenants. The covenants should state that activities such
as landscaping (i.e. planting of trees and shrubs) and construction (i.e. auxiliary structures, dirt
mounds, etc.) activities are expressly prohibited in the designated absorption field envelope.
The Department recommends approval with the following conditions:
Water service shall be obtained from the North Weld County Water District
�. A Weld County septic permit is required for each proposed septic system,which shall be
installed in according to the Weld County individual sewage disposal system regulations.
Each septic system shall be designed for site-specific conditions, including, but not limited
to: maximum seasonal high groundwater, poor soils, and shallow bedrock.
�. All septic system envelopes must be located a minimum of 100 feet from all irrigation
ditches, wells, and/or ponds, and 25 feet from a detention pond.

�. Language for the preservation and/or protection of the second absorption field envelope
shall be placed in the development covenants. The covenants shall state that activities

If required, the applicant shall obtain a storm water discharge permit from the Water
Quality Control Division of the Colorado Department of Public Health and the Environment.
Silt fences shall be maintained on the down gradient portion of the site during all parts of
the construction phase of the project.
$. During development of the site, all land disturbances shall be conducted so that nuisance

conditions are not created. If dust emissions create nuisance conditions,at the request of
the Weld County Health Department, a fugitive dust control plan must be submitted.
In accordance with the Regulations of the Colorado Air Quality Control Commission any
development that disturbs more than 5 acres of land must incorporate all available and
practical methods which are technologically feasible and economically reasonable in order
to minimize dust emissions.
If land development creates more than a 25-acre contiguous disturbance, or exceeds 6
months in duration,the responsible party shall prepare a fugitive dust control plan,submit
an air pollution emissions notice, and apply for a permit from the Colorado Department of
Public Health and Environment.

There are no active or historical building permits on record for this parcel.
XBuilding permits shall be obtained prior to the construction of any building. Buildings that
meet the definition of an Ag Exempt Building per the requirements of Section 29-1-20 and
Section 29-3-20 B.13 do not need building permits, however a Certificate of Compliance must
be filed with the Planning Department and an electrical and/or plumbing permit is required for
any electrical service to the building or water for watering or washing of livestock or poultry.

Please accept this letter of agreement between the Weld County Re-4 School District and Charles
Meserlian for Black Hollow Estates. This agreement references Case No. MK-1039.
The developer has agreed to pay a cash-in-lieu fee of$1,214.57 for each unit in the subdivision.
Currently there are nine lots in the subdivision. There will be no land dedication requirement.
Further, the developer has agreed to build a bus loading zone at the intersection of Black Hollow
• Court and Weld County Road 21. These provisions will satisfy the District in rela`z:on to this

COLORADO SUBJECT: MZ-1039 Black Hog Scat Minor Subdivision(Zone Change)
Weld County Public Works Department has reviewed this change of zone request. Comments made during this phase
of the subdivision process may not be all-inclusive, as other concerns or issues may arise during the remaining
application process.
Comments
External Roadways:
❑ CR 21 and CR 84 are classified by the County as local roads and require 60-foot rights-of-way (en-total). If not
verified, 30-foot rights-of-way will be dedicated on the final plat. CR 21 and CR 84 are graveled.
❑ The applicant is showing CR 21 and CR 84 on the change of zone plat with 40-foot rights-of-way. This would be
appropriate for collector roads, which require 80-foot rights-of-way total. The applicant shall address the proposed
40-foot rights-of-way.
❑ Additional right-of-way shall be required adjacent to the bus pullout area equivalent to the width of the pullout lane.
Revisions must be made to the change of zone drawings, and this right-of-way shall be dedicated on the final plat.
Furthermore, the applicant shall show details of the bus pullout on the Road Plan & Profile drawing to be submitted
with the final plat materials.
@ The applicant shall provide to the Public Works Department written documentation from the school district of
jurisdiction regarding the bus pullout along with the final plat application materials.
!) The applicant shall provide to the Public Works Department written documentation from the post office of jurisdiction
regarding the mailbox turnout along with the final plat application materials.
This 9-lot development will add approximately 86 trips per day to CR 21. The applicant shall enter into an agreement
with the County to proportionately share the cost of improving CR 21. The cost will be based on a proportion of the
traffic generated by the development to existing traffic. The applicant shall submit a proposed off-site roadway
agreement with the final plat application.
ci A traffic study is not currently required, based on the proposal of limited development and anticipated traffic impact
on surrounding roads.
Internal Roadways:
❑ County Code requires developments to pave internal roadways.
❑ The typical roadway cross-section should be shown as two 12-foot paved lanes with 4-foot gravel shoulders on the
change of zone plat. The cul-de-sac edge of pavement radius shall be 50-feet minimum. Stop signs and street name
signs will be required at all intersections. The applicant must resubmit the change of zone plat with an appropriate
cross-section shown.
❑ Intersection sight distance triangles at development entrances shall be shown on the resubmitted change of zone plat.
All landscaping within the triangles must be less than 3'/z feet in height at maturity, and noted on the final roadway
plans.
❑ Easements shall be shown on the final plat in accordance with County standards (Sec.24-7-60) and/ or Utility Board
-^ recommendations. The easements shown appear correct.
The applicant shall provide a pavement design prepared by a professional engineer along with the final plan submittal.

