The Weld County Health Department has reviewed this proposal. The applicant proposes a 9-
lot minor subdivision on 104.4 acres. The minimum proposed lot size of 10.08 acres coupled
with an overall density of one septic system per 11.6 acres meets current Department policy.
The application has not satisfied Chapter 24 of the Weld County Code in regard to water
service. The application materials indicate that North Weld County Water District will serve the
development. We have not received a "will serve" letter from the District. A "draft" water service
agreement was provided, however, the agreement has not yet been executed.
The application has satisfied Chapter 24 of the Weld County Code in regard to sewer service.
Sewage disposal will be provided by individual sewage disposal systems. Because of the large
lot sizes, the Department does not require the applicant to designate any septic system
envelopes on the proposed lots. However, it should be noted that according to the geologic
report conducted by Thomas W. Finely, dated December 9, 2003, seepage onto lots 1 thru 6
may be an issue when the lateral is flowing water. The report also states that some of the
systems may be required to be designed by an engineer. However, given the proposed lot
sizes, adequate area should be available to accommodate these scenarios. In the future, the
Box Elder Sanitation District may make sanitary sewer service available in the vicinity of this
development. Per a February 26, 2004, letter from the District, sanitary sewer service does not
appear to be feasible for this development in the near future
The Department recommends approval with the following conditions:
1. Water service shall be obtained from North Weld County Water District.
2. Sewage disposal shall be by septic systems designed in accordance with the
guidelines of the Colorado Department of Public Health and Environment, Water
Quality Control Division and the Weld County Code (WCC) in effect at the time of
construction, repair, replacement,or modification of the system. Each septic system
shall be designed for site-specific conditions, including but not limited to maximum
seasonal high groundwater, poor soils, and shall bedrock. Additionally, all systems
must meet all setbacks as outlined in the WCC.
3. If required, the applicant shall obtain a storm water discharge permit from the Water
Quality Control Division of the Colorado Department of Public Health and the
Environment. Silt fences shall be maintained on the down gradient portion of the site
during all parts of the construction phase of the project.
4. During development of the site, all land disturbances shall be conducted so that
nuisance conditions are not created. If dust emissions create nuisance conditions,at
the request of the Weld County Health Department, a fugitive dust control plan must
be submitted.

5. In accordance with the Regulations of the Colorado Air Quality Control Commission
any development that disturbs more than 5 acres of land must incorporate all
available and practical methods that are technologically feasible and economically
reasonable in order to minimize dust emissions.
6. If land development creates more than a 25-acre contiguous disturbance,or exceeds
6 months in duration, the responsible party shall prepare a fugitive dust control plan,
submit an air pollution emissions notice, and apply for a permit from the Colorado
Department of Public Health and Environment.
7. "Weld County's Right to Farm" as provided in Appendix 22-E of the Weld County
Code shall be placed on any recorded plat.

Weld County Public Works Department has reviewed this change of zone request. Comments made during this phase
of the subdivision process may not be all-inclusive, as other concerns or issues may arise during the remaining
application process.
Comments
External Roadways:
❑ CR 84 is classified by the County as a local road and requires a 60-foot right-of-way. The applicant shall verify the existing right-
of-way and the documents creating the right-of-way shall be noted on the change of zone plat. If the right-of-way cannot be
verified, it will be dedicated on the final plat.
❑ CR 84 is graveled and maintained by the County. The latest County traffic count is shown as 119 adt. This development will
introduce approximately 86 vehicle trips to the roadway system. This increased level of traffic on unpaved roads creates fugitive
dust and surface maintenance problems. The applicant will be asked to enter into an agreement with the County to
proportionately share the cost of improvements. The cost will be based on a proportion of the traffic generated by the proposed
development to existing traffic. The applicant must submit a proposed agreement with the final plan application. This stretch of
roadway is scheduled into the 2004 County Gravel Plan.
❑ Based on the proposal of limited development and apparent low traffic impact,a traffic study is not currently required.
Internal Roadways:
❑ Stop signs and street name sign locations must be shown on the final roadway construction plans.
❑ Intersection sight distance triangles at the development entrance will be required. All landscaping within the triangles must be
less than 3'h feet in height at maturity,and noted on the final roadway plans.
❑ The applicant shall submit to Public Works stamped,signed and dated final plat drawings and roadway/construction&grading
plan drawings for review (with the final application). Construction details must be included. This is consistent with County
Code: Sec. 24-3-50, "The minor subdivision final plat submitted shall contain the original signatures and seals of all parties
required."
❑ The applicant shall submit Improvements Agreements According to Policy Regarding Collateral For Improvements with the final
plan application. These agreements must be reviewed by Public Works and shall be approved by the BOCC prior to recording the
final plat.
Drainage:
❑ The Minor Subdivision Sketch Plan Drainage Report for Prairie Ridge Estates, dated December 9, 2003,by TEAM Engineering,
Jeffrey W.Couch,P.E.is acceptable.
❑ A final drainage report stamped, signed and dated by a professional engineer licensed in the State of Colorado shall be submitted
with the final plan application. The 5-year storm and 100-year storm drainage studies shall take into consideration off-site flows
both entering and leaving the development. Increased runoff due to development will require detention of the 100-year storm
developed condition while releasing the 5-year storm existing condition.

