SUBJECT: Suggested revisions to USR-1469 Staff Recommendation
Should the Planning Commission approve this application, the Department of Planning
Services recommends that the following condition of approval be added as Condition 2.K:
The applicant shall enter into a Private Improvements Agreement according to policy regarding
collateral for improvements and post adequate collateral for all landscaping,transportation (access
drive, parking areas, etcetera) and non-transportation (plant materials, fencing, screening, water,
signage etcetera). The agreement and form of collateral shall be reviewed by County Staff and
accepted by the Board of County Commissioners prior to recording the USR plat. Or the applicant
may submit evidence that all the work has been completed and reviewed by the Department of
Planning Services and the Department of Public Work. (Department of Planning Services)

and become injured....

families and homes and retail establishments to the town, but changing zoning,

RE: Special Review Permit Use for Industrial Zone District in the A
(Agricultural Zone District).
To: Chris Gathman, Planner,
I (we) have very serious concerns and objections about the Special
Review Permit for Lot B of RE-1621; Pt T2N, R68W of the 6th P.M., Weld
County, Colorado. The towns of Frederick and Firestone Planning and
Zoning officer is also oppose to the Special Review Permit for the same
reasons.
The surrounding homeowners and the Planning and Zoning office of
Frederick, CO gave the following reasons objecting to the Special
Review Permit:
* There is a new public elementary school just two blocks west of
the said property. If more commercial/industrial vehicles
frequent this two lane road, then the safety of parents and
their children would be compromised.
* Currently, the semi trucks being used to transport heavy
equipment to and from this property have to make
big swings in and out of the said property. Because of this
condition, potential road hazards for all people traveling on
the narrow road has greatly increased.
* There are several bus stops in the immediate area of the said
property.
* Currently, the towns of Frederick and Firestone are establishing

new residential home sites in this area.
*Currently, this property is not being used as a residential property,
but rather business trucks, semi trucks and big
commercial/industrial vehicles frequent the property at all
hours of any given day or night. Even at 4:30 am semi trucks
make loud noises, waking up children and create air
pollution that enters our homes through our windows. This is
a serious health concern for all of the surrounding home
owners.
* Mixing a residential community and a commercial business in the
same location is a recipe for potential problems.
Because of the way in which the said property has been used by the new
owners, and the fact that the new owners received two zone violations
since they took position of this property, we the surrounding community
members feel that a Special Review Request Permit would only promote
health safety concerns and traffic issues for all those living near by.
Just 1.3 miles west of the said property is the east 1-25 frontage road that
is zoned for commercial/industrial use. This area would be best suited for
the kind of commercial use that we are now experiencing on a daily
bases at the said property.
If this permit is granted, please require that the following health and
safety rules be enforced upon the said property and company owners:
1) Hours of operation (8 am to 5 pm).
2) Erect a non-see-through 6 foot safety fence on the entire
length of North, East and West property lines of the said
property .
3) No semi and business vehicles allowed to run at idle from
12 am to 8 am and 5 pm to 12 midnight 4o avoid vehicle
fumes.
4) No construction or repair work on equipment and vehicles.
5) Two clearly labeled road signs (on the East and West side
of said property) that indicate heavy road side traffic in
and of the said property.
6) A noise level restriction be put in place for both equipment
and vehicles between 7 am to 5 pm and no business
noise between 5 pm and 7 am
7) Slower speed limit signs on road 18 (from now 45 mph to
35 mph) to avoid potential traffic and safety hazards.
Our hope is that you do not grant this permit to the said property owners.
Attached to this letter is a petition representing the surrounding home
owners opposing this special review permit..
