The letters provided notice to the mineral owners regarding resumption of the application process for USR 1350. Enclosed with this letter are copies of the return receipts from each of the mineral interest owners who received the August 6,2004 letter. As the mailing to Merit Energy was returned undelivered, another letter was mailed to Merit on August 20, 2004. A copy of that letter and the return receipt is enclosed. The status of communications to date with the noticed mineral interest owners is as follows: • Encana advised that it does not have mineral interests or facilities that will be affected by the proposed operations. Verification by letter dated August 23,2004 is enclosed. • TOP Operating advised that it does not have mineral interests or facilities that will be affected by the proposed operations. Verification by letter dated November 2, 2004 is enclosed. • Kaiser Francis did not provide a written response to AI,however following a second letter mailed September 30,2004,John Keller of Kaiser Francis called and left a voice mail for me on October 4, 2004. He stated that the only interest that Kaiser had in the vicinity was in a well called "Sakata",which he advised was outside the proposed mining operations and permit boundary. He also indicated that the Sakata facility and associated interests had been sold to Patina effective September 1, 2004. • Patina Oil &Gas Corporation and SOCO Wattenberg Corporation,represented by Mr. David Padgett,responded by telephone to Al's August 6,2004 letter, indicating that neither Patina nor SOCO have existing facilities or future oil and gas interests within the proposed mine area. A letter requesting written verification on behalf of Patina and SOCO was mailed to Mr. Padgett on September 29, 2004. A copy of the letter,together with a postal return receipt, is enclosed. Written verification has not been provided,however, lacking a response to the contrary AI believes that the statements contained in its September 29, 2004 are verified. I met with Mr. Holloway on August 24,2004,to discuss appropriate mining set-backs and other options. Based upon information provided by Mr. Holloway by telephone on October 12,2004, AI does not contemplate at this time pursuing buy-out or relocation options but will maintain appropriate set-backs as discussed with Mr. Holloway and in accordance with State Division of Minerals and Geology regulations. • Merit Energy facilities and interests are outside of proposed limits of mining with the exception of the Briggs#1 well within the area identified as Phase I(Pond 2 Mining Area)on DMG Exhibit C Mining Plan. I met with Mr. Frank Holubek of Merit on site on November 12, 2004 to discuss appropriate mining set-backs and other options. Al is evaluating options based upon information provided via e-mail from Mr.Casey Morton of Merit on December 13, 2004,and will maintain appropriate set-backs as discussed with Mr. Holubek and in accordance with State Division of Minerals and Geology regulations until such time as AI would determine to pursue the other options. • Kerr McGee has existing facilities within the proposed mining limits of Phase I(Pond 2 Mining Area),DMG Exhibit C Mining Plan, and facilities and future interests within proposed mining limits of Phase II(Pond 3 Mining Area), DMG Exhibit C Mining Plan. I met with Mr. Chris Greneaux and Mr. Matt Miller of Kerr McGee on August 27,2004 to discuss appropriate mining set-backs,directional drill locations and other options. Following numerous requests from AI, Mr. Greneaux advised by e-mail on November 29, 2004 that they will review Al's proposed language for an agreement regarding mining activities and Kerr McGee's rights and interests as they relate to existing and future oil and gas facilities but that it would take some time. Al's proposed language was originally provided to Mr. Greneaux by letter dated December 1, 2001. A copy of that letter was again provided to Mr.Greneaux during the August 27,2004 meeting. It is the intent of Al to maintain appropriate mining set-backs from existing facilities as discussed with Kerr McGee and in accordance with State DMG regulations and to provide appropriate future drill locations as discussed during the August 27,2004 meeting. AI respectfully requests that the County accept the letters provided to mineral interest owners in August 2004,together with this letter and enclosures documenting its ongoing communications, as appropriate notice to mineral interest owners and proceed with scheduling the Planning Commission hearing at the earliest possible date.
