RE: CONSERVATION TRUST FUNDS TO TOWN OF NUNN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado Statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, Weld County, as an eligible entity for distribution of
Conservation Trust Fund Lottery monies received $194,698.07 from the State of
Colorado in 1983, and
WHEREAS, the Town of Nunn was a non-participating Conservation Trust Fund
entity, therefore, their share of $1,598. 13 of the lottery distribution was
included in the unincorporated County share of Weld County's amount, and
WHEREAS, the Town of Nunn has requested the County give the Town of Nunn
their share of $1 ,598. 13, and
WHEREAS, §29-21-101 CRS, 1973 provides that in the utilization of monies
received pursuant to §29-21-101 CRS, 1973, each eligible entity may cooperate
or contract with any other government or political subdivision, and
WHEREAS, the funds from the Conservation Trust Fund must be expended only
for the acquisition, development, and maintenance of new conservation sites or
for capital improvements or maintenance for recreational purposes on any
public site, and
WHEREAS, Weld County must report the use of all lottery funds and certify
that the funds were properly used in accordance with State statute, and
WHEREAS, the Board of County Commissioners desires to give the Town of
Nunn their share of the lottery funds ($1,598. 13) providing they comply with
all the conditions of the State law and enter into a letter of assurance
indicating that they have complied and indicating the use of the funds for
reporting purposes.
NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of
Weld County, Colorado hereby authorize the payment of the Town of Nunn's share
of the 1983 lottery funds from the Conservation Trust Fund in the amount of
$1,598. 13 providing the attached letter of assurance is received from the Town
of Nunn prior to the disbursement of funds.

adopted by the following vote on the 26th day of September, A.D. , 1983.

Dear Board of County Commissioners:
The Town of Nunn assures Weld County that the Conservation Trust Fund monies
in the amount of $1,598. 13 will be spent in accordance with §29-21-101 , CRS,
1973, and all other applicable State laws. The Town of Nunn will report the
use of the funds to Weld County in order for Weld County to certify to the
State Department of Local Government how the funds were utilized.
The Town of Nunn further agrees that if the State of Colorado determines that
any of the funds granted to the Town of Nunn (1,598. 13) were not properly used
by the Town of Nunn, that the Town of Nunn will repay Weld County any
Conservation Trust Fund monies determined unallowable by the State up to the
amount of $1,598. 13.
