RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST FRANCISCO GALLEGOS AND BETTY ROSALEZ FOR VIOLATION
OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Francisco Gallegos and Betty Rosalez,VI#0300064, are allegedly in violation
of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of January, 2004, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Francisco Gallegos and Betty Rosalez were not present or represented at said
hearing,although all parties were notified of said hearing by Department of Planning Services staff,
and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until February 13, 2004, to allow adequate time for the property owners to submit
Building and Zoning Permits to bring the subject property into compliance and for an inspection of
the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0300064 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Francisco Gallegos and Betty Rosalez to remedy the violation of the
Weld County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties, with
an instruction for delay of action upon such referral until February 13, 2004, to allow adequate time
for the property owners to submit Building and Zoning Permits to bring the property into
compliance.

REMEDY

RECOMMENDATION

as the building permit has not been issued.
June 09, 2003 30-day letter that building permit for the mobile home must be issued.
July 15, 2003 30-day letter from Wendi Inloes to remove the mobile home as the zoning permit
has expired.
September 10, 2003 Site inspection by building inspector-skirting and blocking removed. It appears
mobile home is being prepared to move.
September 24, 2003 10-day letter to remove the mobile home as the building permit has expired.

RE: ZPMH-2351 -Temporary Storage of a Mobile Home
Dear Ms. Rosalez:
Your zoning permit for temporary storage of the mobile home located on the W2 of Lot 20, all of Lot 21, Block 6, East
Side Addition, has expired. The mobile home needs to be removed from the property within 30 days of receipt of this
letter. It has also come to the attention of the Department of Planning Services that the home is being lived in. As
a condition (#3 of your zoning permit), the mobile home is not to be used for housing. You are also in violation of
condition#1 which states that a building permit needed to be obtained,which was never completed. Should the home
not be removed in 30 days, a violation will be issued by both the Zoning and Building Departments.
