RE: APPROVAL OF RECORDED EXEMPTION NO. 627 - CLAYTON CLAUS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , it has been determined by the Board of County Com-
missioners at a public meeting held in the Chambers of the Board,
that the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 627, being the property of Clayton
Claus, described as part of the Northwest a, Section 3, Township
3 North, Range 68 West of the 6th P .M. , Weld County, Colorado,
being more patricularly described in the plat which shall be pro-
vided by the applicant and known as Exhibit "A" , said plat to be
recorded, does not come within the purview of the definition of
the terms, "subdivision" and "subdivided land" , pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Clayton Claus be , and hereby is , exempt
from the definition of the terms , "subdivision" and "sub-
divided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a mylar plat to the
Department of Planning Services office to be recorded in the
office of the Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2 C . (4) of the
Weld County Subdivision Regulations . The plat shall be sub-
mitted within ninety (90) days from the date of approval by
the Board.

Re: Recorded Exemption #627
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Clayton Claus for a recorded exemption. The parcel of land
on which this request is being made is described as Lot "A" of Recorded
Exemption #160 (February 1975) , which is part of the NW14, Section 3,
T3N, R68W of the 6th P.M. , Weld County, Colorado.
The property is located 1.5 miles north of Mead on Weld County Road 7.
The property contains approximately 7.97 acres of Class IIIc and VIe
nonirrigaed soils.
The request is to divide the property into parcels of 5.94 acres and
2.03 acres, more or less. It is the intent of the applicant to sell
the smaller parcel to the current renters for a goat raising operation.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved
for the following reasons:
1. The request complies with Section 9-2 C. of the Weld
County Subdivision Regulations submission requirements .
2. The request complies complies with Section 9-2 E. of the
Subdivision Regulations as follows:
- The 7..97 acres, more or less, under consideration will
allow uses which are consistent with the intent clause
of the Agricultural Zone District. The uses will be
compatible with existing surrounding uses.

- The proposal was reviewed by the town of Mead and
was found to comply with their long-range Compre-
hensive Plan;
- The proposal is in compliance with Section 1-3 of
the Weld County Subdivision Regulations and the
proposed land division complies with the Weld
County Comprehensive plan. Therefore, the proposed
use is consistent with efficient and orderly
development;
- The proposal does not exist in an overlay district
area;
- The proposed lots meet minimum lot size require-
ments for land division;
- The Little Thompson Water District has indicated
adequate water service is available for this
proposal;
- The proposed lots are not part of a recorded exemption
within the last five (5) years;
- The two lots proposed will have adequate access from
Weld County Road 7 .
The Department of Planning Services staff recommendation for approval is
conditional upon the applicant submitting a mylar plat to the Department
of Planning Services office to be recorded in the office of the Clerk
and Recorder. The plat shall be drawn in accordance with the requirements
of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within ninety (90) days from the date of approval by
the Board.

Dear Sirs:
I am applying for a recorded exemption on Lot A of
Recorded Exemption No . 1207-3-2 RE16O .
The people renting the house at the present time
would like to buy approximately two acres, including the
house and garage for their goat raising operation. I
will keep the rest of the property, being approximately
six acres . I rill continue to use the corrals in my cattle
business for feeding, and my son will continue using the
shop for his custom hay business . My son will continue
to live in the trailer house on the larger parcel of the
property.
The smaller parcel will be able to utilize the small
area northeast of the corrals as pasture, which at the pre-
sent time I cannot effectively or efficiently use . The use
of both properties will remain agricultural.
The property to be split off adjoins Highland Estates
and would be approximately the same size as those lots, and
I feel it would be compatible with the land use in the area,
which is farming and raising livestock.
There is a water tap in existence serving the larger
parcel and I will purchase and install a tap for the smaller
parcel to be sold . I have a letter from Little Thompson
Water District, stating that a tap is available .
The existing structures will remain as is, with each Site
having it' s own septic system.
There is access off of County Road 7 in existance now
that will serve the smaller parcel . A new access entrance
will be built from Road 7 to serve the remaining larger site .
