Dear Michelle.
Please be advised that Patina Oil & Gas Corporation ("Patina") owns an oil and gas
leasehold interest (limited from the surface to the base of the Codell formation) and is the
operator of the Fisher #1 well located on the referenced property. Patina has a joint
operating agreement with Frank L. Boulter, Thomas P. Brock, Echeverria Trust, Ronnie J.
Asmus, Robert Weakley, Dick Sherwin, Alfred Dworak, Gary Connely and Sheila Lindell
("Non Operators"). The joint operating agreement gives Patina the authority to address
, issues related to the operations of the well and leasehold. Therefore. Patina's earlier
correspondence also represents the interests of the Non-Operators, including SOCO
Wattenbcrg Corp.
The Estate of Leona B. Fisher, Michael K. Arrington, Elmer E. I.undvall and John A.
Brown are owners of the mineral interest which is leased to Patina, et al, and Patina does
not represent these parties. Additionally, States Royalty Limited is an overriding royalty
owner and does not have an interest in the mineral estate and only shares in royalty income
from the subject well.

Ladies and Gentlemen:
Patina Oil & Gas Corporation ("Patina") has been contacted by Weld County Department
of Planning Services and Rainbow Services, Inc. ("Rainbow") regarding USR-1454, a
proposed Site Specific Development Plan and Special Review Permit for Rainbow's
facilities on portions of the captioned property ("Property"). Patina owns and operates an
oil and water storage tank on the Property that is associated with the production facility for
the Fisher 41 well that is located east of the Property. Patina has been assured by Rainbow
that the proposed improvements will not interfere with Patina's operations, access or
encroach on Patina's tanks. Based upon Rainbow's representations, Patina does not see a
need for an additional surface use agreement nor does Patina object to Rainbow's
proceeding with their proposed improvements.

industrial zone districts, (an industrial machine shop) in the A(Agricultural)Zone District.
LEGAL DESCRIPTION: Lot A of RE-735; part of S2 SE4 Section 33, T5N, R65W of the 6th P.M., Weld
County, Colorado.
LOCATION: North of and adjacent to CR 50; Y mile west of CR 43.
Your property is within five-hundred (500)feet of the property on which this request has been made or you
may have an interest in the minerals located under the property. Patina is the operator for the well located
on the property in question and they have indicated in two letters dated 4/15/04 and 4/28/04 (which are
included with this letter) that they have no concerns with the proposed development. If you have any
concerns regarding this development or if you disagree with Patina statement please indicate those
concerns by appearing at the hearing on June 2, 2004 or writing a letter to the following address:
