HomeMy WebLinkAbout20040357.tiff HEARING CERTIFICATION DOCKET NO. 2004-17 RE: SHOW CAUSE HEARING CONCERNING AMENDED USE BY SPECIAL REVIEW PERMIT #673 FOR A DOG KENNEL (MAXIMUM OF 16 DOGS) IN THE A(AGRICULTURAL) ZONE DISTRICT - CATHERINE CARIASO A public hearing was conducted on February 18, 2004, at 10:00 a.m., with the following present: Commissioner Robert D. Masden, Chair Commissioner William H. Jerke, Pro-Tem Commissioner M. J. Geile Commissioner David E. Long - EXCUSED Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Chris Gathman Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated January 30, 2004, and duly published February 5, 2004, in the South Weld Sun, a Show Cause Hearing was conducted to consider revocation of Amended Use by Special Review Permit #673 for a Dog Kennel (maximum of 16 dogs) in the A(Agricultural)Zone District issued to Catherine Cariaso. Lee Morrison,Assistant County Attorney, made this a matter of record. Chris Gathman, Department of Planning Services, stated the Departments of Planning Services and Public Health and Environment and Animal Control recommend continuing the matter to June 16,2004,at 10:00 a.m. He stated during the interim Ms. Cariaso would be required to do one of the following: 1)Remove the kennel operation;2)downsize the kennel operation to no more than 16 dogs;or 3)Apply for an amended Use by Special Review Permit to increase the number of dogs allowed in the facility. Theodore Schrage, surrounding property owner, stated the respondent has too many dogs, they have had conflicts with her horses destroying the fence,and her dogs chase his cows. He stated this is not an appropriate location fora kennel because the barking is unbearable for area residents. Mr.Schrage stated the Conditions of Approval require that the dogs be debarked;however,this has never been done. He stated this area is experiencing rapid growth;there are five new homes being built; and one new residence is ready for occupancy. He stated he has owned land on two sides of the site for more than 35 years,and he expressed concern regarding health and odor. He further stated the respondent does not care for the dogs appropriately. Dean Hanes,surrounding property owner,stated dogs should be quite from 10:00 p.m.to 7:00 a.m.; however, Ms.Cariaso does not control the barking,which is continuous throughout the day. There being no further comments,Chair Masden closed public testimony. (Switched to Tape#2004-09.) 2004-0357 PL0434 HEARING CERTIFICATION - CATHERINE CARIASO (AMUSR #673) PAGE 2 Commissioner Jerke stated based on the terrible conditions, he is not in favor of continuing this matter until June,and a shorterterm is preferable. Commissioner Geile concurred and suggested a two-week continuance. Commissioner Jerke moved to continue the Show Cause Hearing to Wednesday, March 3, 2004. Commissioner Geile seconded the motion, which carried unanimously. There being no further discussion, the hearing was completed at 11:45 a.m. This Certification was approved on the 23rd day of February 2004.