❑ The final drainage report shall incl. a flood hazard review documenting any FE.,--+ defined floodways. The engineer shall
reference the specific map panel number,including date. The development site shall be located on the copy of the FEMA map.
❑ The applicant shall prepare a construction detail for typical lot grading with respect to drainage for the final application. Front,
rear and side slopes around building envelopes must be addressed. In addition, drainage for rear and side lot line swales shall be
considered. Building envelopes must be planned to avoid storm water flows, while taking into account adjacent drainage
mitigation. This is important since Cactus Hill Ditch is located on the uphill side of the proposed development.
❑ The applicant has addressed the irrigation ditch right-of-way and/or easement on the change of zone plat. But the applicant needs
to submit a letter of confirmation from the ditch owner with-respect-to this easement.
❑ Final drainage construction and erosion control plans (conforming to the drainage report) stamped, signed and dated by a
professional engineer licensed in the State of Colorado shall be submitted with the final plan application.
Recommendation
❑ The Public Works Department recommends approval of this change of zone.
The applicant shall address the comments listed above at the specific step of the review process stated. The review
process will continue only when all appropriate elements have been submitted. Issues of concern must be resolved
with the Public Works Department prior to recording the change of zone and final plats.

The following comments are applicable to this proposal:
In accordance with the 97 LCLUC 8.1.4c, Other Standards, the Poudre Fire Authority
will enforce the 97 Uniform Fire Code along with its accompanying local ordinances as
follows:
CUL-DE-SAC:
A dead-end street cannot exceed six-hundred-sixty (660) feet in length. The turn-around
at the end of the street must have an outside turning radius of fifty (50) feet or more, and
an inside turning radius of twenty-five (25) feet. Short fire lanes are permitted to facilitate
a second point of access when a street is greater then 660 feet. All structures beyond the
660 feet limit must be fire sprinklered if a second point of access cannot be provided.
SPRINKLER REQUIREMENTS:
When any portion of the facility or any portion of an exterior wall of the first story of the
building is located more then 150 feet from fire apparatus access as measured by an
approved route around the exterior of the building or facility it shall be fire sprinklered.

No Residential building can be greater then 400 feet from a fire hydrant.
Fire hydrants are required with a maximum spacing of 800 feet along an approved
roadway. Each hydrant must be capable of delivering 500 gallons of water per minute at a

Dear Ms. Lockman:
We have reviewed additional information submitted to this office on April 16,
2004 on the above referenced proposal to subdivide a 104.38-acre parcel into 9 single-
, — family residential lots of approximately 10 acres in size. Although we have not received
a formal request by the county to review this additional information, the State
Engineer's Office felt that it could respond to this additional information as this
information clarifies the previous submittals.
As mentioned in our previous letters dated January 5, 2004, March 22, 2004 and
April 6, 2004 the household water to the residential lots within the subdivision is to be
supplied by North Weld County Water District (District). Since a concern was raised
regarding the District's commitment to the subdivision, a Water Main Extension
Agreement from the District was provided to this office by the applicant's water
consultant, Mr. Jeff Couch from Team Engineering. Based on the information from the
Water Service Agreement, the District is able to serve the proposed 9 lots in the
subdivision per terms and conditions of the District. In addition, the District currently
supplies water to the existing residence on the property.
It is also indicated that the household use water requirements for the nine lots in
the proposed subdivision is 4860 gallons per day (0.60 acre-feet per year per lot or 5.44
acre-feet per year for the entire subdivision). We indicated in our previous letter dated
April 6, 2004 that the estimates of the water requirements appear to be high for the
uses identified. However according to the information in the Water Service Agreement
the District will furnish 70% of an acre-foot [228,000 gallons (0.69 acre-feet per year per
lot)] of water per tap per annual water year if the allotment for the Colorado-Big
Thompson (CBT) project water, as determined by the Northern Colorado Water
Conservancy District, is 50% or greater. The District will restrict the delivery as
necessary when the CBT allotment is less than 50%.