❑ The applicant shall submit to Public Works stamped,signed and dated final plat drawings and roadway/construction
& grading plan drawings for review (with the final application) and approval. Construction details must be included.
This is consistent with County Code: Sec. 24-3-50, "The minor subdivision final plat submitted shall contain the
original signatures and seals of all parties required."
The applicant shall submit an Improvements Agreement According to Policy Regarding Collateral For Improvements
(Public Road Maintenance) with the final plan application. This agreement must be reviewed by Public Works and
shall be approved by the BOCC prior to recording the final plat.
Drainage:
❑ The Public Works Department did not receive requested information from the applicant addressing the shallow
groundwater issue with change of zone application materials. The engineer stated in his letter to Planning that the
submittal included a summary of flood plain and geo-hydraulic information, which Public Works has not received.
Additionally, the engineer's letter stated information relating to groundwater depth had been provided.
❑ The Drainage Report for Black Hollow Estates, dated March 05,2003,by Team Engineering, Inc. in its initial form is
acceptable. A complete review will be done with the final plat application.
❑ The Engineering Geology Report for Proposed Black Hollow Estates, dated February 14, 2003, by Church &
Associates, Inc., states that groundwater was encountered in test holes. The applicant must address this issue at
change of zone.
o A note must be placed on the change of zone plat stating that "lots may not accommodate full-depth
basements"due to groundwater levels.
❑ A final drainage report stamped, signed and dated by a professional engineer licensed in the State of Colorado shall be
submitted with the final plat application. The 5-year storm and 100-year storm drainage studies shall take into
consideration off-site flows both entering and leaving the development. Increased runoff due to development will
require detention of the 100-year storm developed condition while releasing the 5-year storm existing condition.
❑ The final drainage report shall include a flood hazard review documenting any FEMA defined floodways. The
engineer shall reference the specific map panel number, including date. The development site shall be located on the
copy of the FEMA map.
1 The applicant shall prepare a construction detail for typical lot grading with respect to drainage for the final
application. Front, rear and side slopes around building envelopes must be addressed. In addition, drainage for rear
and side lot line swales shall be considered. Building envelopes must be planned to avoid storm water flows, while
taking into account adjacent drainage mitigation.
❑ Final drainage construction and erosion control plans (conforming to the drainage report) stamped, signed and dated
by a professional engineer licensed in the State of Colorado shall be submitted with the final plan application.

