Application was made to the Weld County Planning Staff on December 3, 2004 for a Use By Special Review
in the A(Agricultural Zone District)
Notice of mineral owner and lessees of the mineral estate were notified per State Statute by Tammy Ellerman
on December 29, 2004.
The purpose of today's hearing is to ask you for a determination if a Site Specific Development Plan and a
Special Review Permit for a business permitted as a Use by Right in the Commercial Zone District(vehicle
sales and detailing establishment) in the A(Agricultural)Zone District.
1. Project Overview:
a. Location:
The subject property is located South of and adjacent to County Road 20; East of
and adjacent to Highway 85.
b. Size:
The proposed development acreage is 1.69±acres
The total acreage is 3.164±acres.
c. Surrounding Land Uses:
Surrounding land uses are Highway 85,WCR 20, Railroad Tracks, Kerr McGee Oil and Gas
Tank Batteries,Tote A Shed currently operating under a USR for building of metal sheds and
garages. Many other small businesses in the Corridor are operating under USR's for
commercial business purposes. I will address those in a minute.
2. Chapter 22 of the Weld County Code specifies that the County will continue to support agricultural
activities occurring in unincorporated Weld County. The conversion of agricultural lands to non urban uses
will be accommodated only in areas that have the ability to support such development with adequate facilities
and services. The Applicant has obtained support from Colorado Department of Transportation,The Colorado
Division of Water Resources and is in compliance with a Commercial Well Permit#254153. The sewage
disposal will provide a professional engineered septic system to accommodate commercial use. The
Applicants are working with the Fort Lupton Fire and Rescue which have no concerns. They have also been
in contact with the Weld County Health Department and will meet the criteria addressed in their referral. The
building will meet all specifics mandated by the Weld County Building Department.
3. Review: In reviewing Section 23-2-220, it states "The USES which would be permitted will be
compatible with the existing surrounding land USES. Commercial use of the subject property is undoubtedly
the 'Highest and Best Use of This Property'. Looking at our vicinity map, you can see that most of the
surrounding properties in this region are currently under a USR or grand fathered in and being used for
commercial purposes. From the Fort Lupton city limits to the 3 mile referral area of Fort Lupton these
commercial businesses are aboard. Also along Highway 85 north of the referral to Platteville and Gilcrest.

This definitely is not prime farm ground in that it is a small barren parcel with no irrigation water. It is, at best,
minimally suited for a residence. The traffic noise on Highway 85 and the railroad tracks make it very difficult
for residential use. The subject property also lies in Weld County's state mandated Enterprise Zone which
encourages business just as this one (SEE REFERRAL LETTER).
As you can see, this Application is very much compatible with the surrounding area and will have minimal
impact on the area.
4. In regards to the Fort Lupton referral letter, I would like to comment on that they are not asking for
denial in this Application. They have asked for you to scrutinize the urban growth in a non-urban area. I
attended the meeting, as well as did Mike Whistance. The Board voted on this and it was Brian Grubb's
referral to deny the Application. Board Members voted to not deny the Application. (MINUTES FROM
MEETING).
5. The Applicants have been a great asset to the Fort Lupton and surrounding area for years. They are
the first to help with the schools, 4-H programs, or whatever is needed. As you can see, they have great
support from the community(Chamber of Commerce), as well as neighbors of surrounding properties (See
Letters).
The Applicants are willing to meet the criteria and specifics in order to comply with Weld County's
requirements prior to recording the plat. I hope you will find that this is a first class operation and will be an
asset, not a detriment to Weld County.

program, the Ft. Lupton EL map and the state EZ Certification form (DR 0074). I apologize for
the delay in getting this information to you. For companies located within the physical
boundaries of the EZ, such as your proposed new location at 13030 WCR 20 (south side of
CR 20 and east side of Hwy. 85), there are a variety of state tax credits available, depending
_ upon the company's specific activity. The enclosed information summarizes these credits.

A. USR - 1457 - A Site Specific Development Plan and Special Review Permit for a business permitted
as a use by right in the commercial zone district (vehicle sales and detailing establishment) in the A
(Agricultural) Zone District The applicant is Country Truck and Auto LI C do Mike Whistance and Tony
Dowdy. The property is located at the southeast corner of Weld County Road 20 and Highway 85.
Tammy Ellerman of On- Land Company and Mike Whistance of Country Truck and Auto were present to
answer questions about the application. Mr. Reynolds asked if they had read the staff report. The applicant
affirmed that they had.

Discussion lollowed regarding the amount of nght-of-way necessary for Weld County Road 20 and the
discrepancy on the plans The applicant indicated that it was their intent to dedicate 30 feet of right-of-way for
Weld County Road 20
Ms. Reynolds expressed a concern about traffic and safety on Highway 85. There was discussion about the
Highway 85 Access Plan and the need for accel/decel lanes and left hand funning lanes.

Bruce Davis shared some of the same concerns; however he would prefer to expand the city limits and prefers
- this use to a gravel pit. Mr. Davis recommended that we support the proposal. John Dent, representing the
Fort Lupton Development Corporation spoke in support of the application.
There was discussion about the draft letter included in the packet. Mr. Grubb offered a compromise on the
- language in item#1. He recommended that the last sentence be modified as follows:

It is the opinion of the Fort Lupton Planning Commission that the proposed development is may be urban in
nature and therefore the Use by Special Review should be denied scrutinized for compliance with the ICA.
More discussion followed The consensus was that the letter should be sent to the County with the proposed
change
Bruce Davis moved to send the letter to the County with the proposed changes to the language. Tracey
Reynolds seconded the motion. I he motion passed on a voice vote with no objections

A. 2004 Planning Commission Handbooks — Updates and additions as 'requested at the December
2003 meeting, Mr. Grubb handed distributed the resolutions and AM's that were requested by the Mayor at the
December meeting.
B. Recent Land Use Actions by Weld County- Helt Gravel Pit and Aggregate Industries.
Mr Norcross provided the Commission with an update on the actions taken regarding recent County Land Use
- applications. The applications discussed were Adams Sand And Gravel, Heil Sand and Gravel. Hunt Brothers
rezoning and Etranrucci rezoning
C. Minutes From September 23, 2003
Mr Grubb asked for input and notes from the commission regarding the September 23'd 2003 meeting. Mr.
Norcross noted that he was the only "no" vote. 'he Commission recommended approval and concurred with
the staff report of the application but did not make a recommendation regarding the fee reductions.

Dear Ms. Hatch:
On February II, 2004, the I;oard of Directors of the Fort Lupton Chamber of Commerce
held its regular meeting.
It was brought to our attention that Country Truck and Auto were denied a change in
zoning at I Iwy 85 ,@ Rd 20.
I'he Board of Directors is requesting that you reconsider their request. Country Truck and
Auto are reputable members of our community and have outgrown their present facility.
We are aware of the disapproval of the City of Fort Lupton Planning Commission and
even though we somewhat agree with some of their concerns, we feel that commercial
growth along the I lighway 85 Corridor is inevitable and to deny it because of some bad
decisions in the pass sends a "no growth" message. Commercial and industrial growth
creates a much needed tax base, therefore providing monies for roads and infrastructure.
We feel that comparing this development to the (Formby/LaMarvilla)experience has
nothing to do with this proposal. Please give this proposal reconsideration.
