Cottony Division Director Re: P & A Turkey Farms Vincent Matthews CGS Review No. WE-05-0007 State Geologist Dear Ms Martin; In response to your request and in accordance with Senate Bill 35 (1972), I visited the site and reviewed the site plan on August 24, 2004. The site consists of approximately 126.186 acres and the proposed subdivision would include 9 residential lots on 15.801 acres, two agricultural outlots on 101.106 acres and one common open space outlot on 6.369 acres. There is an existing home on east side of the site, which will be removed. The existing house has a septic system. Water supply for the 9 lots will be from the Weld County Water System. Sanitation services will be provided by individual on-lot septic systems. Included in the review package were a Specific Development Guide (undated), a site layout map by Wohnrade Civil Engineers, Inc. (4-12-04), and a supplement to a Geotechnical Engineering Report by Terracon Consultants Inc. (4-22-04). The original Geotechnical Engineering Report by Terracon was conducted on 5-17-00. The property is on gently sloping terrain, located on the southwest corner of Weld county roads 49 and 52. It is bordered on the west by the Gilmore canal. The site is located on Quaternary gravel deposits, underlain by the Laramie Formation. The log of boring hole No. P-1 indicates that the depth to bedrock on some parts of the property may be too shallow for conventional septic systems. Engineered septic systems may be required in areas where the depth to bedrock is less than 6 feet. Soils on the property were silty sands and sandy clays. The geotechnical report indicates that the bedrock is moderately to highly expansive and recommends a site-specific geotechnical investigation before construction. Part 7 of section 27-6-40 of the Specific Development Guide indicates that the overall density for wastewater disposal will be one septic system per 14.021 acres. While this is true if the entire subdivision is taken into account, there will be 9 septic systems within 15.801 acres for a density of be one septic system per 1.756 acres for the residential portion of the subdivision. The site layout map indicates that a gas well exists just south of Lot 5-Block 1 with a 150 foot radial easement overlapping the southern part of Lot 5-Block 1. The building envelope for Lot 5 should avoid the gas well easement. Provided that the recommendations in the Geotechnical Engineering Report by Terracon Consultants Inc. and the recommendations included in this letter are complied with, this office has no other concerns regarding this subdivision. A separate building permit shall be obtained prior to the construction of any building. 2. A plan review is required for each building. Two complete sets of plans are required when applying for each permit. 3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit application. Current adopted codes include the 2003 International Residential Code; 2003 International Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code. 4. Each building will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be • determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. When measuring buildings to determine offset and setback requirements, buildings are measured to the farthest projection from the building. Department of Public f COLORADO Health and Environment CASE NO.: PZ-1050 NAME: P&A Turkey Farm The Weld County Health Department has reviewed this proposal. The applicant proposes a 9 lot PUD on 126 acres. The minimum lot size is 1.4 acres, and coupled with the overall density of one septic system per 14 acres does meet current Department policy. The application has satisfied Chapter 27 of the Weld County Code in regard to water and sewer service. The application has submitted a letter of availability from Central Weld County Water District in the application materials. Sewer will be provided by individual sewage disposal systems. Preliminary information in the geotechnical report conducted by Terracon, dated May 17, 2000, and submitted in the application, indicates most of the site will probably require engineer design septic systems due to shallow bedrock. The percolation tests were performed in February 2000 and indicate shallow groundwater exists across the site. A supplemental report of borings from Terracon dated April 22, 2004 showed the groundwater table to be deeper than the initial geotechnical investigation. However, the bedrock depth varies widely across the property and may still be an issue for septic system design (meaning shallow or mounded absorption fields). Because of the lot sizes, the likelihood of engineered septic systems, and that livestock are allowed on lots, the Department recommends two septic system envelopes be placed on each lot. The Department would further recommend that language for the preservation and/or protection of the second absorption field envelope be placed in the development covenants and on the plat. This language has been placed in the draft covenants included in the application and is adequate. The proposed Lot 2 Block 2 has improvements, including a septic system. The Department has found 13 septic systems associated with this address (list enclosed). The applicant should review our records to determine which, if any, of these documented systems is associated with the improvements on Lot 2 Block 2. If no permit is found for this existing system, the Weld County Department of Public Health & Environment will require that the system be documented and evaluated. This is in order that any information known about the system is preserved for future consideration (the applicant states that they reserve the right to reuse the system at a later date provided it meets all current regulations). A well permitted with the Colorado Division of Water Resources (permit 26110) has been identified on the property, possibly on Lot 2 Block 2. The well has not been identified on the Change of Zone plat map. The ownership and use of the well should also be identified. The Department recommends approval with the following conditions: 1. Water service shall be obtained from Central Weld County Water District. 