Environmental Health Services has reviewed this proposal for a Kennel. We have no
objections to the proposal, however, we do recommend that the following conditions be
part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The existing septic system to be used for the proposed mobile home shall be
reviewed by a Colorado Registered Professional Engineer. The review shall
consist of observation of the system and a technical review describing the
systems ability to handle the proposed hydraulic load. The review shall be
submitted to the Environmental Health Services Division of the Weld County
Department of Public Health and Environment. In the event the system is found
to be inadequately sized or constructed the system shall be brought into
compliance with current Regulations.
2. The applicant shall submit a manure and stormwater management plan to the
Weld County Department of Public Health and Environment for review and
approval. The plan should describe how manure generated on site will be
stored, managed, removed, land applied, etc. The plan should also describe the
fate of any stormwater that may come into contact with manure.
3. The applicant shall provide written evidence to the Weld County Department of
Public Health and Environment that the applicant has contacted the Colorado
Department of Agriculture (CDA), Division of Animal Industry. This contact shall
determine if a license under the Pet Animal Care Facilities Act (PACFA), as
defined under C.R.S. 35-80-101 through 117. C.R.S. is required, or provide
evidence that the applicant is not subject to the PACFA requirements.

4. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. Animal and feed wastes, bedding, debris and other organic wastes shall be
disposed of so that vermin infestation, odors, disease hazards, and nuisances
are minimized. Such wastes shall be removed at least weekly from the facility
and disposed by a commercial hauler.
2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
3. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
4. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
5. The applicant shall operate in accordance with the approved "waste handling
plan".
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.
8. Adequate handwashing and toilet facilities shall be provided for sanitary
purposes.

9. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
10.The facility shall utilize the existing public water supply. (ARWP)
11.The facility shall maintain compliance with the Best Management Practices
outlined in the Confined Animal Feeding Operation Regulations (5 CCR 1002-
19).

The Weld County Public Works has reviewed this proposal; this project falls primarily under the purview of the
Use by Special Review, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and
requirements are as follows:
COMMENTS:
Caroline Avenue is located within the Aristrocrat Acres Subdivision. This road is a local gravel subdivision road.
All other Aristrocrat Ranchettes is maintained by Weld County.
REQUIREMENTS:
Access: The applicant indicated that there are two existing access points through the industrial grade obscure
chain link fence. The eastern access appears to be the main access with an internal circle drive. The western
access would accommodate removal and replacement of the trailer. This access should be closed and locked.

Parking and Circulation: The off-street parking and circulation including the access drive should be surfaced
with gravel or the equivalent and should be graded to prevent drainage problems. The circulation appears to be
in the main access area.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent property damage of the type
generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of
storm run-off.
I am referring the animal units to the Department of Health and Environment. Additional requirements may be
necessary, as they deal with animal units.

The following permits are on record for this parcel number or address:
MP02212 was issued for a 14 X 60 mobile home. This permit received final inspections and
approval
BC-9700431 was issued to place a move-in house on a basement. The permit was voided after
the foundation was inspected and approved by the owners request.
PRS-033042 was issued to install a 14 X 70 blocked and tied mobile home to replace an
existing mobile home. No inspections have been requested or approved. The permit will expire
on March 30, 2004.
BCS-030284 was issued to demolish an existing mobile home. No inspections have been
requested or approved.
1. All required inspections shall be scheduled and approved for PRS-033042 and BCS-030284
before these permits expire.
2. A building permit will be required for any new structure unless the structure is exempt from
building permits as per Section 29-3-20 B of the Weld County Code.