1. WSFPD will require a water model to be performed for this project. The
subdivision is required to meet our minimum Fire Flow of 1000gpm @
20psi. All water mains are to be looped.
2. Current District streets standards provide that streets 34' and greater can
allow parking on both sides of the street; streets 28' in width will allow
parking on one side of the street only and "NO PARKING FIRE LANE"
signs shall be posted on one side. All streets less than 28' shall be
prohibiting parking on either side and "NO PARKING FIRE LANE" signs
shall be posted on both sides of the street.
3. Cul-de-sacs shall have a minimum 50' turning radius. A B-40 turning
template shall be used to determine adequate turning radius. Required
vertical clearance shall be 13'6". There shall be no grade greater than 6%
on open streets and no grade greater than 4% in intersections. Maximum
depth of cul-de-sacs is 600'.
4. This cul-de-sac exceeds 600' therefore it shall have a designated
emergency access and this access shall be maintained at all times
rendering this access as useable.
5. Hydrant installation details are required to be submitted to the Fire District
prior to project start up. "Complete set of utility drawings need to be
submitted to WSFPD for review and approval" before construction begins.
6. Hydrant location shall be located no more than 300' from structures and
600' spacing.
7. Fire safety during construction shall comply with section 8704 of the "97'
UFC.
8. When construction of new homes starts Addresses, Street Names, and
Signs shall be posted.
9. The Windsor-Severance Fire Protection District requires all buildings be
provided with proper and adequate vehicle access. All proposed building
envelopes currently exceed the 150' requirement as stated in the following
code section.

902.2 Fire Apparatus Access Roads.
902.2.1 Required access. Fire apparatus access roads shall be provided in
accordance with Sections 901 and 902.2 for every facility, building or portion of a
building hereafter constructed or moved into or within the jurisdiction when any
portion of the facility or any portion of an exterior wall of the first story of the
building is located more than 150 feet (45 720 mm) from fire apparatus access as
measured by an approved route around the exterior of the building or facility. See
also Section 902.3 for personnel access to buildings.
EXCEPTIONS: 1. When buildings are completely protected with an approved
automatic fire sprinkler system, the provisions of Sections 902.2.1 and 902.2.2
may be modified by the chief.
2. When access roads cannot be installed due to location on property,

chief is authorized to require additional fire protection as specified in Section
1001.9.
3. When there is not more than two Group R, Division 3, or Group U

More than one fire apparatus road shall be provided when it is determined by the
chief that access by a single road might be impaired by vehicle congestion,
condition of terrain, climatic conditions or other factors that could limit access.

The sheriff's office recommends the following improvements for this housing sub-
division:
1. The sheriff's office requests that builders and developers designate an area by
the entrance of the sub-division in which to place a shelter for school children
awaiting the school bus. This appears to be done for this subdivision.
2. Either a mail distribution within the sub-division or a central drop off location
within the sub-division should be developed so that residents do not have to
cross a county roadway to obtain their mail.
3. The name of the street within the sub-division should be presented to the
sheriffs office for approval. This will eliminate duplication of street names
within the county.
4. A permanent sign should be placed at the entrances to the sub-division
detailing the name of the sub-division, and address. There should be a plan
developed to maintain this sign.
5. If the roadways within this sub-division are not maintained or adopted by the
county, individuals purchasing property in this sub-division should be notified
that the sheriffs office will have limited traffic enforcement powers.
6. A plan should be developed to maintain roadways within the sub-division
especially during inclement weather conditions for emergency vehicles.
7. The sheriff's office is very supportive of homeowner funded homeowners
associations. These associations provide a contact for the sheriff's office and
a means for maintaining common areas.
8. The plans for this sub-division show roadway with no sidewalks. The
sheriffs office requests that sidewalks be provided.
9. If there is an oil or gas well within this sub-division, it needs to be fenced off
in order to mitigate the potential for tampering. These facilities are known to
create an attractive nuisance for young people. Tampering not only creates a
significant danger to safety but also of environmental damage with extensive
mitigation and clean-up costs.
10. If there is a large body of water in the development, it should be fenced off
for the safety of residents.
The Sheriffs Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.

