RE: APPROVAL OF RECORDED EXEMPTION NO. 532. EVERGREEN AVIATION, INC.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Commis-
sioners at a public meeting held on the 3rd of February, 1982
in the Chambers of the Board, that the division into two parcels
of land, as shown on the plat known as Recorded Exemption 532 ,
being the property of Evergreen Aviation, Inc. , described as part
of the Southeast quarter of Section 3, Township 5 North, Range 65
West of the 6th P.M. , Weld County, Colorado does not come within
the purview of the definition of the terms, "subdivision" and
"subdivisided land" , pursuant to its authority under Section 30-
28-101 (10) (d) , CRS 1973, as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms "subdivision" and
"subdivided land" conditional upon the following:
1. A total of 75 feet from the centerline of Colorado
State Highway 263 to the subject property be dedicated
to accomodate the projected flow of traffic
2. The construction of a new access or the reconstruction
of an existing access to a state highway requires an
Access Approach Permit
3. Any improvements on the subject site shall conform with
the height restrictions of the Airport Overlay District
The above and foregoing resolution was, on motion duly made
and seconded, adopted by the following vote on the 3rd day of
February, A.D. , 1982.

Re: Recorded Exemption 532
Dear Commissioners:
The attached application, plat and related items are in reference to a
request by Evergreen Aviation, Inc. for a recorded exemption. The parcel
of land under consideration is described as part of the SE's, Section 3,
T5N, R65W of the 6th P.M. , Weld County, Colorado. This property is
located approximately one and one-half miles east of the city of Greeley,
lying north of and adjacent to Colorado State Highway 263. The property
contains 62.138 acres, more or less, of agricultural land in an "I-3"
(Industrial) zoned district. The existing improvements are on the proposed /
50.138 acres, more or less, parcel designated as Lot "B". The CZL138 acres,W=%:1 ,

more or less, will continue to be owned by the Evergreen Aviation, Inc.
The Evergreen Aviation, Inc. wishes to use the 12.00 acres, more or less,
designated as Lot "A" for servicing their helicopter operation.
Based upon the information submitted in the adopted policies in the County,
the Department of Planning Services staff recommends this request be approved
for the following reasons:
1. The request complies with the submission requirements of
Section 9-2 C. of the Weld County Subdivision Regulations.
2. The request complies with Section 9-2 E. of the Weld County
Subdivision Regulations as follows: the 62.138 acres, more or
less, under consideration is zoned "I-3" and the use proposed
is compatible with that zone district. The subject site is
presently being farmed. The use will be compatible with the
surrounding industrial uses.
These facts support the proposal as being consistent with
the intent clause of the Industrial "3" Zone District.
The proposed use being compatible with existing and
surrounding land uses; the proposed use not being
inconsistent with efficient and orderly developments;

the proposal being in compliance with Section 1-3 of
the Weld County Subdivision Regulations; and the proposed
land division complying with the Weld County Comprehen-
sive plan.
- A letter from the North Weld County Water District dated
December 29, 1981, indicates the proposal will have an
adequate water supply.
- State Highway 263 will serve as the public road for
this proposal.
A letter from the Weld County Health Department dated
January 8, 1982, indicates the sewage disposal system
is adequate.
- The proposal does exist in the Airport Overlay District.
The proposed parcels are not part of a recorded exemption
within the last five (5) years.
- The proposed parcel meets the minimum size requirements
for land divisions.
The recommendation of approval from the Department of Planning Services
staff is contingent upon the following conditions:
1. A total of seventy-five (75) feet from the centerline of Colorado
State Highway 263 to the subject property be dedicated to accomo-
date the projected flow of traffic;
2. The construction of a new access or the reconstruction of an
existing access to a state highway requires an Access Approach
Permit;
3. Any improvements on the suject site shall conform with the
height restrictions of the Airport Overlay District.

SUMMARY STATEMENT
APPLICATION FOR RECORDED EXEMPTION
This Recorded Exemption is being requested by Evergreen Aviation, Inc. ,
owners. This national company purchased this farm in 1980 for the purposes
of building a facility on five acres for helicopter servicing. Since
that time, Evergreen has leased existing improvements located at Weld
County Airport that meet their existing needs. Subsequently, Evergreen
has entered into a contract for the purchase of the subject property with
a private developer. The intended use will be an air transportation
related industrial park. The first phase of the purchase involves the
subject twelve acre parcel.
The property is presently zoned industrial. The future development into
an air-industrial park would seem natural. The first phase is intended
to make adequate land available should there be demand over the next
12 months. Actual subdividing of the entire 62 acre farm is not appropriate
at this time. Exact users and required parcel size cannot be determined
prior to these users actually entering the marketplace. It is anticipated
that the farm would continue to be farmed as sequential development occurs
over the next several years. Continual expansion of the airport will bring
with it, ancillary development and support services.