Upon review of my computer and files,a Zoning Violation (VI-0000100)was noted. The violation was initiated
as a result of receiving complaints regarding presence of derelict mobile homes, a Noncommercial Junkyard
and numerous household pets (cats). Currently, the property owner is in the process of installing a new
mobile home on the property(PRS-033042)and has already applied for a demolition permit(BCS-030284)to
demolish the existing derelict mobile homes. The Noncommercial Junkyard has been screened from adjacent
properties and public rights-of-ways. To address the number of cats on the property,the property owner was
directed to submit this Use by Special Review application. It is my understanding that this is not a typical
kennel application. The cats are her personal pets. She does not operate a business. This application was
submitted to allow her to keep the number of pets that she currently has on her property,which is more than
allowed as a Use by Right in the Agricultural Zone District.
Please be advised that this violation was presented to the Board of County Commissioners through the
violation hearing process on January 8, 2002. At that hearing,the Board of County Commissioners referred
this case to the County Attorney's Office for immediate legal action. Since the other aspects of the violation
have already been addressed, this application, if approved, and once recorded, will correct and close the
violation.
If this application is denied,the number of household pets(cats)shall be reduced to four(4)within 90 days of
denial by the Board of County Commissioners. Otherwise,the County Attorney's office will have no options of
recourse other than to proceed with legal action in District Court.

The Department of Planning Services has reviewed this application and has the following
comments:
The applicant is proposing to kennel 4 dogs of an unspecified breed, 25 cats plus an additional
feral cat colony, goats and poultry animals Additional information shall be provided stating the
typical daily requirements, including approximate square footage of dog runs, housing
(bedding) and dietary requirements for all animals associated with this application.
The applicant's USR Map delineates limited fencing on site, however, the type of fencing,
opaque versus open fencing has not been specified. The applicant shall provide additional
information pertaining to the fencing of the facility from surrounding property owners and public
road rights-of-way.
Given that this is a private facility with little public contact, staff will waive the parking
requirement. Staff will not require the site to meet ADA standards.
The application does not provide information concerning the date of construction for all on-site
structures. As there is a change in use, the Department of Building Inspection shall be
contacted to verify how the structures were permitted and if there are any building related
issues that should be addressed. This includes the proposed 14x68 foot trailer, the non-
dimensioned trailer to be removed and the 39x60 foot concrete foundation.
The application states that domestic water is obtained from Aristocrat Ranchettes Water
District. As this is technically a commercial endeavor, written evidence for verification of a
commercial tap should be obtained from the water district and submitted to the Department of
Planning Services.
The application states that there is a leach field on site. Animal wastes are disposed of through
a refuse hauler.
Section 23-3-250.A.6 states "Areas used for trash collection shall be screened from public
rights-of-way and all adjacent properties. These areas shall be designed and used in a manner
that will prevent wind- or animal-scattered trash." It is unclear from the applicant's drawing
whether the trash collection area is screened from the public rights-of-way and adjacent
properties. Written and /or graphic evidence shall be submitted to the Department of Planning
Services for review and approval.
Section 23-3-250.A.9 addresses "Outside storage. Uses involving outdoor storage of vehicles,
equipment or materials when permitted shall be screened from public rights-of-way and all
adjacent properties." It is unclear from the applicant's drawing whether there is an area for
outdoor storage. Written and /or graphic evidence shall be submitted to the Department of
Planning Services for review and approval.
Section 23-3-250.6 addresses Operation Standards. Section 23-3-250.6.6 addresses the
issues of Light. "Any lighting, including light from high temperature processes such as welding
or combustion, shall be designed, located and operated in such as manner as to meet the
following standards: sources of light shall be shielded so that beams or rays of light will not
shine directly onto adjacent properties; neither the direct nor reflected light from any light
source may create a traffic hazard to operators of motor vehicles on public or private streets;
and no colored lights may be used which may be confused with or construed as traffic control
devices." It is unclear from the applicant's drawing whether there is an any exterior lighting.
The applicant shall provided written and /or graphic evidence to the Department of Planning
Services for review and approval. A Lighting Plan may be required, if applicable.
Section 23-3-250.B.7 states "Property shall be maintained in such a manner that grasses and
weeds are not permitted to grow taller than twelve (12) inches. In no event shall the property
owners allow the growth of noxious weeds. (Weld County Codification Ordinance 2000-1)
The existing on-site landscape treatment is adequate for this facility.

The sheriff's office has no concerns with this Special Use Permit. I have discussed this
location with the animal control officers and they told me that the applicant Barbara
Schottelkotte does spend a significant amount of money on food and veterinarian services
as she has stated in her application. Our position on this does not attempt to predict any
future behavior of this applicant or whether or not the number of animals present are
within the guidelines of this type of permit.
The Sheriffs Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.
