RE: APPROVAL OF RECORDED EXEMPTION NO. 479 - BILL AND PENELOPE
CULLEN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held on
the 18th day of February, 1981 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of land, as shown on the plat known as Recorded
Exemption No. 479 , being the property of Bill and Penelope Cullen
described as part of the Southwest Quarter of Section 10 , Town-
ship 3 North, Range 68 West of the 6th P.M. , Weld County, Colo-
rado, being more particularly described as follows, does not come
within the purview of the definition of the terms "subdivision"
and "subdivided land," pursuanL to its authority under Section
30-28-101 (10) (d) , CRS 1793, as amended:
That portion of the Southwest Quarter of
Section 10 , Township 3 North, Range 68
West of the 6th P.M. , Weld County, Colo-
rado, being more particularly described
as follows:
Beginning at the West one-quarter corner
of Section 10; thence along the West line
of said Section 10 , South 00°05' 50" West
667 . 00 feet; thence South 89°54 '10" East
657 . 28 feet to the Northerly right-of-way
line of the Great Western Railroad; thence
along said Northerly right-of-way line
the following courses , North 52°06 '50"
East 100 . 10 feet to a point of curve;
thence along the arc of a curve to the
right (radius of said curve being 1, 950 .00
feet, chord of said arc bears North
64°27 ' 05" East 745. 65 feet) a distance of
750 . 27 feet; thence North 75°28 ' 25" East
1, 231. 94 feet to a point on the North
line of the Southwest Quarter of said
Section 10; thence South 89°28 ' 20" West
2600. 56 feet to the point of beginning,
containing 21. 983 acres more or less.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the

definitions of "subdivision" and "subdivided land" pursuant to
its authority under Section 30-28-101 (10) (d) , CRS 1973 , as
amended, and Section 2-1A(3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Bill and Penelope Cullen be, and hereby
is, exempt from the definition of the terms "subdivision" and
"subdivided land" pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973 , as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 18th day of
February, A.D. , 1981.

Re: Recorded Exemption #479
Dear Commissioners:
The attached application, plat, and related items are in reference to a
request from Bill and Penelope Cullen for a recorded exemption. The
parcel of land on which this request has been made is described as part
of the SW1, Section 10, T3N, R68W of the 6th P.M. , Weld, County, Colorado.
This property is located adjacent to the north edge of Mead on the east
side of Weld County Road 7. The property contains approximately 22
acres of Class II irrigated soils. The request is to split the property
into parcels of 2.9 acres and 19.0 acres. Mr. Cullen wishes to sell the
portion of the property associated with the lumberyard/hardware business
to his partner, Mr. Johnson. Lot A is presently zoned commercial. Lot
B would be retained by Mr. Cullen.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends this request
be approved for the following reasons:
1. The request is in compliance with the policies of the Weld
County Comprehensive Plan in that to minimize conflicting
land uses, development is encouraged to locate adjacent
to existing towns and in accordance with the comprehensive
plans and stated wishes of each community. The parcel of
land is located adjacent to the Town of Mead. The Town of
Mead Planning Commission has recommended approval of this
request.
2. The request is in compliance with the intent clause of the
recorded exemption procedures (Section 9.2 of the Weld County
Subdivision Regulations). The parcel is too small to be used
as an agricultural unit. The use of the property would
appear to be compatible with surrounding land uses.
