Environmental Health Services has reviewed this proposal for a single family dwelling unit and a
home business. We have no objections to the proposal, however, we do recommend that the
following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be recorded:
1. The applicant shall submit evidence to the Department of Planning Services, from the
Colorado Division of Water Resources, demonstrating that the well is appropriately
permitted for the use.
We recommend that the following requirements be incorporated into the permit as conditions
that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed facility and shall be
installed according to the Weld County Individual Sewage Disposal Regulations.
2. The septic system is required to be designed by a Colorado Registered Professional
Engineer according to the Weld County Individual Sewage Disposal Regulations.
We recommend that the following requirements be incorporated into the permit as development
standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a
manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a solid waste in the
Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.

3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, fugitive particulate emissions, blowing debris, and other potential nuisance
conditions.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.
6. Adequate handwashing and toilet facilities shall be provided.
7. Any septic system located on the property must comply with all provisions of the Weld
County Code, pertaining to Individual Sewage Disposal Systems.
8. A permanent, adequate water supply shall be provided for drinking and sanitary purposes.

masonry fence.

The Department of Planning Services reviewed the above referenced Use by Special Review
application and offers the following comments:
The application text states that there are plans to construct one single family dwelling unit and
auxiliary quarters on the parcel. The drawing reviewed by staff delineated one proposed
structure only. Staff requests further clarification on this issue.
The applicant states in the application materials that the landscaping on-site will be native
grass. Further, the application materials state that a separate Landscape Plan will be submitted
separately. Staff requests clarification on this issue.
Landscaping materials as indicated in the Approved Landscape Plan shall be maintained at all
times. Dead or diseased plant materials shall be replaced with materials of similar quantity and
quality at the earliest possible time.
The applicant shall demonstrate how the proposed plant material will be watered, thus ensuring
adequate growth and established of the feeder root system.
The applicant shall contact the Department of Building Inspection for appropriate Building
permits that may be required for all future construction associated with this facility.

Dear Ms. Hatch:
I have reviewed the submitted material pertaining to the Site Specific Development Plan and
Permit for a Use by Special Review for the Sellers property, located west of and adjacent to Weld
County Road 17 approximately 1.4 mile south of Weld County Road 10 (Case Number: USR-
1449). The Fire District does not object to the plans, but does have the following comments and
requirements regarding the construction of a new residence on the property:
• All construction shall be in accordance with the provisions of the Uniform Fire Code, as
ratified by the Weld County Commissioners, and all other codes and ordinances, as enforced
by Weld County.
• Water supply for fire protection may be required for a new single family residence. In
instances when a request is for a recorded exemption or a special use and not a subdivision,
water supply for fire protection is not required for a single family residence that is not larger
than 3,600 gross square feet and is placed on at least a 2.5 acre site. If a residence exceeds
3,600 gross square feet, or is placed on less than 2.5 acres, water supply for fire protection
may apply. All other structures may require water supply for fire protection depending on the
use of the new structure.
• When water supply for fire protection is required and not available, the installation of a
residential fire sprinkler system will be accepted as an alternative to meeting the required fire
flow.
• Approved address numbers shall be placed on the residence or on a freestanding sign in such
a position to be plainly visible and legible from the street fronting the property. Address
numbers or letters shall contrast with their background.
• The access drive shall support the imposed loads of fire apparatus (60,000 pounds) in all
weather driving conditions and be free from obstructions, including locked gates, unless
otherwise approved.

Thank you for referring the Raeben Sellers/Tamijo LLC Use by Special Review
application to the School District. Based upon expected student generation
rates from what appears to be the possibility of one new single-family unit
on 39.32 acres, the new home would generate approximately 1 new student to be
accommodated within district. Bus transportation would likely be provided.
It is understood that approval of the special use review does not yet add a
residential unit to enrollment potential. However, certain school issues
should be considered at this important juncture, including school site
planning, transportation access and facility capacity.
The current facilities that would serve this lot are Twombly Primary, Butler
Elementary, Fort Lupton Middle School and Fort Lupton High School.

