HomeMy WebLinkAbout20043458.tiff RESOLUTION RE: APPROVE CONSENT TO THE ENFORCEMENT BY THE WESTERN HILLS FIRE PROTECTION DISTRICT OF THE 2003 INTERNATIONAL FIRE CODE, WITH AMENDMENTS, WITHIN THE DISTRICT'S UNINCORPORATED PORTIONS OF WELD COUNTY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Section 32-1-1002(1)(d), C.R.S., provides that a fire code promulgated by a fire district may be enforced in the unincorporated portions of a county only with the consent of the board of county commissioners of such county, and WHEREAS, the Western Hills Fire Protection District ("the District") has presented a resolution and minutes, dated October 18, 2004, adopting and promising to enforce the 2003 International Fire Code, with certain amendments set forth in said resolution and minutes, within the District's unincorporated portions of Weld County, and WHEREAS, after review, the Board deems it advisable to consent to the enforcement by the District of the 2003 International Fire Code, with certain amendments set forth in said resolutions, within the District's unincorporated portions of Weld County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that it hereby consents to the enforcement by the Western Hills Fire Protection District of the 2003 International Fire Code, with certain amendments set forth in its resolution and minutes dated October 18, 2004. The matter is set for the Board to consider on its Monday, December 13, 2004, meeting, which will take place at 9:00 a.m. in the Board's First Floor Meeting Room, Weld Centennial Center, 915 10th Street, Greeley, Colorado. As we discussed by email, I have scheduled a 45 minute work session with the Board of County Commissioners to discuss the matter on Tuesday, December 7, 2004, at 10:30 a.m. in Room 350, Weld Centennial Center. I respectfully request that you, Doug Forsman, and available Board of Directors members attend. Additionally, the Board of County Commissioners has been consistent in asking the fire protection districts to make sure there has been adequate notice to the property owners within the districts of the adoption of fire codes. The Board has accepted affidavits of publication of notices of the meetings of the district boards when the codes were adopted. Total calls 67—broken down as follows Incident Type Total Electrical wiring/equipment problem 1 Emergency Medical Incident 29 False Call (other than a fire alarm) 8 Grass Fire 11 Service Call, other 8 Vehicle accident with injuries 9 Vehicle accident, non-injury 1 Grand Total 67 Upcoming—All Officers' meeting on Wednesday,October 20th Fire Prevention Week—Activities just finished Collective Bargaining Agreement—just signed at last UCFRA Board meeting, no raise in 2005 and 2% in 2006. Some non-economic issues in the contract were resolved. The Union passed the agreement by a 3 to 1 margin. By comparison to area Fire Departments, our pay was at the top of the survey. However, our stations are busier and our personnel offer ALS service. 9. Oral or Written Suggestions from the Board or Taxpayers None • 10. WHEREAS, the Western Hills Fire Protection District has the responsibility of interpreting and enforcing the International Fire Code for the protection of citizens who live within the Authority's boundaries; and WHEREAS,the International Fire Code, 2003 Edition, is deemed by the Authority to be the version of the Code that will provide the best protection to citizens. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE WESTERN HILLS FIRE PROTECTION DISTRICT AS FOLLOWS: 1. The International Fire Code, 2003 Edition,together with Appendices B, C,E,F, and G, included therein is hereby adopted by reference as law in the boundaries of the Western Hills Fire Protection District. The International Fire Code and the appendices and tables and the referenced standards are on file at the office of the Union Colony Fire/Rescue Fire Prevention Bureau. 2. The International Fire Code, 2003 Edition, is hereby amended in accordance with the provision of Exhibit A, attached hereto and incorporated herein by reference. 3. These regulations shall be known as the Fire Code of Western Hills Fire Protection District, hereinafter referred to as "this code." 102.3. Change of use or occupancy. The provisions of the International Existing Building Code this code and all currently adopted building codes shall apply to all buildings undergoing a change of occupancy. 102.4. Application of building code. The design and construction of new buildings shall comply with the International Building Code this code and all currently adopted building codes. Repair, alterations and additions to existing structures shall comply with the International Existing Building Code this code and all currently adopted building codes. Delete Section 102.5. 102.6 Referenced codes and standards. The codes and standards referenced in this code shall be those that are listed in Chapter 45 except that references to National Fire Protection Association standards shall refer to the most current edition of such standard and all references to the ICC Electrical Code shall[Wean the currently adopted electrical code. and Such codes and standards shall be considered part of the requirements of this code to the prescribed extent of each such reference. Where the differences occur between the provisions of this code and the referenced standards, the provisions of this code shall apply. 104.1.1 Fire prevention bureau personnel and police. The chief and members of the fire prevention bureau shall have the powers of a police officer to issue a summons into court and in performing their duties under this code and shall only extend as far as the authority set forth in Colorado Revised Statutes 1973 §32-1-1002 as amended, or other applicable state statute. When requested to do so, the Sheriff or the chief of police is authorized to assign such available deputies or police officers as necessary to assist the fire department in enforcing the provisions of this code. 105.6.31 Open Burning. An operational permit is required for the kindling or maintaining of an open fire or a fire on any public street, alley, road, or other public or private ground. Instructions and stipulations of the permit shall be adhered to. Exception: Recreational fires. 108.3 Qualifications. The board of appeals shall consist of members who are qualified by experience and training to pass on matters pertaining to hazards of fire, of the jurisdiction. Appeals Process. All appeals shall first be made in writing to the Fire Marshal. A subsequent appeal to the Fire Marshal's decision shall be made in writing to the Fire Chief. An appeal to the Fire Chiefs decision EXHIBIT A WESTERN HILLS FIRE PROTECTION DISTRICT AMENDMENTS TO INTERNATIONAL FIRE CODE, 2003 EDITION shall be made in writing to the Union Colony Fire Rescue Authority Board. Al! decisions and findings shall be rendered in writing to the appellant with a duplicate copy filed in the Fire Prevention Bureau. Rulings by the Union Colony Fire Rescue Authority Board shall be final. 109.3 Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter, repair or do work in violation of the approved construction documents or directive of the fire code official, or of a permit or certificate used under provisions of this code, shall be guilty of a misdemeanor, punishable by a fine of not more than 1,000 dollars or by imprisonment not exceeding one year, or both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense. 111.4 Failure to comply. Any person who shall continue any work after having been served with a stop work order, except such work that a person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not less that [AMOUNT] dollars or more than [AMOUNT] dollars guilty of a misdemeanor,punishable by aline of not more than $1,000 or by imprisonment not exceeding one year, or both such fine and imprisonment. 903.2.7An automatic sprinkler system installed in accordance with Section 903.3 shall be provided throughout all buildings with a Group R fire area. Exception: One- and Two-family dwellings unless otherwise required based upon fire flow,fire apparatus access or other life safety hazard as deemed by the fire code official. 3204.3.1.1 Location. Stationary containers shall be located in accordance with Section 3203.6. Containers of cryogenic fluids shall not be located within diked areas containing other hazardous materials. Storage of flammable cryogenic fluids in stationary containers outside of buildings is prohibited except in those areas zoned Industrial. 3404.2.9.5.1 Locations where above-ground tanks are prohibited. Storage of Class and II liquids in aboveground tanks outside of buildings shall be prohibited except in those areas zoned Industrial, Agricultural, and PUD subject to the approval of the fire code official. 3406.3.1 Location. The location of wells shall comply with Sections 3406.3.1.1 through 3406.3.1.3.2. oil and natural gas operations shall be in accordance with Safety Regulations of the Colorado Oil and Gas Conservation Commission. Setbacks contained therein shall apply to new and existing oil and natural gas operations.
