SUBJECT: AMUSR-227, Cornish Plains Livestock
The Weld County Department of Public Health and Environment has reviewed this
application. As a part of our review, I observed the facility with you and Clair Orr on
November 11, 2003. Based upon my observations and discussions with the owner, the
operation is currently not in compliance with Regulation No. 81 of the Colorado Water
Quality Control Commission Regulations a.k.a. the Confined Animal Feeding Operation
— Control Regulations (CAFO Regulations). A significant portion of any run-off from the facility
would discharge into the Coal Ridge Ditch Drainage. Our recommendation will include many
conditions pertaining to demonstration of compliance with the CAFO Regulations. We
encourage the applicant to contact Ron Jepson (303-692-3520) in the Water Quality Control
Division of the Colorado Department of Public Health & Environment to better understand
compliance options as the CAFO Regulations are currently in the process of being
amended.
We recommend for approval of the feedlot with numerous recommended conditions and
standards. We have attempted to simplify our referral by separating the proposed conditions
into conditions of approval and development standards.
The following are recommended to be conditions of approval:
1. Prior to recording the plat:
A) The facility shall demonstrate compliance with the Confined Animal Feeding
Operations Control (CAFO) Regulations and the additional requirements
outlined below. This shall be demonstrated by submitting a comprehensive
manure and waste water management plan, for a 3,000 head facility, to the
Weld County Department of Public Health and Environment for review and
approval. This plan shall include, but not be limited to the following:
(1) Demonstration that all manure stockpile areas and waste water

collection, conveyance, and retention facilities are adequately sized
and constructed to handle and retain the storm water run-off generated
from a twenty-five year, twenty-four hour storm event. This shall be
conducted by a Registered Professional Engineer .
(2) Demonstration that any proposed waste water retention structure will
be constructed in accordance with the CAFO Regulations. The
demonstration shall be conducted by a Registered Professional
engineer.
(3) A site map demonstrating the layout of the site. This should include
the locations of all pens, structures, feed storage areas, any water
courses through the property, manure storage areas, lagoons, etc.
(4) A surface contour map which demonstrates all surface water
control features on the site. This should include surveyed surface
elevations, indicate flow direction, run-on and run-off control features,
etc.
(5) Demonstration that the facility has the ability to manage, dispose,
and/or land apply manure and waste water at agronomic rates in
accordance with the CAFO regulations.
(6) Demonstration that adequate measures are in place to prevent any
discharges except those which are allowed by the CAFO Regulations.
(7) Other necessary measures which are required in order to comply with
the CAFO Regulations.
(8) A description of the types of records that will be maintained on the
facility, as required by the CAFO Regulations.
(9) Evidence that the site is graded to convey stormwater or other waste
waters to retention facilities in order to prevent stagnant or pooling
water.
B) In accordance with the CAFO Regulations, the applicant shall submit the facility's
manure and waste water management plan to the Colorado Department of Public
Health and Environment for review and comment.
C) Dust abatement, fly control, odor control, and pest control plans shall be
submitted to the Weld County Department of Public Health and Environment for
review and approval.
D) All septic systems located on the property shall have appropriate permits from the
Weld County Department of Public Health & Environment. The Environmental
Health Division of the Weld County Department of Public Health & Environment
was unable to locate a septic permit for the existing home on the property. Any
existing septic system(s) which is not currently permitted through the Weld County
Department of Public Health & Environment will require an I.S.D.S. Evaluation

prior to the issuance of the required septic permit(s). In the event the system(s) is
found to be inadequate, the system(s) must be brought into compliance with
current I.S.D.S. regulations.
E) The applicant shall submit evidence to the Department of Planning Services, from
the Colorado Division of Water Resources, demonstrating that the well(s) on the
property are appropriately permitted for the use.
The following are recommended to be development standards:
1. Fugitive dust shall be controlled on this site. The facility shall be operated in
accordance with the approved dust abatement plan at all times.
2. All liquid and solid waste shall be stored and removed for final disposal in a manner
that protects against surface and groundwater contamination.
3. There shall be no permanent disposal of solid wastes, as defined in the Regulations
Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2), at this site.
4. The facility shall maintain compliance with Confined Animal Feeding Operations
Control Regulations (5 CCR 1002-19) and the Weld County Code, as amended.
5. The facility shall adhere to the maximum permissible noise levels allowed in the Light
Industrial Zone as delineated in Section 25-12-103 C.R.S, as amended.
6. Any required CDPS Permit shall be maintained in compliance with the Water Quality
Control Division of the Colorado Department of Public Health & Environment.
7. The facility shall not discharge run-off or other waste waters to surface or
groundwater with exception to what is allowed by the Confined Animal Feeding
Operations Control Regulations.
8. Wastes materials, not specifically addressed by other development standards, shall
be handled, stored, and disposed in a manner that controls fugitive dust, blowing
debris, and other potential nuisance conditions.
9. The applicant shall remove, handle, and stockpile manure from the livestock area in a
manner that will prevent nuisance conditions. The manure piles shall not be allowed
to exist or deteriorate to a condition that facilitates excessive odors, flies, insect
pests, or pollutant runoff. The surface beneath the manure storage areas shall be of
materials which are protective of State waters. These areas shall be constructed to
minimize seepage or percolation of manure contaminated water. In no event shall
the facility impact or degrade waters of the State in violation of the Confined Animal
Feeding Operations Control Regulation (5 CCR 1002-19).
10. The facility shall be operated in accordance with the approved odor abatement plan.
Odors detected off site shall not equal or exceed the level of fifteen-to-one dilution

threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control
Regulations. Additional controls shall be implemented at the request of the Weld
County Department of Public Health and Environment in the event odor levels
detected off site of the facility meet or exceed the level of fifteen-to-one dilution
threshold, or in the judgement of the Weld County Health Officer, there exists an odor
condition requiring abatement.
11. A spillage retention berm shall be required around any fuel container with a volume
greater than 50 gallons. The volume retained by the spillage berm should be greater
than the volume of the largest tank inside the berm.
12. The facility shall be operated in a manner to control flies. The facility shall be
operated in accordance, at all times, with the approved fly control plan. Additional fly
control measures shall be implemented at the. request of the Weld County
Department of Public Health and Environment in the event that flies (which can be
determined to be associated with the facility) are in such a number to be considered a
nuisance condition. The plan shall also be implemented in the event the Weld
County Department of Public Health and Environment receives a significant number
of fly (associated with facility) complaints, and in the judgement of the Weld County
Health Officer, there exists a fly condition requiring abatement.
13. There shall be no burning conducted at the site, with exception to burning defined as
"agricultural open burning" as defined by Regulation No. 1 of the Colorado Air Quality
Control Commission Regulations.
14. The facility shall be operated in accordance with the approved manure and waste
water management plan.
15. No cattle shall have direct access to Waters of the State except access that is
allowed per the Confined Animal Feeding Operations Control Regulation (5 CCR
1002-19).
16. The facility shall be operated and maintained in a manner to prevent nuisance
conditions.
17. All septic systems on the facility shall comply with the Weld County Code.
18. The facility shall be operated in a manner to control pests. The facility shall be
operated in accordance, at all times, with the approved pest control plan. Additional
control measures shall be implemented at the request of the Weld County
Department of Public Health and Environment in the event that rodents (which can be
determined to be associated with the facility) are in such a number to be considered a
nuisance condition.

The Weld County Public Works has reviewed this proposal; this project falls primarily under the purview of the
Use by Special Review, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and
requirements are as follows:
COMMENTS:
WCR 74 is designated as a local gravel road, which requires a 60-foot right-of-way at full build out. There is
presently 60 feet of right-of-way. This road is maintained by. Pursuant to the definition of SETBACK in the Weld
County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-
way line.
Our most current average daily traffic count (ADT) reflects 220 vehicles taken on WCR 74 between WCR 65 and
WCR 392. There was no date or time period listed.
~'y oldest count reflects 153 vehicles July 1, 1997, taken on WCR 74 between WCR 59 and WCR 61.
Existing Access: This dairy has been in existence for a quite a while. All existing accesses have a purpose for
the dairy operation. The western access appears to be utilized for the scale house and circulation. The middle
access appears to be the most used for accessing the office and coral areas. The eastern access is utilized as a
residential/agricultural access.
REQUIREMENTS:
Application Requirement Section 23-2-260 D5a: The scale of the plat plan should be one inch, equivalent to
100 feet or any usable scale if approved by Planning Services. The applicant indicted one inch = 165 feet. There
is not scale available for scaling of the plat. c1: All public rights-of-way of record associated with WCR 74
should be placed on the plat drawing identifying the existing rights-of-way.
Access: Utilize the three existing accesses to the facility.
Circulation: All feed allies shall be surfaced with gravel, and shall be graded to prevent drainage problems.
Off-Street Parking: No off-street parking adjacent to WCR 74 shall be allowed. Utilize on site parking only.
Storm Water Drainage: The remaining portion of the site not dealing with the Colorado Confined Animal
Feeding Controlled Regulations shall use this management practices.
The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably
reserve the natural character of the area and prevent property damage of the type generally attributed to run-off
late and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off.

Dear Ms. Katyryniuk,
I have received and reviewed Cornish Plains Livestock LLLP's Site Specific Development Plan
and Special Review Permit application, Case Number AmUSR-227, for a 3000 head beef feedlot
near Cornish. In addition, a site inspection was made to view the feedlot and surrounding
properties.
Due to it's size, this facility will need to be in compliance with the State's Confined Animal
Feeding Operation (CAFO) Regulations. In this regard, I would mention one area of concern.
Their application states, and visual inspection confirms, that corrals on the north side of the
feedlot drain into the Coal Ridge ditch. Normally this ditch is dry, however with a significant
rainfall event runoff from the corrals has the potential of leaving the property. [It should be noted
that if water were to leave the property, it would drain into a closed basin and not continue on to
other tributaries or water bodies.] To comply with CAFO regulations, it is recommended that the
applicant take measures to construct, and divert runoff water to, a retention structure that meets
regulatory guidelines.
Other than this one concern, I have no other issues regarding this application. If there are any