1 2. This subdivision is in rural Weld County and is not served by a municipal sanitary sewer system. Sewage disposal shall be by septic systems designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 3. Primary and secondary septic envelopes shall be placed on each lot. Each envelope must meet all setback requirements. 4. Language for the preservation and/or protection of the absorption field envelopes shall be placed in the development covenants. The covenants shall state that activities such as permanent landscaping,structures, dirt mounds or other items are expressly prohibited in the absorption field site. 5. The existing septic system (currently not known to be permitted) must be properly abandoned in accordance with Section 30-4-20 (D) as a part of this development OR the existing septic system will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit (recorded Statement of Existing). 6. If required, the applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment. Silt fences shall be maintained on the down gradient portion of the site during all parts of the construction phase of the project. 7. During development of the site,all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions,at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 8. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods that are technologically feasible and economically reasonable in order to minimize dust emissions. 9. If land development creates more than a 25-acre contiguous disturbance, or exceeds 6 months in duration,the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. 10. Comments made during this phase of the subdivision process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Comments External Roadways: ❑ The Weld County Roadway Classification Plan currently shows CR 49 with a classification as a rural area arterial requiring a 130-foot right-of-way (strategic corridor). The applicant shall verify the existing right-of-way and the documents creating the right-of-way shall be noted on the change of zone plat. If the right-of-way cannot be verified, it will be dedicated on the final plat. CR 49 is paved. ❑ CR 52 is classified by the County as a local road and requires a 60-foot right-of-way. I Based on the proposal of limited development and apparent low traffic impact, a traffic study is not currently required. This development will add approximately 86 trips per day to transportation system. ❑ This development will introduce additional vehicle trips to the roadway system. This increased level of traffic on unpaved roads creates fugitive dust and surface maintenance problems. The applicant shall enter into an agreement with the County to proportionately share the cost of improvements. The cost will be based on a proportion of the traffic generated by the development to existing traffic. The applicant shall submit a proposed agreement with the final plan application. Internal Roadways: ❑ The internal roadway right-of-way shall be 60-feet in width including cul-de-sacs with a 65- foot radius, and dedicated to the public. The typical cross-section of interior road shall be shown as two 12-foot paved lanes with 4-foot gravel shoulders on the change of zone plat. The cul-de-sac edge of pavement radius shall be 50-feet. U Stop signs and street name sign locations must be shown on the final roadway construction plans. ❑ Intersection sight distance triangles at the development entrance will be required. All landscaping within the triangles must be less than 31/2 feet in height at maturity,and noted on the final roadway plans. ❑ The applicant shall submit to Public Works stamped,signed and dated final plat drawings and roadway/construction& grading plan drawings for review(with the final application)and approval. Construction details must be included. This is consistent with County Code: Sec. 24-3-50, "The minor subdivision final plat submitted shall contain the original signatures and seals of all parties required." ❑ The applicant shall provide a pavement design prepared by a professional engineer along with the final plan submittal. The sheriff's office requests that builders and developers designate an area by the entrance of the sub-division in which to place a shelter for school children awaiting the school bus. This area should also include a pull off for the school bus which enables it to safely load and unload children out of the roadway in the event the bus is unable to drive down the street due to road conditions. 2. Either a mail distribution within the sub-division or a central drop off location within the sub-division should be developed so that residents do not have to cross a county roadway to obtain their mail. 3. The name of the street within the sub-division should be presented to the sheriffs office for approval. This will eliminate duplication of street names within the county. . 4. A permanent sign should be placed at the entrances to the sub-division detailing the name of the sub-division, and address. There should be a plan developed to maintain this sign. 5. If the roadways within this sub-division are not maintained or adopted by the county, individuals purchasing property in this sub-division should be notified that the sheriffs office will have limited traffic enforcement powers. 6. A plan should be developed to maintain roadways within the sub-division especially during inclement weather conditions for emergency vehicles. 7. The sheriffs office is very supportive of homeowner funded homeowners associations. These associations provide a contact for the sheriffs office and i-. a means for maintaining common areas. 8. The plans for this sub-division show roadway with no sidewalks. The sheriffs office requests that sidewalks be provided. 9. If there is an oil or gas well within this sub-division. This needs to be fenced off in order to mitigate the potential for tampering. These facilities are known to create an attractive nuisance for young people. Tampering not only creates a significant danger to safety but also of environmental damage with extensive mitigation and clean-up costs. The Sheriffs Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Board of County Commissioners or as indicated by growth not considered at the time the plan was developed.
