HomeMy WebLinkAbout20040356.tiff RESOLUTION RE: ACTION OF BOARD AT SHOW CAUSE HEARING CONCERNING AMENDED USE BY SPECIAL REVIEW PERMIT#673 FOR A DOG KENNEL (MAXIMUM OF 16 DOGS) IN THE A (AGRICULTURAL) ZONE DISTRICT - CATHERINE CARIASO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on February 18, 2004, a Show Cause Hearing was conducted to consider revocation of Amended Use by Special Review Permit#673 for a Dog Kennel (maximum of 16 dogs)in the A(Agricultural)Zone District issued to Catherine Cariaso,750 Highway 60, Loveland, Colorado 80537, and WHEREAS,Catherine Cariaso is the current owner of the facility located on property being further described as follows: Part of the NE1/4 of Section 6, Township 4 North, Range 68 West of the "6th P.M., Weld County, Colorado WHEREAS,at said hearing of February 18,2004,after hearing all testimony presented,the Board deemed it advisable to continue the matter to March 3, 2004, at 9:00 a.m., to allow the respondent additional time to come into compliance, and WHEREAS, at said hearing of March 3, 2004, after hearing all testimony presented, the Board deemed it advisable to continue the matter to June 16,2004,at 10:00 a.m.,with the condition that a staff inspection be performed on March 31, 2004, confirming that the number of adult dogs (6 months and older) has been reduced to 16, and remain as such until the respondent either removes the kennel or receives approval for an amended Use by Special Review Permit allowing additional dogs, and WHEREAS, on April 14, 2004, the respondent was found to be in compliance with the maximum limit of 16 adult dogs (6 months and older), and WHEREAS, pursuant to a Sheriffs Deed, recorded on June 3, 2004, at Reception No. 3185961, the property was transferred from Catherine Cariaso, aka Dodie Cariaso, to Home State Bank, and 2004-0356 PL0434 SHOW CAUSE HEARING - AMUSR #673 - CATHERINE CARIASO PAGE 2 WHEREAS, at said hearing of June 16, 2004, after hearing all testimony presented, and having heard no statements in mitigation of the violation,the Board deemed it advisable to revoke Amended Use by Special Review Permit#673 based on the finding that the respondent is out of compliance with Development Standard #7, which states, "The Special Review Permit shall automatically expire upon lease or conveyance by the applicant of the subject parcel," and WHEREAS,the Board finds no basis for imposition of an alternative penalty in light of the fact that Catherine Cariaso no longer owns the property. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County,Colorado,that Amended Use by Special Review Permit#673, issued to Catherine Cariaso, be, and hereby is, revoked. In response to the letter dated January 30, 2004 from Dodie (Catherine) Cariaso in regards to her labrador kennel, the Department of Planning Services, Department of Public Health & Environment, and Animal Control recommend that this Show Cause Hearing be continued until June 16, 2004. Ms. Cariaso showed us her kennel facility. The site was cleaner than the previous two visits (the carpets had been cleaned the day before) and Ms. Cariaso was in the process of washing out several of the kennel carriers. Ms. Cariaso indicated that she was having an easier time maintaining her kennel operation now that the number of dogs had been reduced after removal from animal control. She indicated that she still had approximately 32 dogs. There was a sign (for sale by owner) in front of the property but Ms. Cariaso indicated that the property would likely be foreclosed upon and taken by the bank before somebody bought the property. She reiterated that she would likely be off the property by before June 1, 2004 unless she could somehow get out of default on her mortgage. She indicated that this was unlikely. SUBJECT: Inspection of Amended USR-673 kennel facility in response to zoning code violation complaint. Date: December 15, 2003 TIME: Approximately 9:30 A.M. PLACE: 750 Highway 60, Loveland CO 80537 (Amended USR-673) SUMMARY: Gary Schwartz- Weld County Sheriff's Office, Chris Gathman - Department of Planning Services, and Char Davis - Department of Public Health & Environment visited the facility in response to a zoning complaint and an animal neglect complaint. Ms. Cariaso let us into the house. In the kitchen area there were approximately five kennels along with one loose dog that was lying on a chair. We moved into a back room area where there were approximately nine kennels with approximately three puppies a piece in each kennel. The room contained a strong smell of urine, feces and ammonia. Ms. Cariaso indicated that she tried to change the blankets in the kennels and wash out the kennels every two to three days. Ms. Cariaso admitted that she had approximately 40 dogs. She has had a hard time selling the adult dogs because there is a glut of Labrador Retrievers on the market. She indicated that she would work with the County to reduce the numbers of adult dogs that she had but that she wanted to keep the puppies to sell as her source of income. Ms. Cariaso indicated that her property had been foreclosed upon and she would probably be off of the property by Spring of 2004. ON 