The Department of Planning Services reviewed the above referenced Use by Special Review
Landscape Plat and offers the following comments:
1The USR Plat shall be prepared in accordance with Section 23-2-260.D of the Weld County
Code. The map submitted with the application materials does not meet this standard.
iSection 23-3-250.A.4 and Section 23-3-250.A.5 of the Weld County Code addresses the
required yards and required landscape areas. Section 23-3-250.A.5.a states "No more than
eighty-five percent (85%) of the total area of a Lot shall be covered. Land shall not be deemed
covered if it is used for growing grass, shrubs, trees, plants or flowers or if covered by
decorative gravel or wood chips, or if it is otherwise suitably landscaped."
/Section 23-3-250.A.5.a states "That portion of a Lot which abuts a public or private street right-
of-way shall be landscaped for a distance of ten (10) feet, measured at a right angle from the
Lot line towards the interior of the Lot. Driveways may pass through the required landscaped
areas."
There was not a plant material list submitted that delineates the proposed plant material. One
shall be submitted for review and approval with the Landscape and Screening Plan prior to
recording the USR Plat. Future submittals shall address the type of plant material existing
or proposed for the site.
'Landscaping materials as indicated in the Approved Landscape Plan, to be submitted, shall be
maintained at all times. Dead or diseased plant materials shall be replaced with materials of
similar quantity and quality at the earliest possible time.
4The applicant shall demonstrate how the proposed plant material will be watered, thus ensuring
adequate growth and established of the feeder root system. Further, the applicant shall provide
evidence that a commercial well permit has been obtained prior to recording the USR plat.
V he application materials state that the proposed facility will be utilized as a 3000 head feedlot,
operating 24 hours per day, 7 days per week. There will be two full time and three part time
employees. Per Appendix 23-B of the Weld County Code, the number of off-street parking
spaces required is 1 space for each employee, full or part time.
/There are existing structures on site without delineated dimensions. The scale house, office
and trailer of unspecified use shall be dimensioned such that staff may determine the
appropriate parking requirement. Per Appendix 23-B of the Weld County Code, the number of
off-street parking spaces required for office related uses is one space for each two employees
plus one space for each 500 square feet of area is required. All on-site parking shall meet the
requirements of the Section 23-3-320.C.3 of the Weld County Code.
/The applicant shall delineate curb stops for the parking spaces shown on the USR plat. One
curbs stop for each space is the standard.

er Section 23-3-350.B, the applicant shall delineated sufficient screened off street parking
areas. Given the nature of the facility, an appropriate number of tractor trailer parking spaces
are also required and shall be delineated on the USR plat. All parking and loading areas shall
be screened from adjacent properties and road rights-of-way. The applicant shall delineate an
opaque visual screen on all sides of the property to mitigate the potential negative impact and
aesthetic concerns on surrounding properties.
/Section 23-3-350.D provides for adequate street access. The applicant shall demonstrate a
safe and approved access. Points of ingress and egress to this parcel shall be clearly
identified. Appropriate language shall be included on the plat delineating the access to this
parcel. The Department of Public Works should be consulted on this issue.
ISection 23-3-350.H addresses the issue of trash collection areas. Areas used for storage or
trash collection shall be screened from adjacent public rights-of-way and adjacent properties.
These areas shall be designed and used in a manner that will prevent wind or animal
scattered trash.
./Section 23-3-260 addresses operation standards for Commercial uses. The applicant shall
address the issue of on-site lighting, including security lighting in applicable. Subsection B.6
states "any lighting ... shall be designed, located and operated in such a manner as to meet the
following standards: sources of light shall be shielded so that beams or rays of light will not
shine directly onto adjacent properties...."
'The applicant has not delineated any on-site signs. The sign shall adhere to Section 23-4-90.A
and .B of the Weld County Code. One identification sign per principal use shall be allowed,
provided that the sign does not exceed sixteen (16) square feet in area per face. Further, the
location of the sign, if applicable shall be delineated on the Landscape / Site Plat. All
structures, including signs, on site must obtain the appropriate building permits.
The application map delineates one residence and one trailer. The applicant shall provide the
Department of Planning Services with appropriate documentation as to how the trailer is
permitted. If the trailer is not permitted, the applicant shall attempt to permit the trailer of
remove the trailer from the property.
/Issues associated with historic run-off and overland flow away from this facility shall be
reviewed by both the Department of Public Health and Environment and the Department of
Public Works.
/The applicant shall enter into an Improvements Agreement according to policy regarding
collateral for improvements and post adequate collateral for all transportation (access drive,
parking areas, etcetera) and non-transportation (plant materials, fencing, screening, etcetera).
The agreement and form of collateral shall be reviewed by County Staff and accepted by the
Board of County Commissioners prior to recording the USR plat.

The sheriff's office has no concerns with this Special Use Permit. The sheriff's office
would however be willing to provide a program entitled Crime Prevention through
Environmental Design to the developer. This program reduces the likelihood of criminal
activity at a specific location by"hardening" it to crime.
The Sheriff's Office lacks the ability to absorb any additional service demand without the
r , resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.
