RESOLUTION
RE: APPROVE VACATION OF CONDITIONAL USE PERMIT, CUP #9 - REGENT
BROADCASTING OF FORT COLLINS, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated March 12, 1975, the Board did approve Conditional Use
Permit, CUP #9, for the construction of a radio communications tower for Joseph J. Tenneson,
President of Colorado R. G., Inc., on the following described real estate, to-wit:
Part of the W1/2 of the SE1/4 of Section 19,
Township 8 North, Range 66 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, the Board has received a request from Regent Broadcasting of Fort Collins,
Inc., current operator, to vacate said Conditional Use Permit, CUP #9, and
WHEREAS, at a hearing on April 4, 2004, the Board of County Commissioners deemed it
advisable to continue said matter to April 19, 2004, then to May 19, 2004, and
WHEREAS, at said hearing on May 19, 2004, the Board of County Commissioners heard
all of the testimony and statements of those present, studied the request of the applicant and the
recommendations of the Department of Planning Services staff and all of the exhibits and evidence
presented in this matter and, having been fully informed, deems it advisable to approve said
vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Conditional Use Permit, CUP #9, be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 19th day of May, A.D., 2004.

SUBJECT: Vacation of CUP-9
The Department of Planning Services has received the attached letter from David J. Remund,
Vice-President of Regent Broadcasting of Fort Collins, Inc. Mr. Remund is requesting that CUP-
9 be vacated since the Tower on the site is now permitted under USR-1457.
Background information:
Legal Description: Part of the Section 19, T8N, R66W of the 6TH P.M., Weld County, Colorado
Location: IA mile west of County Road 27 and 74 feet north of County Road 90
CUP-9: CUP-9 was for a radio transmission tower
Regent Broadcasting of Fort Collins, Inc recently applied for USR-1457. The Department of
Planning Services required the vacation of CUP-9 as a condition of approval. This request for
vacation of CUP-9 is to satisfy the Department of Planning Services' condition.

I just found out that the final building permit for the Tower is not going to be done for 2 more weeks. We can't
vacate the CUP till the building permit is done and the USR plat is recorded. Can you move this from April 19 to
May 19th. I am sorry I sent this over so early.
