HomeMy WebLinkAbout20052628.tiff RESOLUTION RE: APPROVE MILEAGE REIMBURSEMENT RATE DUE TO HURRICANE KATRINA WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Section 30,11-107(T), C.R.S., allows the Board of County Commissioners of Weld County to set the mileage reimbursement rate for all Weld County officers, employees and agents in an amount not less than twenty cents per mile, nor more than a rate per mile equal to the standard mileage rate allowed pursuant to 26, U.S.C. 162, as amended, and regulations promulgated thereunder, and WHEREAS,the Board of Weld County Commissioners on November 5, 2001, indexed the mileage reimbursement rate at two cents per mile below the standard mileage rate allowed pursuant to 26, U.S.C.162, and WHEREAS, the Board of Weld County Commissioners, due to the rapid increase of gas prices caused by Hurricane Katrina, desires to allow the mileage reimbursement rate to equal the standard mileage rate allowed pursuant to 26, U.S.C. 162 of 40.5 cents per mile for the time period of September 1, 2005, through December31, 2005, to allow employees to recover the maximum amount allowed under state law during this unusual gas market, and then have the policy of November 5, 2001, resume on January 1, 2006, when the IRS had an opportunity to adjust the mileage reimbursement rate to reflect the market rate of gas at the time. NOW, THEREFORE, BE IT RESOLVED by the Board of Weld County Commissioners, that due to the rapid increase of gas prices caused by Hurricane Katrina that the mileage reimbursement rate be increased to equal the standard mileage rate allowed pursuant to 26, U.S.C.162 of40.5 cents per mile for the time period of September 1, 2005,through December 31, 2005, to allow employees to recover the maximum amount allowed under state law during this unusual gas market. BE IT FURTHER RESOLVED by the Board of Weld County Commissioners,that the policy of November 5, 2001, will resume on January 1, 2006,when the IRS had an opportunity to adjust the mileage reimbursement rate to reflect the market rate of gas at the time pursuant to 26, U.S.C.162.