The District is on record as not opposing growth so long as the growth is
planned and is manageable from a student enrollment standpoint. This
development could impact all levels of schools. In addition, even without
this project, completion of other previously approved developments would
generate more students than can be accommodated by the existing schools.
A COMMUNITY WHICH BELIEVES EDUCATION IS A SHARED RESPONSIBILITY

As the volume of developments increases with no alleviation of the existing
capacity conditions, the ability to provide the same quality education for
these new students becomes increasingly difficult. Weld County School
District Re-8 requests the cooperation and participation of the developer to
provide cash in-lieu of land dedication fee, (currently $939) , to address the
need for future school sites. Further, the District requests that the County
assist with monitoring residential growth working and consider facility
capacity impacts upon the schools in determining whether a new project should
be approved.
We appreciate your cooperation and the opportunity to comment upon the issues
of interest to both the County and the School District. We ask that the
building permit not be issued until the applicant demonstrates that the cash
in-lieu of land dedication fee has been paid, or that arrangements have been

The Weld County Public Works has reviewed this proposal; this project falls primarily under the purview of the
Use by Special Review, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and
requirements are as follows:
COMMENTS:
WCRs 10 and 17 are designated on the Road Capital Improvement Plan in the County Wide Impact Fee Code
Ordinance, Section 20-1-30, as local gravel roads, which require 60-foot rights-of-way at full build out. There
are presently 60-foot rights-of-way. Both roads are maintained by Weld County. Pursuant to the definition of
SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback measured
from the future right-of-way line.
Our most current traffic count was taken on May 9, 2003, on WCR 17 between WCRs 8 and 10. It reflected 94
rehicles taken in a 72-hour period.
REQUIREMENTS:
Access: The main access point is being identified to access the existing oil and gas tank battery site. The
applicant identified that there is an existing access from WCR 17. Utilize this access point.
The plat drawing identified a 30-foot nonexclusive access and utility easement from WCR 10. If the applicant
chooses to use this access easement, verification of the type of access and the use is required in the way of a
deed or recording number identifying the type of access in the permitted uses. The applicant identified on the
drawing an access from this nonexclusive easement. Verification is needed on which access the applicant has
proposed to use for the facility either from WCR 10 or from 17.
If the applicant chooses to use the 30-foot nonexclusive access and utility easement for the residential/home
business access point, notification to adjacent property owners along that 30-foot nonexclusive access should
be given as the applicant is changed the use of the access easement from residential to construction-type use.
This documentation should be provided to the Weld County Public Works Department and the Planning
Services.
The access easement shall be a graded and drained road to provide an all-weather access.
Outbuilding/Storage: I cannot comment on circulation, equipment parking, or material storage, as there are
no out buildings, indoor, or outdoor storage areas identified on the plat drawing. The applicant identified
parking south of the house. Is this residential vehicle parking or construction parking?

Off-Street Parking: The off-street parking including the access shall be surfaced with gravel or the equivalent
and shall be graded to prevent drainage problems.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a
manner that will reasonably preserve natural character of the area and prevent property damage of the type
generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding
of storm run-off.

There are no active or historical building permits on record for this applicant's name, parcel or
address.
1. Building permits shall be obtained prior to the construction of any building. Buildings that
meet the definition of an Ag Exempt Building per the requirements of Section 29-1-20 and
Section 29-3-20 B.13 do not need building permits, however a Certificate of Compliance must
be filed with the Planning Department and an electrical and/or plumbing permit is required for
any electrical service to the building or water for watering or washing of livestock or poultry.
2. A plan review is required for each building except for buildings that meet the definition of Ag
Exempt buildings. Plans shall bear the wet stamp of a Colorado registered architect or
engineer. Two complete sets of plans are required when applying for each permit.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the
time of permit application. Current adopted codes include the 1997 Uniform Building Code;
1998 International Mechanical Code; 1997 International Plumbing Code; 2002 National
Electrical Code and Chapter 29 of the Weld County Code. (Weld County intends to adopt the
2003 International Building, Residential, Mechanical, Plumbing and Fuel Gas Codes early in
2004).
4. Each building will require an engineered foundation based on a site-specific
geotechnical report or an open hole inspection performed by a Colorado registered engineer.
Engineered foundations shall be designed by a Colorado registered engineer.
5. Building height, wall and opening protection and limitations and separation of buildings of
mixed occupancy classifications shall be in accordance with the Building Code. Setback and
offset distances shall be determined by the Zoning Ordinance.
6. Building height shall be measured in accordance with the Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction
and to determine compliance with the Bulk Requirements from Chapter 27 of the Weld County
Service,Teamwork, Integrity,Quality

Code. Building height shall be measured in accordance with Chapter 23 of the Weld County
Code in order to determine compliance with offset and setback requirements. Offset and
setback requirements are measured to the farthest projection from the building.
7. A Flood Hazard Development Plan shall be submitted for buildings constructed within the
100-year flood plain.
