RE: APPROVE CONDITION OF APPROVAL #1.E FOR RESUBDIVISION, RS #1064, FOR
LOT LINE ADJUSTMENT ONLY -JASON AND JULIE ROTHE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on October 11, 2004, the Board of County Commissioners approved the
application of Jason and Julie Rothe,596 North 66th Avenue,Greeley,Colorado 80634,c/o Thomas
Survey Services, 2619 West 11th Street Road, Suite 24, Greeley, Colorado 80634, for
Resubdivision, RS#1064,for a Lot Line Adjustment only,on the following described real estate,to-
wit:
Lots 6 and 7,JB Acres; being part of the S1/2 SW 1/4

of Section 33, Township 6 North, Range 66 West of
the 6th P.M., Weld County, Colorado
WHEREAS, the applicant, Jason Rothe, was present at said hearing, and
WHEREAS, Condition of Approval #1.E was approved, to read as follows:
"The plat shall include all existing utility easements
along with a minimum ten (10) foot utility easement
on the south property line of Lot 7."
WHEREAS, after reviewing the recommendation of the Utility Board, staff requested
amendment of Condition of Approval #1.E to read as follows:
"The plat shall include all existing utility easements
along with a minimum ten (10) foot utility easement
divided equally between Lots 7 and 6."
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that Condition of Approval#1.E for Resubdivision fora Lot Line Adjustment Only,
RS #1064, on the hereinabove described parcel of land be, and hereby is, amended as follows:
"The plat shall include all existing utility easements
along with a minimum ten (10) foot utility easement
divided equally between Lots 7 and 6."
BE IT FURTHER RESOLVED that all other Conditions of Approval included in Resolution
#2004-3019, approved on October 11, 2004, remain in full force and effect.

The applicants for RS-1064, Jason and Julie Rothe have been approved by the Board of County
Commissioners on October 11, 2004 for a Resubdivision for a lot line change between Lots 6
and 7 in JB Acres. The Department of Planning Services is requesting that item number 1.E be
changed to reflect the intention of the Utility Board.

THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS
REQUEST BE APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section
24-5-30.6 of the Weld County Code.
2. It is the opinion of the Department of Planning Services' Staff that the application has
shown compliance with Section 24-4-30.C of the Weld County Code, as follows:
A. Section 24-5-30.C.4 -- That the lot line revision complies with the approved
recorded final plat. The lot line revision is to change the acreages between the
existing Lot 6 and Lot 7 of JB Acres while also including a parcel of land located
to north of the Lot 7. Lot 6 is currently approximately 2.36 acres and will increase
to be a total of approximately 3.68 acres. Lot 7 is currently 3.19 acres and will
decrease to be a total of approximately 1.79 acres.
B. Section 24-4-30.C.4 -- Compliance with the adopted rules, regulations and
ordinances currently in force and affecting the subdivision. There is an existing
20' utility easement running along the rear lot lines of both Lot 6 and Lot 7. An
existing 5' utility easement runs along the east property line of Lot 6. The Utility
Board requested that the applicant provide a 10' utility easement along the

southern lot line of Lot 7. The applicants will be required to obtain sign-off from
the utility providers prior to recording the plat.
This recommendation is based, in part, upon a review of the application materials submitted by
the applicant, other relevant information regarding the request, and responses from referral
agencies.
The Department of Planning Services' Staff recommendation for approval is conditional upon
the following:
1. Prior to Recording Resubdivision Plat:
A. All pages of the plat shall be labeled RS-1064. (Department of Planning

B. All septic systems must be on the appropriate lot. Prior to recording the plat the
Weld County Department of Public Health and Environment recommends that
the applicant review the Weld County Code pertaining to septic systems to
assure that any installed septic system will comply with all setback requirements
found in the Code. (Department of Public Health and Environment)
C. The applicant shall submit to the Weld County Department of Planning Services
evidence that any existing septic system meets all requirements of the Weld
County Department of Public Health and Environment. The Weld County
Department of Public Health and Environment was unable to locate a septic
permit for the septic system located at 595 North 66th Ave. Any existing septic
system which is currently not permitted through the Weld County Department of
Public Health and Environment will require an I.S.D.S. evaluation prior to the
issuance of the required septic permits. In the event the system is found to be
inadequate, the system must be brought into compliance with current I.S.D.S.
regulations. (Department of Public Health and Environment)
D. The applicants shall obtain sign-off from the utility providers prior to recording the
plat. The utility name and signature shall be on the plat. (Department of

E. The plat shall include all existing utility easements along with a minimum ten (10)
foot utility easement on the south property line of Lot 7 divided equally between
Lot 7 and Lot 6. (Department of Planning Services & Utility Board)
F. The plat shall be amended so Parcel A is labeled Lot 6 and Parcel B is labeled
Lot 7. (Department of Planning Services)
G. The following notes shall be placed on the plat:
1. Should noxious weeds exist on the property or become established as a
result of the proposed development the applicant/landowner shall be
responsible for controlling the noxious weeds, pursuant to Chapter 15,
Articles I and II of the Weld County Code. (Department of Public Works)

2. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the
Weld County Department of Planning Services.
3. The applicant shall submit a digital file of all drawings associated with the Resubdivision
application. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation);
acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export
files format type is .e00. The preferred format for Images is .tif (Group 4). (Group 6 is
not acceptable). (Department of Planning Services)
4. Upon completion of items #1 and #2 above the applicant shall submit a Mylar plat along
with all other documentation required as Conditions of Approval. The Mylar plat shall be
recorded in the office of the Weld County Clerk and Recorder by Department of Planning
Services' Staff. The plat shall be prepared in accordance with the requirements of
Section 24-4-40.D.6 through D.9 of the Weld County Code. The Mylar plat and
additional requirements shall be submitted within sixty (60) days from the date of the
Board of County Commissioners resolution. The applicant shall be responsible for
paying the recording fee.
