Masden, Chair Commissioner William H. Jerke, Pro-Tem Commissioner M. J. Geile Commissioner David E. Long - EXCUSED Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Sheri Lockman Health Department representative, Char Davis Public Works representative, Peter Schei The following business was transacted: I hereby certify that pursuant to a notice dated November 19, 2004, and duly published November 24, 2004, in the Fort Lupton Press, a public hearing was conducted to consider the request of Gerrit and Karen Voshel for a Site Specific Development Plan and Use by Special Review Permit#1486 for a Kennel (25 dogs)in the A(Agricultural)Zone District. Lee Morrison,Assistant County Attorney,made this a matter of record. Chair Masden advised Gerrit Voshel,applicant,that he has the option of continuing this matter to a date when the full Board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Long will listen to the record and make the determining vote. Mr.Voshel indicated he would like to proceed today. Sheri Lockman,Department of Planning Services,presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She also gave a brief description of the location of the site and surrounding uses. She further stated ten referral agencies reviewed this proposal, seven responded favorably or provided comments that have been addressed in the Conditions of Approval and Development Standards,three agencies did not respond,and staff has received various letters of support. Ms.Lockman stated the applicant has submitted a Waste Handling Plan,which has been reviewed and approved by the Department of Public Health and Environment, therefore, Condition #1.B can be deleted. Ms. Davis stated the applicants have complied with all the health requirements, and the site is serviced with a permitted domestic well and a septic system. Peter Schei, Department of Public Works, stated the case was initially reviewed by Don Carroll, Department of Public Works,and his referral response indicates all of the transportation items have been addressed and staff has no concerns. 2004-3430 PL1751 �(� ; /'Z/ /'l /fLCe7') /oz 7cry HEARING CERTIFICATION - GERRIT AND KAREN VOSHEL (USR #1486) PAGE 2 Mr.Voshel stated they have worked hard to comply with the County requirements. In response to Commissioner Geile,Mr.Voshel stated the application is for25 dogs;however, it is unlikely they will ever reach that number. He explained some of their dogs are too old to continue competing, and he intends to breed younger dogs to continue competing. He stated the champion dogs are kept indoors,and each of the dogs is allowed to come into their home on a rotating basis. Responding to Chair Masden, Mr.Voshel stated a majority of their dogs are Brittany Spaniels,as well as some Shelties. No public testimony was offered concerning this matter. In response to Chair Masden, Mr.Voshel stated he has reviewed and concurs with the Conditions of Approval and Development Standards, as proposed,as well as deleting Condition#1.B. Mr.Voshel stated he intends to continue to meet or exceed the requirements. Commissioner Vaad moved to approve the request of Gerrit and Karen Voshel for a Site Specific Development Plan and Use by Special Review Permit #1486 for a Kennel (25 dogs) in the A(Agricultural)Zone District,based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion included deleting Condition#1.6 and relettering the subsequent paragraphs accordingly. The motion was seconded by Commissioner Jerke,and it carried unanimously. There being no further discussion, the hearing was completed at 10:35 a.m. This Certification was approved on the 13th day of December 2004.
