210 RESOLUTION RE: APPROVE VACATION OF SPECIAL REVIEW PERMIT#878-DANIEL OCHSNER AND BARRY PAYANT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated July 11, 1990, the Board did approve Special Review Permit#878 fora a Recreational Facility in the A(Agricultural)Zone District for Daniel Ochsner and Barry Payant, 18905 Weld County Road 394,LaSalle,Colorado 80645,on the following described real estate, to-wit: Part of the NE1/4, Section 31, part of the SE 1/4, Section 30,and part of the SW 1/4, Section 29, all in Township 5 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS,the Board has received a request from Jacqueline Johnson,Attorney for Daniel Ochsner, to vacate said Special Review Permit#878, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present,studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and,having been fully informed, deems it advisable to approve said vacation. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Special Review Permit#878 be, and hereby is, vacated. The above and foregoing Resolution was,on motion duly made and seconded,adopted by the following vote on the 21st day of April, A.D., 2004. Ochsner Dear Ms. Mika: We represent Daniel L. Ochsner in the above referenced Recorded Exemption application. On his behalf, we hereby request that USR 878 be vacated, and that the application for RE-3502 be processed by your department. I am enclosing a copy of the recorded Warranty Deed from the Brantners to Mr. Ochsner for the triangular piece of property which will be included in Lot B of RE-3502. I am also enclosing an unexecuted Quit Claim Deed deeding that piece into Lot B of RE-1335. Please advise me if this is satisfactory to you, and if so, Mr. Ochsner will execute the Quit Claim Deed and record it. It is my understanding that your department will take the necessary steps to identify Mr. Ochsner's home on Lot B of RE-3502 as a nonconforming structure.
