RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0300203
AGAINST DEAN VANCE AND DEBRA WIRKNER-VANCE FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Dean Vance and Debra Wirkner-Vance,VI#0300203, are allegedly in violation
of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of January, 2005, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS,Dean Vance and Debra Wirkner-Vance were not present or represented at said
hearing, although all parties were notified of said hearing by Department of Planning Services staff,
and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Dean Vance and Debra Wirkner-Vance to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties.

immediate action.

justify the use for the second home.
Call for inspections on permit number BC-0000756 for the interior remodel once the
issue with the mobile homes is resolved so a certificate of occupancy can be issued.
This meeting will take place in the County Commissioners' Hearing Room, First Floor, Weld County
Centennial Center, 915 10th Street,Greeley, Colorado. It is recommended that you or a representative be in

Dear Mr. and Mrs.Vance:
This letter is in regard to our conversation today at the Department of Planning Services. Currently the Department of Planning
Services is processing a building permit and Flood Hazard Development Permit for a stick built house that has been on the
property since prior to 1972. Apparently,there are two additional mobile homes located on the property, as well as the stick
built house. The two mobile homes were permitted in 1977 and 1979 as Accessory to the Farm mobile homes (definition
included with letter), which is a temporary use, as long as the use can be substantiated. These permits have not been
substantiated for the use as Accessory to the Farm in quite some time. You also indicated that the titles were purged and both
mobile homes are now on permanent foundations. The Department of Planning Services does not have any record of building
permits for those foundations or Flood Hazard Development Permits for either mobile home. As explained to you,one single
family dwelling per legal lot is allowed by right in the Agricultural Zone District (Section 31.2.1 of the Weld County Zoning
Ordinance,enclosed with this letter).
There are several different options to bring the property into compliance with today's regulations, as listed below:
1. Remove both of the mobile homes from the property once the Certificate of Occupancy for the stick built home has been
issued.
2. Permit one or both of the existing mobile homes in accordance with the Weld County Zoning Ordinance (mobile home,
Section 43,and flood hazard,Section 53,of the Weld County Zoning Ordinance included with this letter). All appropriate permits
shall be applied for and approved.
3. Apply for a Recorded Exemption to allow for one residence per legal,buildable parcel. (This application has been included
with this letter for your convenience).
4. Apply for a Site Specific Development Plan and Special Review Permit(USR)for more than one single family dwelling unit
per lot other than those permitted under Section 31.2.1 of the Weld County Zoning Ordinance, as described above. (An
application for a USR is enclosed with this letter).
Other options may also be available to you. If you have any questions regarding your property, please feel free to come in or

SECTION VI
6.1 Uses Permitted •
(1 ) General - In any zoning district where a building, structure or use
is enumerated, any other building, structure or use which is similer
to those enumerated and no more obnoxious or detrimental to the area
in which it is located, shall he permitted.
(2) Mobile Homes
(A) Mobile homes shall he permitted in the MH, Mobile Home District.
as a Use by Right subject to the provisions of the MH, Mobile
Home District.
(B Mobile homes shall be permitted in the A-Agricultural District
as an accessory use on a farm provided there is not more than
one such mobile home per farm and that the mobile home is
occupied by persons employed on the farm and their families.
(C) Mobile homes shall be permitted in the A-Agricultural District:
as a principal use, nrevided such mobile homes meet all conditions
of the Weld County Eu :;;ling Code (except that wall heights may L
less than required by the County Building Code) and further pro-
dided that each N:ohile nome is first approved as a use by special
review of the Count,' Planning Commission.
(D) In the A-Agricultural District a mobile home may be occupied as
a temporary use derinq the construction of a residence on the
same lot subject to the following special conditions:
1 . Before a temporary permit is issued for the mobile home,
a building permit shall be obtained for construction of a
permanent dwelling on the same lot.
2. Construction of the permanent dwelling shall be commenced
within 90 days of issuance of the temporary permit for the
mobile home and shall be diligently pursued.
3. The temporary permit for occupancy of the mobile home shalt
be valid for a period of six months subject to renewal .
4. The temporary hermit shall be issued by the Board of County
Commissioners or its authorized representative subject to
such fees as may he established by the Board of County
Commissioners.
(E) Mobile homes shall be permitted as an accessory use limited to one
mobile home per le L -iny B, Business District, C, Commerical
District, or I , '.rusi." i:l District where a mobile home is ne
to house an employee oe the property for purposes of protecti
or control of the principl use of the lot.

TO WHOM IT MAY CONCERN:

The septic system located on the property owned by Jerry Brewer,
12475 Weld County Road 23, Ft. Lupton, Colorado in Section 35,
Township 3 North, Range 67 West, was not installed with Weld
County Health Department permit. This system serves a mobile
home.
Steve Strandberg, Sanitarian, Environmental Health Services, made
a visual inspection on Wednesday, October 26, 1977 of the area and
could not detect that the system was malfunctioning. He spoke
with Mr. Brewer and found that Mr. Brewer installed the system
himself approximately 21 years ago.
We cannot determine the depth of the system and whether or not
potential or existing problems exist with water table.

this certificate , the site upon which the mobile home is to
be placed is zoned in a class which does not preclude the
implacement of a mobile home and further that all conditional use
permits and other requirements for placing such mobile home
have been obtained or will be obtained prior to the placement
of the home.
Borrower further certifies that site is either served by
a central sewage and water facility subject to supervision
and control by a government authority, or the site has a
minimum size of not less that one-fourth acre .
It is understood that the undersigned parties make this
representation to Green Tree Acceptance , Incorporated for the
purposes of obtaining an FHA insured loan.