We have reviewed additional information received on the above referenced proposal to
subdivide 80-acre parcel, into 9 single-family residential lots of approximately 8.9 acre in size.
On October 24, 2003 the State Engineer's Office received clarification on the water supply plan
for Black Hollow Estates subdivision from the applicant's Water Consultant Team Engineering.
Although we have not received a formal request by the county to review the additional
information to the water supply plan, the State Engineer's Office felt that it could respond to the
material submitted, as this is just the information requested in our previous letter dated April 24,
2003.
As requested a letter from The North Weld County Water District (District) has been
submitted with this additional information. Based on the above-mentioned letter the District is
able and intends to serve the proposed 9 residential lots. The District will supply treated water
to the subdivision, charging fees for the water supply on a per tap basis payable prior to the
activation of the tap. Based on current records on file in this office, the District currently has an
adequate uncommitted water supply to provide the water associated with this subdivision.
In addition a Water Supply Information Summary Sheet was also provided. The
household use water requirement for the residential lots is estimated at 5,400 gallons per day
(6.04 acre-feet per year).
Pursuant to Section 30-28-136(1)(h)(II), C.R.S., the State Engineer's office offers the
opinion that the proposed water supply will not cause material injury to existing water rights, and
the supply is expected to be adequate with the North Weld County Water District supplying the
water to the subdivision.

As you may know, the State Engineer's Office through a Memorandum dated August 7, 1995
informed the counties that, effective August 31, 1995, this office will no longer respond to land use actions
that do not involve the subdivision of land as defined in Section 30-28-101(10)(a) C.R.S. (see attached
memorandum). These actions include, but are not limited to lot line adjustments, zone change request,
special use land and division by exemption. The material submitted this time appears to be only for a
change in zoning on the proposed Black Hollow Estates.
However, since we have previously commented on the above-referenced proposal to subdivide an
80-acre parcel, into 9 single-family residential lots of approximately 8.9 acre in size, we will reiterate those
comments. The North Weld County Water District (District) will provide water for the residential lots. The
District has agreed to serve the proposed site and information from this referral indicates that a water
extension agreement has been submitted to, and has been approved by the Weld County Attorney's
Office. However, as we mentioned in our previous letter, a letter of commitment from the District needs to
be provided to the State Engineer's Office. We also request that a complete Water Supply Information
Summary be provided to this office with the estimates on the total residential water usage.
Since our concerns regarding the North Weld County Water District commitment to the
subdivision were not addressed in this submittal the comments from our letter dated April 24, 2003 are still
in effect.

This memorandum is to inform you of procedural changes in providing "an opinion regarding
material injury likely to occur to decreed water rights by virtue of diversion of water
necessary or proposed to be used to supply the proposed subdivision and the adequacy of the
proposed water supply to meet requirements of the proposed subdivision", as required under
section 30-28-136(h)(I), C.R.S. (1986 Repl, Vol.).
In June of 1992, HB92-1156, required that recommendations be made within 21 days after
the mailing by the county. No additional staff was allocated to implement this accelerated
review. I find that with the increased developmerifactivity in the state:my staff cannot-
respond in a timely manner to all of the land use referrals we receive.
• Therefore, in order to allow our timely comments on all SUBDIVISION OF LAND referrals
as mandated by section 30-28-136(h)(I) C.R.S., effective AUGUST 31, 1995, THIS
OFFICE WI I NO LONGER RESPOND TO LAND USE ACTIONS THAT DO NOT
INVOLVE THE SUBDIVISION OF LAND AS DEFINED IN SECTION 30-28-101-
(10)(a) C.R.S. (1986 REPL. VOL.). These actions include but are not limited to lot line
adjustments, zone change requests, special use of land, and division by exemption. After
August 31, 1995, we will not respond to or maintain records on any referral we receive that
does not address the subdivision of land as defined in section 30-28-101(10)(a)C.R.S.
Enclosed is a "Water Supply Information Summary" form which as of August 31, 1995 we
will require to be submitted along with each subdivision referral in order for us to be able to
respond in a timely manner. I ask that you provide copies of this form to all future
subdivision applicants along with your application package. The data required for this

summary should be provided by the applicant from their water supply report as required
under section 30-28-133(d)(I),(II),(III),and (IV) C.R.S. (1986 Repl. Vol.). We will base

