The Department of Planning Services has determined that the changes are significant from the original applicant and request that the referral agencies review the changes and amend your referrals accordingly. I have provided you their request for changes and a copy of their original application. 1. The applicant is requesting to increase the number of employees on site from the originally proposed ten (10) to twenty (20) employees. 2. Originally the application was for the storage of passenger vehicles, including autos, trucks, and motorcycles. The applicant is requesting to change that list to state 'the site will be limited to the storage of a range of vehicles assigned to the users of the property by insurance companies for potential sale. Those vehicles have included: cars, trucks, sport utility vehicles, vans, recreational vehicles, buses, semi's, tractor-trailers, trailers, motorcycles, all-terrain vehicles, scooters, mopeds, boats, jet-skis, small tractors, backhoes, and bulldozers.' 3. The Department of Planning Services is also requesting with the original application that the Special Use Permit is for COPART (an insurance company for the processing and selling intact insurance damaged vehicles) and shall not be transferable to any successors in interest to the prescribed property and shall terminate automatically upon conveyance or lease of the property to others for operation of the facility. The applicant is requesting that this language change to read as follows 'The Special Use Permit was originally granted to COPART (a company that provides services to insurance companies relating to the processing and selling of intact insurance damaged vehicles). This Special Use Permit may be transferred by COPART to any company which acquires COPART and intends to continue the operation of the Property without change from those conditions identified in this Special Use Permit. In the alternative, COPART may transfer this Special Use Permit to any "Related Entity" which is defined to mean an entity in which COPART is a shareholder, member of a limited liability company, or an owner of a company which is a subsidiary of COPART or a related entity of COPART provided that COPART delivers to Weld County a Notice of Transfer 30 days prior to the completion of that transfer and identifies the relationship or ownership interest that COPART will have in the related entity. No other transfer by COPART of this Special Use Permit shall be permissible. • 4. The Department of Planning Services is requesting that 'the application does not propose any portion of the site to be leased to another party. In the event that a portion of the building is proposed to be leased to another party in the future, the applicant shall submit a copy of the lease agreement and information regarding the proposed use of the leased portion to the Weld County Building Inspection Department, Greater Brighton Fire Protection District and the Department of Planning Services for review. Based upon the proposed use and/or impacts of the leased portion, the Department of Planning Services may require an Amended Use by Special Review application.' The applicant is requesting that the language be changed to read as follows. 'This condition shall not prevent COPART from leasing a portion of a building as an office to an insurance company with whom COPART regularly conducts business. COPART shall notify Weld County of any such lease and provide Weld County with a copy of the lease, but such leasing shall not require an Amended Use By Special Review Application. COPART, Inc. continues to believe that the language of the revised Condition 23 is not substantially different than the language of the original application filed by COPART, Inc. It is understood that you will be providing this language as well as other information to entities for review and the purpose of this letter is to provide additional understanding to why the language was requested. During the Planning Commission hearing, I suggested that 85% of the vehicles placed at the COPART, Inc. site would be automobiles. In fact, that estimate was too conservative. In the last four years of the Denver operation, at a minimum, 97.5% of the vehicles placed on site were automobiles. Based upon the contracts that COPART, Inc. has with insurance companies, it must accept other damaged types of equipment from insurance companies for potential sale as well. Based on the information supplied by COPART, Inc., approximately 1% of the remaining 2.5% of other vehicles is attributable to motorcycles and ATV vehicles. The remaining 1.5% represents a variety of recreational equipment and industrial equipment. In the industrial. equipment category in the year 2004 of the 70 items received, 27 were semi tractors, 19 were semi trailers, 13 medium-sized trucks and four were commercial vans or delivery trucks. The information provided suggests the language of the revised Condition 23 is consistent with the original application and the primary use of the site will be for the storage of automobiles, SUVs and pick ups which are the majority of the vehicles subject to insurance claims and which are provided by insurance companies to COPART, Inc.