121003 I RESPONDED TO THE ADDRESS OF 750 HIGHWAY 60 IN AN ATTEMPT TO CONTACT THE OWNER OF THE KENNEL, KATHERINE CARIASO. UPON ARRIVAL ON SCENE I WAS ABLE TO CONTACT MISS CARIASO, AND ADVISED HER THAT I HAD -GOTTEN A COMPLAINT ON THE SANITATION OF HER KENNELS, AND THAT I WOULD KE TO WALK AROUND AND CHECK THE FACILITIES. WHEN WE WALKED IN THE HOUSE, WE WALKED INTO THE KITCHEN IN WHICH THERE WERE APPROXIMATELY FIVE KENNELS. TWO OF THE KENNELS HAD TWO APPROXIMATELY SIX MONTH OLD PUPPIES IN EACH ONE. THE OTHER KENNELS ALL HAD NUMEROUS NUMBERS OF PUPPIES IN THEM. THERE WAS ALSO A DOG THAT WAS LOOSE IN THE KITCHEN AND LAYING ON A CHAIR WHEN I ARRIVED. SHE THEN NOTED THAT ALL OF THE KENNELS IN THE KITCHEN WERE DIRTY AND DID HAVE FECES IN THEM ALONG WITH URINE SOAKED BLANKETS. I WAS THEN TAKEN INTO A BACK WITH APPROXIMATELY TEN TO 15 MORE KENNELS. THIS ROOM WAS EXTREMELY DIRTY WITH FECES ALL OVER THE FLOOR AND IN EACH OF THE KENNELS. THE MAJORITY OF THE KENNELS IN THIS BACK ROOM WERE FILLED WITH LARGE AMOUNTS OF PUPPIES THAT WERE FAIRLY YOUNG. ALL OF THE KENNELS IN THE BACK ROOM WERE FILLED WITH FECES AND URINE, AND THE PUPPIES WERE COVERED IN THE FECES. AT THIS TIME I DID ASK MISS CARIASO WHEN THE LAST TIME SHE CLEANED THE KENNELS WAS, AND SHE STATED THAT SHE HAD CLEANED THEM SATURDAY MORNING, AND THIS BEING WEDNESDAY. I DID ALSO OBSERVE APPROXIMATELY FIVE TO SIX OLDER PUPPIES JUST OUTSIDE THE BACK DOOR IN A SMALL ENCLOSED CONCRETE AREA. ALL OF THOSE DOGS APPEARED TO BE WET FROM BEING OUTSIDE. THE OUTSIDE KENNEL AREA WAS --4LSO EXTREMELY DIRTY. NONE OF THE DOGS HAD AVAILABLE FOOD OR WATER. HERE WAS A BUCKET OF WARM WATER SITTING IN THE KITCHEN TO WHICH SHE WAS GOING TO WATER THE DOGS SO THEY WOULD NOT HAVE TO DRINK COLD WATER. THE TIME I WAS AT THE HOUSE, MISS CARIASO GOT MORE AND MORE AGITATED WITH MY PRESENCE. SHE WAS VERY COOPERATIVE AT THE BEGINNING AND ONCE I EXPLAINED WHY I WAS THERE, SHE BECAME MORE AND MORE UNWILLING TO GIVE ME INFORMATION. MISS CARIASO KEPT TRYING TO MAKE EXCUSES FOR THE REASONS THAT HER KENNELS WERE AS DIRTY AS THEY ARE. MISS CARIASO ALSO STATED THAT THE STATE VETERINARIAN'S OFFICE REPRESENTED BY SCOTT LEECH HAD BEEN ON HER PROPERTY EARLIER. MISS CARIASO DID SHOW ME AN INSPECTION LETTER FILLED OUT BY SCOTT LEECH SAYING THAT THE KENNEL WAS BELOW STANDARDS IN SANITATION AND NEEDED TO BE IMPROVED. I DID CONTACT SCOTT LEECH WITH THE COLORADO STATE VETERINARY'S OFFICE AND ASKED HIM WHAT HE HAD DONE. AT THIS TIME MR. LEECH STATED HE HAD DONE AN INSPECTION ON 120203 ON THE PROPERTY, AND FOUND THE PROPERTY TO BE VERY DIRTY. MR. LEECH STATED THAT HE DID GIVE MISS CARIASO A DEADLINE DATE TO CORRECT THE PROBLEMS, HOWEVER, HE COULD NOT REMEMBER OFF THE TOP OF HIS HEAD, WHAT THAT DATE WAS. MR. LEECH ALSO STATED THAT HE HAD NUMEROUS CONTACTS WITH MISS CARIASO IN THE PAST, AND SHE WAS KNOWN TO HAVE NUMEROUS PROBLEMS AT HER KENNEL. There were some dog carriers in the kitchen and approximately 9-12 dog carriers in the back room area. The dog carriers in the back room had approximately 2 adult dogs a piece. A few of the carriers had puppies. Ms. Cariaso indicated that she had let many of the dogs inside due to the cold weather. The cages appeared to be cleaner than our initial visit on December 15, 2003. She showed us outside to an outbuilding and two chainlinked dog run areas. Some dogs were outdoors, most dogs were located in dog carriers. I counted a total 19 dogs outside of the house. The issue is Ms. Cariaso's "dog kennel". As a former provider of services for Ms. Cariasco I have witnessed dog feces in her back yard, in some cases ankle deep. Although I have not reviewed her entire operation, if the care of her dogs as well as the condition of her dog runs are any indication of the environment in which puppies, as well as adult dogs are kept, I would be very concerned about the county allowing her to continue her "kennel". I was made aware of this hearing by another party and am writing this letter anonymously due to the some times vindictive nature of Ms. Cariaso. I have reviewed your file in completion, which dates back to your initial licensing with the Pet Animal Care and Facilities Act(PACFA)in 1995, and I have not found any violations relating to overcrowding of your dogs or escape of your dogs. PACFA does not set limits on numbers of animals that a facility can house,but it does set minimum square footage requirements per animal that dog breeding facilities must adhere to or exceed. It appears that you have met or exceeded these spatial requirements throughout your history with us. You have been licensed with PACFA as a small-scale dog breeder only, which means that you transfer between 24 and 99 puppies per year. Large-scale dog breeders generally have over 100 dogs and transfer over 100 puppies in a year. As compared to other dog breeding facilities throughout the state, your size could be classified as "medium-sized". I have not known you to wholesale puppies to pet stores or other retail outlets, nor have I known you to board any animals. After today's re-inspection,I have found that in reducing some of your numbers of dogs housed at your facility the sanitation has been improved.