Your planning staff may refer to the attached guidelines to assist them in preliminarily
determining whether a well permit might be available. County planners and reviewers
should keep in mind that the issuing of a well permit does not assure that an adequate well
can be developed on the parcel Also, well test and pump tests conducted in conjunction
with well construction are not always reliable indicators of long term ground water
production rates. The long term adequacy of any ground water source may be subject to
fluctuation due to hydrologic and climatic conditions.
Please inform your planning staff of our procedural changes and the guidelines related to the
issuing of well permits. I regret having to make these changes but our resources are
extremely limited due to growth related work load increases, so we can only provide services
required by statutes.

This morning WSSC received a fax of the letter Mr. Jeff Couch sent to you requesting the
approval to proceed with their application without an agreement between the two parties.
Before I respond to his request, I must respond to the assertions made by Mr. Couch.
• It is true that I did tell Mr.Couch that I had seen a copy of the letter agreement and had
lost the e-mail file, but in the same discussion Mr.Couch stated that he had forgotten to
follow up on the agreement until the morning of the hearing and had discovered that it
was not completed.
• My letter to the planning commission does not"summarize exactly"the letter agreement
that he wrote. We would want a signed and recorded by the applicant right of way
agreement and a letter of understanding to include a statement on the plat addressing the
possibility of groundwater problems on the lots. 1.have spoken to our attorney about this
right of way agreement and letter of understanding. Our attorney's workload for the
company is currently fully committed to other company issues and it will take some time
to get a draft ready to submit to the applicant.
• Mr. Couch's letter states that one locked gate per lot for lots adjacent to the ditch will be
allowed. That was never discussed during the one meeting. We are opposed to it
because we do not want any access to our ditch by any one in the development. We want
no additional exposure to liability as stated in the letter to the commission.
I am unwilling to direct our attorney to stop more pressing matters and have him draft the
documents necessary for our protection in this application. As mentioned above I have talked to
our attorney about this matter last week and am willing to commit to having drafts done by the
end of the year.
•
Water Supply and Storage Company is not opposed to the scheduling of this application before
the County Commissioners. That is an issue between the planning department and the applicant.

I have met with a representative of this application once,several months ago, to discuss
the proposed land use change. I am writing today to let you know the status of any
agreement between our company and the applicant.
At the time there were three concerns our company had with the application: a recorded
right of way for operation,construction,repair and maintenance of the ditch, fencing to
mitigate additional exposure to liability and unauthorized use of the right of way, and the
location of the building envelopes in respect to the location of our ditch.
This morning the applicant's representative faxed a copy of a proposed letter agreement
to our company. This letter appears to have been written by our company. It was written
by someone other than Water Supply and Storage Company.
I will respond to the three sections of the letter.
Right-of-Way:
The right of way will allow the company to do all of the activities
identified above and be recorded
Fencing:
The purpose of the fence is to not allow access to the ditch for reasons
mentioned above
Groundwater:
Because this proposed use is located downstream from our ditch, which is
unlined and has been in existence for approximately 100 years,thiscould
result in future disagreement about who is responsible for any actual or
perceived damages as a result of these waters. We ask that proper
notification to the future owners stating this potential and that it is a
condition they accept when purchasing their lots.

upcoming Change of Zone submittal for Black Hollow Estates. This correspondence is intended to
satisfy 23-2-50.8.14 of the Weld County Code relating to the need for an agreement between
Wafer Supply and Storage Company and the owner/developer of Black Hollow Estates.
This information is provided to identify any conflicts or issues relating to the development of rune
(9) residential lots purposed as part of Black Hollow Estates. Specifically, it applies to historical
and necessary ditch activities which Water Supply and Storage Company undertakes along the
Larimer County Canal adjacent to this property located south of Weld County Road 84

Areas adjacent to the canal may have a higher water table. Houses should be setback an
appropriate distance to eliminate potential conflicts with groundwater, underdrains,existing
irrigation headgates and laterals. Future structures should be designed to facilitate

project at this time and reflects our previous comments dated April 24, 2003. Additional