Pursuant to Section 30-28-136(1)(h)(II), C.R.S., the State Engineer's office offers
the opinion, that contingent upon water service being provided by the District, the
proposed water supply will not cause material injury to existing water rights and the
supply is expected to be adequate.

Dear Ms. Lockman:
We have reviewed the Water Supply Information Summary that was submitted to this
office on March 26, 2004 for the Prairie Ridge Estates Subdivision. It is indicated that the
household use water requirements for the nine lots in the proposed subdivision is 4860 gallons
per day (0.60 acre-feet per year per lot or 5.44 acre-feet per year for the entire subdivision).
The estimates of the water requirements appear to be high for the uses identified. We
recommend that the applicant explain the basis for using 180 gallons per day per person for
this subdivision. Typical water use estimates for inside use are in the range of 80-100 gallons
per day per person, rather than the 180 gallons per day per person used in this submittal.
In addition, a letter of commitment from the North Weld County Water District (District)
was supposed to be provided to this office. Since our concerns regarding the District's
commitment to the subdivision were not addressed, the comments from our previous letters
(copies enclosed) dated January 5, 2004 and March 22, 2004 are still in effect.

Dear Ms. Lockman:
We have reviewed the above referenced proposal to subdivide a 104.38-acre parcel described as
Lot B of the Recorded Exemption RE-1873, into 9 single-family residential lots of approximately 10 acres
in size. Eight of the proposed ots will_accommodate new structures and the ninth parcel would be created
to facilitate the existing farm residence.
The North Weld County Water District (District)has been proposed as the source of water and
the information from the referral material indicates that the District has agreed to serve the proposed site,
however no letter of commitment from the District was included. The District currently supplies water
service to the existing residence on the property. Based on current records on file in this office,the District
currently has an adequate uncommitted water supply to provide the water associated with this project,
however, this agency cannot render an opinion until a letter of commitment is received from the District.
Additionally, a "Water Supply Information Summary"form (copy enclosed)which was provided to
the county along with the State Engineer's August 7, 1995 letter was not included in the referral material.
As stated in the State Engineer's letter, this form is required to be submitted along with each subdivision in
order for this office to respond to the county.
Pursuant to Section 30-28-136(1)(h)(II), C.R.S., it is the State Engineer's opinion that sufficient
evidence was not submitted documenting that the proposed water supply can be provided without causing
injury to the existing water rights.

for this subdivision.

was supposed to be provided to this office. Still our concerns regarding the District's
commitment to the subdivision were not addressed.

Dear Ms. Lockman:
Pursuant to the State Engineer's Office Memorandum dated August 7, 1995, effective
August 31, 1995, this office will no longer respond to land use actions (lot line adjustments,
zone change request, special use land and division by exemption) that do not involve the
subdivision of land as defined in Section 30-28-101(10)(a) C.R.S. (see-attached memorandum).
The material submitted this time appears to be only for a change in zoning on the proposed
Prairie Ridge Estates.
Additionally, we have previously commented on the above-referenced proposal to
subdivide a 104.38-acre parcel into 9 single-family residential lots of approximately 10 acres in
size. Information from this referral material indicates that the North Weld County Water District
(District) is still listed as the water provider for the residential lots. The District has agreed to
serve the proposed site, however a letter of commitment from the District was not provided.
Additionally a Water Supply Information Summary Sheet was not included in the referral
material. Since our concerns regarding the District's commitment to the subdivision were not
addressed in this second submittal, the comments from our letter (copy enclosed) dated
January 5, 2004 are still in effect.

This memorandum is to inform you of procedural changes in providing "an opinion regarding
material injury likely to occur to decreed water rights by virtue of diversion of water
necessary or proposed to be-used to supply the proposed subdivision and the adequacy of the
proposed water supply to meet requirements of the proposed subdivision", as required under
section 30-28-136(h)(1), C.R.S. (1986 Repl, Vol.).
In June of 1992, HB92-1156, required that recommendations be made within 21 days after
the mailing by the county. No additional staff was allocated to implement this accelerated
review. I find that with the increased development activity in the state, my staff cannot
respond in a timely manner to all of the land use referrals we receive.
Therefore, in order to allow our timely comments on all SUBDIVISION OF LAND referrals
as mandated by section 30-28-136(h)(I) C.R.S., effective AUGUST 31, 1995, THIS
OFFICE WILL NO LONGER RESPOND TO LAND USE ACTIONS THAT DO NOT
r INVOLVE THE SUBDIVISION OF LAND AS DEFINED IN SECTION 30-28-101-
(10)(a) C.R.S. (1986 REPL. VOL.). These actions include but are not limited to lot line
adjustments, zone change requests, special use of land, and division by exemption. After
August 31, 1995, we will not respond to or maintain records on any referral we receive that
does not address the subdivision of land as defined in section 30-28-101(10)(a) C.R.S.
Enclosed is a "Water Supply Information Summary" form which as of August 31, 1995 we
will require to be submitted along with each subdivision referral in order for us to be able to
respond in a timely manner. I ask that you provide copies of this form to all future

I am attaching a copy of a letter sent to Mr.Carlson concerning items to be considered when
developing this parcel of land. As you can see the 15 foot easement is not in keeping with the
discussion I had with Mr. Carlson. The 25 foot easement is really necessary to allow for the
equipment used to maintain the ditch.
Another point to include in this development is the need to have`unrestricted' access along the ditch
for the purpose of operation and maintenance. This should be clearly spelled out to any potential
developers,builders,and homeowners. The natural tendency for this type of development and
resulting homeowner is to fence the property boundary. This would result in 6 or 7 fences along this
ditch greatly increasing the time and cost to North Poudre Irrigation Company of delivering water to
this HOA.
It should also be noted that the use of vinyl fencing is quite attractive it is very susceptible to damage
from fire in the near vicinity. A good example would be a fence of vinyl material placed too close to
the ditch where normal ditch burning would cause it to sag or even melt. The practice of burning
ditches to prepare for the season is a common activity.
The share of North Poudre Irrigation Company water should be in the name of the HOA and one
contact person should be designated as the contact person for placing and coordinating all orders for
water delivery. I would recommend that this be included in the covenants and/or the HOA bylaws.

Dear Mr.Carlson:
Thank you for asking for comments from the ditch company concerning your planned development.
After talking to you on the phone I wanted document our conversation in writing.
The following items were discussed:
• The covenants should reflect North Poudre Irrigation Company's prescriptive easement
along and on both sides of the Cactus Hill Ditch. The width of this easement is typically 25
feet to allow normal operation and maintenance of the ditch.
• Lots 1 through 6 cannot fence across the ditch easement or in any way impede the access of
North Poudre Irrigation Company to their easement. I would suggest that this be made part
of the covenants for these parcels.
• Any water shares in North Poudre Irrigation Company should be in the name of the
homeowner association as single shares cannot be split. With this in mind water ordered for
delivery will need to be made through a designated contact person. It should also be noted
that one share of North Poudre water will not provide sufficient water to more than an
average of two acres.
• Water will be usually be available to rent or shares are available to purchase.

1. Building permits shall be obtained prior to the construction of any building. Building permits are
required for the principle dwelling and for buildings accessory to the principle dwelling.
2. A plan review is required for each building. Two complete sets of plans are required when applying
for each permit.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of
permit application. Current adopted codes include the 2003 International Building Code; 2003
International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code;
2002 National Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical report or an
open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be
designed by a Colorado registered engineer.
5. Fire resistance of walls and openings, construction requirements, maximum building height and
allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined
by the Zoning Ordinance.
6. Building height shall be measured in accordance with the 2003 International Building Code for the
purpose of determining the maximum building size and height for various uses and types of construction
and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code.

The sheriffs office recommends the following improvements for this housing sub-
division:
1. The sheriff's office requests that builders and developers designate an area by
the entrance of the sub-division in which to place a shelter for school children
awaiting the school bus. This area should also include a pull off for the school
bus which enables it to safely load and unload children out of the roadway in
the event the bus is unable to drive down the street due to road conditions.
2. Either a mail distribution within the sub-division or a central drop off location
within the sub-division should be developed so that residents do not have to
cross a county roadway to obtain their mail.
3. The name of the street and address numbers within the sub-division should be
presented to the sheriffs office for approval. This will eliminate duplication
of street names within the county.
4. A permanent sign should be placed at the entrances to the sub-division
detailing the name of the sub-division, and address. There should be a plan
developed to maintain this sign. Individual addresses also need to be clearly
visible for each residential site.
5. If the roadways within this sub-division are not maintained or adopted by the
county, individuals purchasing property in this sub-division should be notified
that the sheriff's office will have limited traffic enforcement powers.
6. A plan should be developed to maintain roadways within the sub-division
especially during inclement weather conditions for emergency vehicles.
7. The sheriff's office is very supportive of homeowner funded homeowners
associations. These associations provide a contact for the sheriffs office and
�-. a means for maintaining common areas.
8. If there is an oil or gas well within this sub-division. This needs to be fenced
off in order to mitigate the potential for tampering. These facilities are known
to create an attractive nuisance for young people. Tampering not only creates
a significant danger to safety but also of environmental damage with extensive
mitigation and clean-up costs.
9. Any bodies of water in this subdivision should be fenced to restrict access for
safety of the residents.
The Sheriff's Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.
